About this file

This is a No Right of Way (ROW) Needed Verification Checklist prepared by the FHWA Division Florida for the Walton County Safety Action Plan and Crosswalk Connections Demonstration project, funded under the FY24 Safe Streets and Roads for All (SS4A) Grant (693JJ32640486). The checklist serves as a pre-construction verification tool to determine whether right-of-way acquisition is necessary for the project. The Walton County project encompasses the development of a safety action plan for the county and the design and construction of a crosswalk demonstration activity for CR 30A and Scenic Gulf Drive (CR 2378) corridors. The verification checklist was submitted on December 31, 2024, and addresses eight primary conditions to assess ROW requirements, including whether the project is planning-only, can be constructed within existing ROW, involves early acquisition or donation, requires temporary property rights, or impacts existing property improvements or airspace.

The checklist is structured to confirm that no ROW acquisition is necessary if all responses to the verification statements are marked "Yes" or "N/A," though a ROW Certification Form remains required regardless. The project is being procured through a Request for Qualifications (RFQ) under Florida's Consultants' Competitive Negotiation Act (Chapter 287.055, Laws of Florida), seeking qualified engineering firms licensed in Florida to provide professional services. Funding for this SS4A grant project is provided through federal highway assistance, with the work focused on safety improvements and pedestrian connectivity in Walton County.

PROJECT NAME/DESCRIPTION:

Walton County Safety Action Plan and Crosswalk Connections Demonstration

This verification checklist is a tool to be used before the construction phase of the project to aid in determining if ROW is needed for a project. Please verify each of the following statements by comparing the ROW plan against the PS&E.
Yes
No
This is a planning project only, with no demonstration and/or other use of or access to real estate and/or right-of-way required.
_
_
The project can be constructed, operated, AND maintained entirely within the acquiring agency’s existing ROW, which was obtained under one or more of the following methods (check one of the four methods below & provide supporting documentation):
_
_
1. ☐ ROW acquisition occurred prior to July 1, 1971, before the Uniform Act Law was enacted.
_
_

2. ☐ ROW was certified under a previous Federal aid project.

Federal aid project #

_
_
3. ☐ ROW was purchased for a purpose other than this project and is no longer needed for its original purpose.
_
_
4. ☐ ROW was obtained through normal dedication or exaction procedures not related to this project (there was no unconstitutional taking).
_
_
Early acquisition or donation was not obtained specifically for this project.
_
_
The acquiring agency does not need to obtain any interest in, or possession of, real property (including temporary uses, leases, easements, access rights, air rights and/or airspace) to construct, operate and maintain the proposed project.
_
_
The acquiring agency solely needs temporary rights to perform work exclusively for the benefit of the property owner and does not cause compensable damages. Work shall not be done if agreement cannot be reached.
_
_
Real property improvements are not encroaching into the existing ROW and/or airspace.
_
_

If all the response to the above are “Yes” or “N/A” than no ROW acquisition is needed. Note a ROW Certification Form is still required.
