About this file
This is an Amendment One to a Notice of Availability of Funds and Funding Opportunity Announcement (FOA) from the U.S. Department of Labor, Employment and Training Administration for Program Year 26 Workforce Innovation and Opportunity Act (WIOA) Indian and Native American Programs Employment and Training Grants. The FOA number is FOA-ETA-26-20, with an application deadline of May 22, 2026, at 11:59 p.m. Eastern Time.
The amendment modifies Section II.A.1 (Eligibility) to specify three categories of eligible applicants: Federally recognized Native American tribal governments, Native American tribal organizations meeting criteria under 25 U.S.C. Section 5304(l), and 501(c)(3) nonprofits (excluding institutions of higher education). Eligible nonprofits are limited to Alaska Native-controlled organizations, Native Hawaiian-controlled organizations, Indian-controlled organizations serving Indian and Native Americans including Tribal Colleges and Universities, consortiums of eligible entities, and State-recognized tribal organizations meeting specified definitional requirements. Faith-based organizations are encouraged to apply and will not face discrimination based on religious character. Current recipients from the 2022 competition (FOA-ETA-22-05) must reapply to receive additional funding. New entities must have populations in their designated geographic service area that would receive at least $100,000 under the funding formula, though the Grant Officer may consider applications below this threshold if additional geographic areas are added. Incumbent grantees receiving less than $100,000 as of October 18, 2016, are grandfathered and may continue receiving less than $100,000 if they have continuously met this requirement. An exception to the $100,000 minimum applies to applicants consolidating resources under Public Law 102-477 if consolidated resources total at least $100,000 with minimum $20,000 from Section 166 funds. Questions should be directed to INAP.OGM@dol.gov.

Employment and Training Administration
NOTICE OF AVAILABILITY OF FUNDS AND FUNDING OPPORTUNITY ANNOUNCEMENT
(FOA) FOR: Program Year 26 Workforce Innovation and Opportunity Act (WIOA), Indian and Native American Programs – Employment and Training Grants
ANNOUNCEMENT TYPE: Amendment One
FUNDING OPPORTUNITY NUMBER: FOA-ETA-26-20
SUMMARY: The Employment and Training Administration announced April 2, 2026, the availability of funds and the Funding Opportunity Announcement (FOA) for Indian and Native American Program grants to be awarded through a competitive process. The closing date for receipt of applications is May 22, 2026, at 11:59 p.m. Eastern Time.
Section II.A.1 [ELIGIBILITY] is hereby amended per the edits in red font below:
1. The following organizations are eligible to apply:
• Native American tribal governments (Federally recognized)
• Native American tribal organizations (other than federally recognized tribal governments)
• Nonprofits having a 501(c)(3) status with the IRS, other than institutions of higher education
To be eligible as a Native American tribal organization, an applicant must meet the criteria as defined in 25 U.S.C 5304(l):
• The recognized governing body of any Indian tribe; any legally established organization of Indians which is controlled, sanctioned, or chartered by such governing body or which is democratically elected by the adult members of the Indian community to be served by such organization and which includes the maximum participation of Indians in all phases of its activities: Provided, that in any case where a contract is let or grant made to an organization to perform services benefiting more than one Indian tribe, the approval of each such Indian tribe shall be a prerequisite to the letting or making of such contract or grant.
Eligible Nonprofits with 501(c)(3) status with the IRS are limited to the following organizations:
• Alaska Native-controlled organizations;
• Native Hawaiian-controlled organizations;
• Indian-controlled organizations serving INAs, including Tribal Colleges and Universities as defined at 20 CFR 684.130;
• A consortium of eligible entities which meets the legal requirements for a consortium, as defined in 20 CFR 684.200(e); and
• State-recognized tribal organizations that meet the definition of an Indian-controlled organization, as defined in 20 CFR 684.130 and incumbent State-recognized tribes that meet the requirements at 20 CFR 684.130.
Faith-based organizations are encouraged to apply, as are all eligible organizations. Those that meet the eligibility requirements may receive awards under this funding opportunity. DOL will not, in the selection of recipients and administration of the grant, discriminate on the basis of an organization’s religious character, affiliation, exercise, or lack thereof, or on the basis of conduct that would not be considered grounds to favor or disfavor a similarly situated secular organization.
Current recipients of the INAP Employment and Training Grants that received an award and subsequent annual allotments under the last competition in 2022 (FOA-ETA-22-05) must apply under this FOA if they wish to receive additional funding. The list of current recipients, along with their Program Year 2025 funding allocations, may be found at: Program Year 2025 Funding Allotments and Application Instructions for the WIOA Section 166 Indian and Native American Programs Grantees.
In accordance with 20 CFR 684.200(b):
A new entity (not an incumbent grantee) must have a population within the designated geographic service area which would receive at least $100,000 under the funding formula found at § 684.270(b), including any amounts received for supplemental youth services under the funding formula at §684.440(a). The Grant Officer may consider applications that do not initially meet the $100,000 funding threshold if the Grant Officer offers – and the applicant accepts – additional geographic areas to its application to meet the $100,000 threshold.
And in accordance with 20 CFR 684.200(c) and (d):
Incumbent grantees that do not meet the dollar threshold under the funding formula and were receiving INA funding of less than $100,000 as of October 18, 2016, will be grandfathered into the program and are eligible to be awarded less than $100,000, provided the grantees have continuously received less than $100,000 since October 18, 2016, and submit an application in accordance with Section IV of this FOA.
The Department will make an exception to the $100,000 minimum for applicants that apply for WIOA funding through Public Law 102-477, as amended by Public Law 115-93, the Indian, Employment, Training and Related Services Consolidation Act of 2017, if all resources to be consolidated under the Public Law 102-477 plan total at least $100,000, with at least $20,000 derived from Section 166 funds.
Incumbent Public Law 102-477 grantees that were receiving INA funding of less than $20,000 as of October 18, 2016, will be grandfathered into the program and are eligible to be awarded less than $20,000 provided the grantees have continuously received less than $20,000 since October 18, 2016.
