This is a combined synopsis / solicitation for commercial items prepared in accordance with the format in Subpart

12.6 and Subpart 13.105, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

Description of Requirement:

The objective of this contract action is to provide the US Army Corps of Engineers (USACE) assistance in the following activities associated with the UMCD Waste Testing and Disposal project in accordance with the Performance Work Statement dated 16 August 2022:

1) Sample thirteen (13) 5-gallon buckets of soil for TNT and RDX.

2) Additional four (4) 5-gallon buckets, 64 8-oz jars, and a cooler of additional Investigation Derived Waste (IDW) will need to be sampled for TNT and RDX.

3) Containerize and sample several additional boxes found into five (5) 5-gallon buckets for TNT and RDX.

4) Hazardous Waste disposal.

This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-01; effective 06 December 2021.

This RFQ is 100% set aside for small business. The associated North American Industry Classification System (NAICS) code is:

562112 – Hazardous Waste Collection Size Standard $ 41.5M

Period of Performance: Upon award 90 days to complete Scope .

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

1 Subject: UMCD Waste Testing and Disposal FY22

1.1 Background

Waste has been left behind over the years at the Umatilla Chemical Depot (UMCD) Groundwater Extraction System (GETS) and nearby storage igloo (Igloo B-1050). The waste includes thirteen (13) 5-gallon buckets of lead contaminated soil from the Air Defense Artillery (ADA) and East Washout Lagoon, as well as various containers of soil (See Table 1 and Table 2). The 13 5-gallon buckets, and various Investigation Derived Waste (IDW) are located in an igloo at UMCD approximately one-half mile from the GETS.

1.2 Scope

Sample the 13 5-gallon buckets and various IDW from Umatilla as noted in the Price Schedule. After results are received, dispose of the waste appropriately (subtitle C or D landfill). All disposals shall meet local, state, and federal laws and regulations. Provide all sample results, bill of ladings and waste manifest within 5 business days of receipt of such documents. Provide laboratory DOD ELAP and Oregon certifications 5 workdays prior to mobilizing on site.

Leave all 1” and greater hoses, manifolds, cement, bentonite, tables, furniture, and sampling equipment/materials not identified in figures 5 and 6 within igloo B-1050.

1.3 Period of Performance

Upon award the contractor has 90 calendar days to complete the Scope.

1.4 Bid Schedule

CLIN 1. JOB - Sample and dispose of 13 5-gallon buckets of lead-contaminated soils. Buckets may be consolidated into a 55-gallon drum. Samples should be collected by Method 8330 for TNT and RDX. Provide sample analysis and waste manifest. DOD ELAP/OR lab certification is required (Figures 3 and 4).

CLIN 2. JOB – Containerize water samples from blue cooler into larger container(s) and sample contents. Samples collected shall be analyzed by Method 8330 for TNT and RDX And hazardous waste characteristics: ignitability (EPA 1010/1030), corrosivity (EPA 9045/150.1), and TCLP (metals [SW 1311/6010 & 7740/7471/245], VOCs [SW1311/8260], SVOCs [SW1311/8270], pesticides [SW1311/8081]). Dispose of the IDW water after characterization data is received. Provide sample analysis and waste manifest. DOD ELAP/OR lab certification is required.
