A PROPOSED CONTRACT ACTION UNDER FAR SUBPART 5.2 and no contract shall be awarded from this notice. No reimbursement will be made for any costs associated with providing information in response to this Sources Sought or any follow-up information requests.
No Solicitation is currently available. The purpose of this notice is to obtain information from businesses that are interested and capable of providing the types of services noted below. The United States Fish and Wildlife Service (USFWS) will use information obtained through this notice as well as other market research to develop an acquisition strategy.
A. SUMMARY OF REQUIREMENT:
The USFWS anticipates soliciting and awarding one Firm Fixed Price (FFP) contract for design build services to complete needed improvements to the sanitary sewer system and to harbor infrastructure at Midway Atoll National Wildlife Refuge (NWR). Much of the island’s infrastructure was built in the World War II era and is well beyond its useful life. The US Fish and Wildlife Service (Service) operates and maintains the NWR as well as Henderson Airfield with Service staff and contractor staff residing on the island year-round. To maintain operations and keep staff on-island, significant repairs to the sewer system and inner harbor are needed.
The scope of this effort includes replacement of major components of the existing sewer system including piping, lift stations, manholes, etc.as well as other associated work. It also includes planning, design, permitting, and construction activities to repair or replace infrastructure within the inner harbor and the south seawall.
The objectives of this project are to repair infrastructure on Midway Atoll NWR that are critical to continued operations. This project has three main objectives, listed below in order of priority:
1. Replacement of sewer system per 100% design documents.
2. Design Build: Replace or repair critical harbor infrastructure to allow for continued harbor operations.
a. Tug Pier (Base)
b. Harbor Seawall (Option)
c. Finger Piers (small vessel docks; Option)
3. Repair South Seawall (Option)
The sewer system work consists of replacement of existing gravity sewer mains, new sewer services to within 5’ of each building being served, new sewer manholes, a new sewer lift station, and all other work required in accordance with the design documents. This is a firm, fixed price, line item. The Service has completed all permits related to this work requirement.
The Contractor may identify and recommend Alternative Technical Concepts (ATC) items to the Service for consideration for the sewer system only. All ATC recommendations will be accepted at the sole discretion of the Service and may include design, material, or construction method alternatives.
Critical harbor infrastructure, for the scope of this contract, consists of the tug pier, harbor wall, and finger piers. Repair or replacement of these components are needed to ensure harbor operations can continue. The Contractor may propose either a long-term, short-term solution or both with associated costs for FWS consideration. All proposed short term/repair solutions shall have a 15-year minimum design life. Proposed long term/replacement solutions shall have a 50-year minimum design life. The Contractor shall declare the design life of the proposed solution in their proposals. Harbor operations include regular use by supply vessels, onloading and offloading of equipment, construction material, and supplies, and small boat operations. The Contractor shall prepare all necessary permits and design documents for all proposed construction of harbor infrastructure.
Replacement of harbor infrastructure (specifically the tug pier) is strongly preferred over short-term repair options, provided it meets budgetary constraints. Locating the replacement pier to minimize haul distance to other island infrastructure, minimizes interference to wildlife and meets the intent of the Master Plan is desired. Demolition of the existing Tug Pier is not required and reducing the footprint is allowable provided the proposed size and layout meets the needs of FWS Operations. The tug pier is currently under restricted use and requires annual inspections to monitor its condition. The Contractor shall perform a physical inspection of the tug pier within 60 days of the NTP and assume responsibility for annual inspections until repair or replacement of the structure is complete. The tug pier replacement or repair solutions must accommodate the offloading of cargo from the vessel to the uplands, utilizing the existing 40 Ton crane and front-end loader. Specific design criteria will be provided during Phase 2 selection.
Repairs along the harbor wall and south seawall will be completed in 100-linear foot increments.
The selected Contractor shall coordinate with USFWS to select wall repair areas, prioritizing those whose failure would restrict access to the tug or finger piers, pose the highest risk of structural failure, wildlife entrapment hazards, and contamination hazard.
The finger piers (small vessel docks) must support launching and mooring capabilities for four small boats ranging in length from 8 ft to 50 ft (e.g. large 31 ft Safeboat, twin engine 21 ft Safeboat, Zodiacs, single engine dinghy, and 31 ft landing craft).
The Contractor shall prepare a draft and final Environmental Assessment (EA) and, if warranted, a Finding of No Significant Impact (FONSI) for proposed work for the harbor infrastructure construction, and long-term operation and maintenance. The EA shall evaluate up to two (2) Action Alternatives and a No Action Alternative. Green and green-gray infrastructure solutions should be considered where possible.
Repair of the south seawall consists of repairing the seawall from the south jetty southward to the RSA (approximately 5,720 LF) per the provided detailed conceptual design. The FWS has completed NEPA and permitting for the south seawall. The contractor shall follow all permitting conditions for repairs of the south seawall.
The Contractor shall provide all equipment, tools, materials, supplies, transportation, labor, supervision, management, and other incidentals necessary to meet the requirements as stated in this SOO. Near the completion of the contracted work, purchase of the Contractor’s used equipment may be considered by the Contractor and the Service. Within 90 days of the final period of performance end date, the Service will issue a request for proposal for a contract modification to purchase specific equipment currently on the project and on island.
OPERATING CONSTRAINTS:
Midway Atoll NWR’s location and critical habitat require careful care and consideration for all work conducted on island. It is more than 1,100 air miles from the nearest off-island medical facility and provides critically important nesting and resting habitat for millions of seabirds, representing 22 species. Equipment and materials brought onto the island must be cleaned and inspected to prevent the introduction of any invasive species. Work on and around Midway Atoll NWR requires strict adherence to all applicable policies, rules, regulations, and other guidance that helps provide safety for personnel on island, cultural resources, and natural resources. All contract personnel and construction activities on island will comply with all rules, regulations, best management practices, and policies in the attached appendices. All Contractor personnel will attend a mandatory briefing and orientation upon arrival.
Terrestrial construction activities are limited to July 15th through October 31st due to wildlife limitations and ongoing refuge operations. For construction activities related to inner harbor work, the Contractor may propose for the Service to review and approve work outside of this timeframe. Material/equipment delivery and mobilization/demobilization can only occur May 30 – November 15; however, within this window, offload of materials may be limited (at stretches of less than a day) based on wildlife restrictions. Albatross are present on island beginning in the middle of October and start nesting within a couple weeks. By the middle of November, birds must not be disturbed from their nests until the end of May when the albatross chicks are mobile. Planning and design activities may occur year-round and will require coordination and approval by the Service. Throughout construction, FWS must be able to continue harbor and refuge operations which includes but is not limited to use of the tug pier and small boat operations.
All activities throughout the duration of the project and at completion shall prevent damage, flooding, entrapment and other impacts to wildlife and their habitat.
Due to the remote nature of Midway Atoll NWR the Contractor is responsible for ensuring all material, fuel, power, equipment, personnel, and any other required items are in place before work begins. No FWS utilities, communication network, equipment, fuel, material, or personnel will be made available for Contractor use. Contractors shall be self-sufficient for performing all work. Material deliveries and personnel arrival will need to be coordinated per Midway Atoll NWR guidance.
All vessels traveling to and from Midway Atoll NWR and within the Papahānaumokuākea Marine National Monument must adhere to all requirements for bio-security and invasive species management.
Lodging and meals for Contractor employees are available on a limited basis. During the duration of the contract Midway Atoll NWR can provide meals and lodging for up to 20 Contractor personnel at once. The Contractor is required to use existing lodging and meals on Midway Atoll. Temporary man camps on island are not permitted. Barge based lodging may be permitted but will require FWS approval. Personnel who utilize Midway provided lodging and meals shall pay current rates at the time of the stay. Lodging and meal requirements shall be identified by the Contractor on project schedules (at least 60 days prior to lodging start date) and coordinated/approved with Refuge management. No other on island lodging is available.
Travel to and from Midway Atoll NWR throughout the duration of the project is the responsibility of the Contractor. If available, limited seating on a regularly scheduled, Service contracted flight may be considered. Costs for seats on a Service flight would be charged at the time of reservations being made. Contractor chartered flights can use Henderson Airfield and will be subject to regulations and landing fees.
Normal work hours at the station are 7:30am to 4:00pm local Midway Time, Monday through Friday, excluding Federal Holidays. Construction work will be allowed dawn to dusk and within any permitting constraints. If FWS staff is needed in support of the Contractor’s work, additional hours outside normal work hours may be requested (at least 14 days in advance) and are subject to approval by Station staff and the Contracting Officer.
The Contractor shall comply with the most stringent environmental federal, state, and local laws and regulations, and project permits. The Federal Government is not exempt from compliance with environmental regulations. The Contractor is responsible for knowing and following all applicable Federal, State, and Local regulations for environmental protection, including waste disposal, sewer discharge, air emissions, and storm water requirements. The Contractor shall maintain an awareness of changing environmental regulatory requirements to avoid environmental deficiencies for activities on Midway Atoll NWR.
The Contractor shall coordinate with Service Cultural Resources for a review of any potential impacts to cultural resources before proceeding with any work.
The Contractor shall not disturb areas identified as contaminated and/or Land Use Control areas.
All work is occurring in previously disturbed areas. No anticipated contaminants or unexploded ordinance (UXO) is expected. If contractors encounter or suspect contaminants or UXOs they shall immediately stop work, secure the area as appropriate, notify Service personnel, and await further instruction before resuming work.
The period of performance for Task 1, Replacement of Sewer System is 730 days from the Notice to Proceed (NTP). The period of performance for NEPA documents and compliance is 730 days from the NTP. The period of performance for all other tasks is 1,825 days from the NTP.
