About this file

This is a Request for Bid (RFB) issued by the Commonwealth of Kentucky Transportation Cabinet, Division of Purchases, on behalf of the Division of Maintenance for a master agreement to provide polypropylene barrier wall construction services across Districts 1-10. The solicitation seeks all materials, equipment, and labor necessary to complete bank erosion control projects at various locations throughout Kentucky. Line items include polypropylene barrier bags (minimum 18-inch opening, trapezoidal shape, 5 oz. material, tested to ASTM standards), installation equipment, on-site technical support, mobilization services (bag deployment, heavy equipment, routine at 30 days response, and emergency at 5 days response), labor for delivery and installation, concrete Class B, concrete pump trucks, mechanical support equipment, trackhoe, long reach trackhoe, loader, dump truck, 6-inch minus stone aggregate, and traffic control services. Installation locations and quantities will be furnished through written Transportation Delivery Orders. The deadline for written questions is July 7, 2026 at 3:00 p.m., with responses posted by July 8, 2026 at 3:00 p.m. Bids close on July 15, 2026 at 1:30 p.m. Eastern Time via electronic submission only through the Kentucky Vendor Self Service eProcurement system. The tentative award date is August 31, 2026. The initial contract period begins no earlier than September 1, 2026 and extends through August 31, 2027, with four optional one-year renewal periods available upon written approval of both parties and potential renegotiation of terms.

Pricing shall be submitted on the attached Vendor Bid Sheet with F.O.B. Destination Freight Prepaid terms. Award will be determined using a best value ranking approach evaluated by district, with scoring based on price (85 points), response time (5 points), and years of experience (10 points). A minimum of three years' experience providing similar services is required, with maximum scoring consideration at 12 years. Vendors must specify response time in days; general terms such as "as required" or "as soon as possible" will render bids non-responsive. Penalties of 1% per day apply for delays beyond the contracted completion date, except for delays caused by Commonwealth acts, third parties, civil authority, natural disasters, or acts of God. Unit prices are subject to Consumer Price Index adjustment at contract renewal, calculated from the U.S. Bureau of Labor Statistics CPI-U index; adjustments exceeding 10% allow the Department to cancel the contract. Kentucky resident bidders and qualified bidders (Kentucky Correctional Industries, Kentucky Industries for the Blind, and nonprofit agencies serving individuals with severe disabilities) receive statutory preferences of 20% and 15% respectively. Vendors must provide certificates of insurance with $1,000,000 per occurrence general liability coverage (or higher as determined by the Commonwealth), maintain workers' compensation insurance, and provide automobile liability insurance if applicable. The Commonwealth will not be bound by vendor terms conflicting with solicitation requirements, and all bids must remain valid for 90 calendar days after closing. Online bidding is mandatory; emailed and hard-copy submissions will not be accepted.

Document Phase Document Description Page 8

2600000682 Final Polypropylene Barrier Wall Construction Districts 1-

Total Pages: 29

No shipments or services are authorized until an official Delivery Order has been fully processed by an authorized agency.

2.05 - Quantity Basis of Contract

Any and all quantities mentioned in this solicitation are purely estimates and are not to be implied nor inferred as being guarantees. The State is obligated to buy only that quantity needed by its agencies during the term of the contract. Requirements may exceed the quantities shown and the contractor will be required to furnish all requirements shown on Delivery Orders dated during the life of the contract.

2.06 - Exception to Required Use of Contract

The establishment of this Master Agreement is not intended to preclude the use of similar products when requested by the agency. The Commonwealth of Kentucky reserves the right to acquire large requirements through other competitive processes.

2.07 - Basis of Price Revisions

Prior to renewal of the contract, at the request of either party, the unit bid prices will be calculated to reflect the adjustment in the Consumer Price Index for the previous contract period as published by the US Bureau of Labor and Statistics at https://www.bls.gov/cpi/ to be applied to new work order assignments. The Consumer Price Index for All Urban Consumers (CPI-U), US City Average, All Items, 1982-84=100, not seasonally adjusted will be used.

If the amount of the requested adjustment is more than ten percent, the Department reserves the right to cancel this contract.

The unit price adjustment will be determined by comparing the published CPI for the month when the contract was let (or the published CPI used to establish the previous contract period prices) to the published CPI for the month the renewal is executed. If the CPI for the month of the renewal is unavailable at renewal, the latest published monthly CPI prior to the renewal month will be used. See example below.

Published CPI for the month of renewal or the latest published monthly CPI prior to the renewal month (no CPI data for July 2022; use May 2022 CPI)..............................................................................................292.296

Published CPI used when contract was let or previously renewed (May 2021).......................................... 269.195 Difference in CPIs...............................................................................................................................+23.101 Percent change............................................................................................(+23.101 / 269.195) x 100 = 8.58%

This price escalation method will not be applied to items of work that are separately covered under commodity price escalation clauses. No other changes in the terms, conditions, etc. of this contract will be made when an extension to the contract is implemented.

2.08 - Addition or Deletion of Items or Services

The KYTC Division of Purchases reserves the right to add new and similar items, with the consent of the vendor, to the contract. If an addition is agreeable to both parties, the KYTC Division of Purchases will issue a Modification.

Until such time as the vendor receives a Modification, the vendor shall not accept Delivery Orders from any agency referencing such items or services.

2.09 - Changes and Modifications to the Contract

Document Phase Document Description Page 9

2600000682 Final Polypropylene Barrier Wall Construction Districts 1-http://www.bls.gov/cpi/

During the period of the contract, a modification shall not be permitted in any of its conditions and specifications, unless the contractor receives electronic or written approval from the KYTC Division of Purchases. If the contractor finds at any time that existing conditions make modification in requirements necessary, the contractor shall report the matter promptly to the KYTC Division of Purchases for consideration and decision. All contract modifications shall be subject to the provisions of 200 KAR 5:311.

2.10 - Reduction in Contract Worker Hours/Employee Furlough

The Kentucky General Assembly may allow for a reduction in contract worker hours in conjunction with a budget balancing measure for some professional and non-professional service contracts. If under such authority the agency is required by Executive Order or otherwise to reduce contract hours, the contract will be reduced by the amount specified in that document. The reduction of hours may be applicable to those contract workers that provide a service in state government buildings on a regularly scheduled basis, such as janitorial, security guard, mailing services, and food services.
