About this file
This document is a Justification for Other Than Full and Open Competition (FAR 6.302-1) for UNICOR, Federal Prison Industries, Inc. The document seeks approval for UNICOR to enter into a contract with Quigley Motor Company to obtain retrofitted vehicles for the Department of Homeland Security's Customs and Border Patrol (CBP). Specifically, the contract is for GM van 4x4 drive conversions with detailed specifications, including using General Motors original equipment components, maintaining a lower center of gravity, and retaining OEM systems like brake systems, steering, traction control, and electronic stability control.
The total estimated contract value is $12,500,000, and CBP is requesting Quigley Motor Company as a sole source vendor due to their status as the incumbent contractor. The justification emphasizes that changing vendors would require CBP to retrain staff, purchase new tools, and potentially introduce safety issues due to unfamiliarity with different parts and systems. The contract is for commercial items supporting CBP field operations, and full and open competition is not recommended as CBP has stated Quigley Motor Company is the required source for their specialized 4-wheel drive conversion needs.

4. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited.
Custom Border Patrol (CPD) an agency within the Department of Homeland Security (DHS) has requested using Quigley Motor Company as a sole source. Quigley Motor Company is the incumbent contractor for this and CBP is familiar with their parts and maintenance. By awarding to Quigley Motor as a sole source, it will prevent CBP to have to retrain staff to make repairs and purchase tools to make said repairs. By changing vendors CBP would incur additional expenses and possible safety issues due to unfamiliarity with the parts and systems.
5 A description of effects made to ensure that offers are solicited from as many potential sources as is practical including whether a CBD notice was, or will be, publicized as required by Subpart 5.2 and, if not, which exception under5.202 applies.
Due to the specific 4-wheel drive conversion employed by CBP, and resulting familiarization with Quigley Motor Company 4X4 components, continued standardized utilization in CBP law enforcement fleet vehicles is considered critical to satisfy stated operational, safety and security criteria.
6. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

7. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
This acquisition requirement is for the purchase of commercial items regarding field operations for CBP. Due to CBP making the sole source request a Market Survey was not completed.
8. Any other facts supporting the use of other than full and open competition.
None.
9. A listing of sources, if any, that expressed in writing, an interest in the acquisition
None.
10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services are required.
At the present time, full and open competition is not recommended for this requisition. CBP has stated that Quigley Motor Company is the required source for the items needed for the requirement. Because of this, additional sourcing was not sought.
11. Contracting Officer certification that the identification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
I hereby certify that this request for Justification and Approval of other than Full and Open Competition is made in good faith, and that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advance planning or a desire to expend funds while those funds are still unavailable.
