About this file

This is an Emergency Purchase Statement issued by the State of Illinois Chief Procurement Office for the Illinois State Police (ISP) Forensic Sciences Command for continued Digital Asset Management System (DAMS) services from the incumbent vendor, Foray, LLC. The emergency purchase authorizes continued software licensing and support for Foray's DAMS to provide uninterrupted access to the ISP-configured environment for secure digital evidence image capture, storage, retrieval, and audit trail management. Services include system access for ISP Latent Prints and Footwear/Tiretrack examiners, ongoing customer support (minimum 8am-5pm CST, Monday-Friday), maintenance and backups, and interoperability with ISP's Laboratory Information Management System (LIMS), NEC ABIS, and Adobe Photoshop. The emergency contract was awarded effective July 1, 2026, and is designed to bridge operations during the competitive RFP process currently underway for DAMS services.

The emergency purchase was necessitated because the existing Foray contract (P-83173) expired on June 30, 2026, and the competitive RFP directed by the CPO office following a sole source justification hearing could not be completed before expiration. The ISP determined that transitioning to an alternative DAMS vendor would require data migration, retraining, LIMS/ABIS integration, and validation—a process that cannot be completed within the emergency timeframe and would itself cause service disruption to forensic casework operations. ISP searched the Business Enterprise Program (BEP) vendor database and found no BEP-certified vendors offering a compatible digital asset management system. The estimated expenditure for this emergency purchase is $61,947.00, funded through State Appropriated Funds. The contract is signed by Leann Fitzgerald, Acting Agency Procurement Officer, dated July 1, 2026.

Emergency Condition (select the appropriate option from the drop-down menu below):

To prevent or minimize serious disruption in critical State services that affect health, safety, or collection of substantial State revenues

Provide a description and reasons for needing this emergency purchase:

The Illinois State Police (ISP) Forensic Sciences Command requires continued access to Foray, LLC’s Digital Asset Management System (DAMS) to prevent serious disruption to forensic casework operations. The ISP Latent Prints and Footwear/Tiretrack disciplines rely on this system to capture, store, and manage digital evidentiary photographs and images in a secure, auditable environment. Without continued access, ISP would be unable to work cases, compromising the integrity of the criminal justice system and the agency’s statutory obligations. ISP was directed by the CPO’s office to conduct an RFP for Digital Asset Management System services following a hearing regarding sole source justification. ISP is actively preparing that RFP;

however, the competitive procurement process cannot be completed before the current contract term expires. This emergency purchase will bridge the gap between expiration of the existing Foray contract and the anticipated award of a new contract under the forthcoming RFP.

Provide the conditions and circumstances that led to the need for this emergency purchase:

ISP has contracted with Foray, LLC for Digital Asset Management System services under a series of sole source contracts and renewals (most recently P-83173, covering July 1, 2025 through June 30, 2026). Following a CPO hearing on the sole source justification, ISP was directed to conduct a competitive procurement (RFP) to open the market for DAMS services beyond Foray. ISP has been preparing the required RFP, but the complexity of the technical requirements and the RFP development timeline have made it impossible to complete the competitive process before the current contract term expires on June 30, 2026. Because the DAMS is mission-critical to daily forensic casework, and an interruption in access would prevent examiners from documenting, processing, or retrieving evidentiary images, ISP requires an emergency extension to maintain continuity of services while the RFP proceeds to award.

Reason for selection of this particular vendor:

Foray, LLC is the incumbent provider of the DAMS currently in use by ISP. Transitioning to an alternative system requires data migration, retraining, LIMS/ABIS integration, and validation, a process that cannot be completed within the timeframe of this emergency period. No alternative vendor can provide immediate continuity of the existing operational environment. Foray is selected solely to bridge operations during the competitive RFP process currently underway.

Description of supplies or services to be provided:

Continued software licensing and support for Foray’s Digital Asset Management System (DAMS), including access to the existing ISP-configured environment for secure digital evidence image capture, storage, retrieval, and audit trail management. Services include: system access for ISP Latent Prints and Footwear/Tiretrack examiners; ongoing customer support (minimum 8am–5pm CST, Monday–Friday); maintenance and backups; and interoperability with ISP’s LIMS (Laboratory Information Management System), NEC™ ABIS, and Adobe Photoshop.

Emergency procurements shall be made with as much competition as is practicable under the circumstances, and agencies shall utilize best efforts to include contractors certified under the Business Enterprise Program in its emergency procurement process. 30 ILCS 500/20-30(a).

Describe the actions taken by the agency to make the emergency purchase with as much competition as is practicable under the circumstances:

ISP contacted Foray, LLC as they are the source capable of providing uninterrupted access to the existing Digital Asset Management System environment during the emergency period. The nature of this emergency requires continuity of the specific software system currently in use, including all integrated case data, LIMS/ABIS integrations, and examiner workflows.

No alternative DAMS vendor can provide equivalent operational access on an emergency basis without a data migration, system implementation, and validation period that would itself cause the disruption this emergency purchase is intended to prevent.

ISP is currently preparing a competitive RFP for Digital Asset Management System services, as directed by the CPO's office following prior sole source hearing. That competitive process will provide the full market opportunity for alternative vendors.

List the actions taken by the agency that constitute its best efforts to include contractors certified under the Business Enterprise Program in this emergency purchase:

ISP searched the BEP vendor database for contractors certified under the Business Enterprise Program with the capability to provide Digital Asset Management System software and support services meeting ISP's technical requirements. No BEP-certified vendors were identified that offer a digital asset management system compatible with ISP's existing operational environment, including required integrations with ISP's LIMS, NEC™ ABIS, and Adobe Photoshop. Because this emergency purchase requires continuity of the specific system and no BEP-certified vendor can provide equivalent services on an emergency basis, ISP was unable to include a BEP-certified contractor in this purchase. BEP participation requirements will be incorporated into the forthcoming competitive RFP for Digital Asset Management System services.
