Amendment 1 FN1507-21 Systems Parts and Components
Q: Is UNICOR only accepting submissions electronically (facsimile or email) – If so would UNICOR also like a hard copy forwarded in addition to the electronic version? If electronic submission only– what is the size limitation for what UNICOR’s system will accept?
A: Offerors may submit hard copies of the proposal to Linda Kerr and Tatea Cavanaugh. The proposal submission to Linda Kerr shall contain all submission requirements in response to the solicitation and the pricing for the typicals. The proposal submission to Tatea Cavanaugh, shall include all submission requirements in response to the solicitation with the exclusion of pricing.
UNICOR Federal Prison Industries McKean 6975 Route 59 Lewis Run, PA 16738 Attn: Linda K. Kerr, Supv. Contract Specialist Phone: (814) 362-4155 UNICOR Federal Prison Industries, 400 First Street NW Washington, DC 20534 Attn: Tatea Cavanaugh, Chief of Sales Phone (202)-305-7302 Q: Due to all of the submission requirements – the files needed as a response will be very extensive. Does UNICOR have the ability to do a file transfer?
A: We cannot accept file transfers Q: If award is being based off of typicals and UNICOR purchases by components – does UNICOR want comprehensive component lists for each product line proposed be submitted with the bid response or just the listed typicals priced at the model level?
A: Award will be based off of typicals so that UNICOR can do an apples to apples comparison of each offerors proposal. However the typical pricing shall be broken into component. 2 of 5 Q: If complimentary items (ex. sneeze guards, mobile screens, etc.) are available for the typicals listed – how should those be submitted as part of a proposal?
A: If complimentary items are available for the typicals they shall be priced as option items and not included in the base typical price Q: Delivery is stated as 14 calendar days after receipt of order. Many components used in Systems Furniture are available with a 14 day delivery but due to its complexity and the high volume nature of many essential components a 14 day lead-time for all required components is not very realistic. There will be thousands of components in the various price lists submitted - many of these components are not required very often (at times only used every few years); therefore, they will not be stocked and will need to be sourced when they are required.
As such would it be satisfactory to provide designated lead-times with a maximum of 28 days (14 – 28 days) for each component under each specific product line listed with our bid response?
A: UNICOR will accept 14 calendar day delivery for items to UNICOR Milan, however items to be delivered to all other UNICOR locations will be changed to 21 calendar days.
Q: The sample Bill of Material included with the bid makes allowances for quantity price break points. Based on the size of the accompanying component lists for the entire product offering this would be very difficult to administer at the individual Purchase Order level – would UNICOR allow for an annual sales volume discount in its place?
A: As stated in the solicitation the offeror shall provide quantity price breaks and no annual sales volume discount will be allowed.
Q: Due to the size of the required ANSI/BIFMA test results – would it be sufficient to supply a summary of the test results or does UNICOR require all test results in their entirety be submitted with the bid response?
A: No summaries will be accepted, offerors shall provide ANSI/Bifma test results as requested in the solicitation.
Q: If all test results need to be supplied in their entirety do, we need to supply test results for product lines that are already part of UNICOR’s portfolio (ex. System XXI/Classic XXI, PowerWorks/Crescendo, etc.).
A: All products new and existing shall provide the ANSI Test Results.
Q: Under Submission Requirements listed on page 71 – item 14 states Green Guard certification is required. UNICOR replaced Green Guard certification utilizing a sub-licensing agreement for SCS Indoor Air Quality certification so can SCS certificates be submitted as part of our response versus Green Guard? 3 of 5 A: Yes, SCS certificates is acceptable.
Q: Does the successful bidder have to have a sub-license agreement in place with SCS or like organization for their products that UNICOR can utilize?
A: Any offeror receiving award shall provide UNICOR with sub-licensing.
Q: In regard to property; UNICOR is requesting sole intellectual property rights to all products offered; is this correct? This is not possible; the bidders would not be able to produce their own products legally for any other customers.
A: The solicitation does not state all products offered, however, the solicitation does state the following:
Vertical Integration Plan: Offeror(s) must submit a written vertical integration plan that will give FPI the right to vertically integrate any component parts or subassemblies for the products under this contract, with the exception of any limitations that are specified in the offeror's proposal and incorporated into the contract (for example: proprietary components that are supplied by a subcontractor(s)). Further, FPI may substitute alternative components that it manufactures or assembles as long as those components meet form, fit and function requirements. The offeror(s) will give FPI the right to, and assist to vertically integrate or outsource any component parts or sub-assemblies. Attention should be paid to the level of additional inmate employment that is expected, the required investment in equipment or tooling, any proposed compensation due to the contractor (and the services provided for that compensation), and the effect upon FPI's total costs to manufacture the products. Should FPI Invoke Vertical Integration on specific part(s) it shall be agreed that offeror will not implement an engineering change to discontinue the specific part(s) unless mutually agreed upon by FPI and offeror. If offeror discontinues the part or makes an engineering changes to the part(s) without FPI’s consent, offeror will pay FPI for all costs incurred.
Design Capabilities and Engineering Services
Offeror(s) shall provide engineering and design support. In all cases, the design rights and intellectual property rights would become UNICOR's either after some period of time or in design fees paid to the offeror(s). UNICOR can at any time elect to produce any of the parts at UNICOR plants. The design rights will belong to UNICOR exclusively, unless otherwise agreed to in writing by both Parties. The proposed offering shall be a desirable line that would be competitive with similar items in the commercial market place. The Contractor(s) shall be liable for ensuring that all items offered shall not infringe on any patents. UNICOR will have the right to outsource parts from other vendors. 4 of 5
Q: Will the due date of December 8th be extended for this RFP?
A: No, the due date will not be extended for this RFP. 5 of 5
