FEDERAL SUPPLY SCHEDULE (FSS) SOLE-SOURCE JUSTIFICATION

REFERENCE: NAMB-26-00091-C – Facilities Management Systems Support

Upon the basis of the following justification, prepared in accordance with the ordering instructions at GSAM/R 538.7104-3(b) and FC 8.401(b), 538.7104-3(b)(2), I approve this sole source acquisition.

1. Identification of the agency and the contracting activity.

This action is being taken by the Department of Energy (DOE), National Nuclear Security Administration (NNSA). The contracting office is the Office of Partnership and Acquisition Services, Headquarters Services Acquisition Branch (NA-PAS-314).

2. Nature and/or description of the action being approved.

The Facilities Management Services contract is essential for managing and enhancing the vast 300,000 square feet of conference space at the NNSA. Our strategy focuses on providing dedicated support for this task order over the next two years, ensuring that all operational needs are met efficiently and effectively. This commitment aims to maintain the high service standards expected from such a significant venue while remaining adaptable to any evolving requirements. By leveraging the resources and expertise from the FM Systems Group, LLC (FMS) contract, we intend to foster an environment that not only supports successful conferences and events but also optimizes the use of our extensive facilities. The anticipated improvements from this initiative will address current operational challenges and prepare the NNSA for future growth in a dynamic landscape.

As the organization navigates the complexities of its mission, the integration of streamlined processes will establish a solid foundation for sustained success, enabling the NNSA to respond more effectively to emerging challenges and uphold its leadership in national security while ensuring operational excellence.

The period of performance for the action is one (1) year base period, and two (2) twelve

(12) month option periods. The estimated value is . This is a follow-on effort from Contract No. 89303023CMA000088.

3. The authority and supporting rationale, and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. Only one source is capable of providing the requirement at the level of quality required because the products, services, or solutions are unique or highly specialized.

FMS is the only provider capable of meeting this requirement because they are the sole proprietor and original developer of the FMS system NNSA currently uses. FMS’s proprietary tool and system integrates seamlessly within NNSA’s specific IT infrastructure and they have developed custom integration points tailored specifically for NNSA’s systems. Furthermore, FMS has consistently met NNSA’s stringent security and compliance standards, having configured their commercial product to precisely align with NNSA’s operational environment.

As the proprietaiy owner, only FMS can perfo1m the necessaiy patches and updates to maintain this software's functionality. FMS holds a granulai· understanding ofNNSA's codebase and system dependencies, which is critical for minimizing service dismptions.

FMS does not provide its proprieta1y source code to any value-added resellers or paiiners. This unique combination of deep integration with existing legacy systems, proprietaiy technology, and specialized compliance modules tailored for NNSA operations establishes FMS as the singular provider capable of managing this system without dismpting essential processes.

IfNNSA were to transition to another Facilities Management tool, it would result in an extensive re-configuration of the cmTent infrastmcture. This would risk mismanagement ofNNSA's 300,000 square feet of conference space and incur substantial administrative costs associated with implementing a new system. Cost analysis shows licenses alone from alternative solutions are significantly more expensive, ranging from 116.67% to 400% higher- an additional $35,000.00 to $l20,000.00. The cmTent FMS solution is in a maintenance phase, affording low service continuity costs. Conversely, new commercial softwai·e would demand significant sta1t-up costs, including activation and securityrelated fees, rendering alternative options cost-prohibitive for this requirement.

4. Determination by the ordering activity contracting officer (CO) that the order represents a fair and reasonable price, consistent with GSAM/R 538.7102-2(d)(2) and

538. 7104-2( a )(3).

The Contracting Officer finds that the anticipated cost to the Government is fair and reasonable (based on the estimated value of the requirements).

5. Description of the market research conducted among schedule holders and the results, or a statement why market research was not conducted.

The market offers a wide range of mature, commercially available facilities management tools such as IBM Maximo, TRIRIGA, and MaintainX. Although these vendors offer a facilities management tool, they do not possess the proprieta1y technology to sustain services. Additionally, if NNSA were to consider other product lines, the level of effo1t (i.e. cost, government resources) would exceed the Agency need and potentially compromise the data integrity upon migration. With any new software integration and/or migration, there is increased risk of data loss and system functionality. These risks will disable NNSA from being successful in their mission. FM Systems has proprietaiy technology that is essential to Agency operations. Using a different solution and service would require extensive configuration, data migration, and result in unacceptable operational risks, cost, and government resources. This approach preserves valuable historical data and operational continuity, reducing downtime and transition risks.
