Summary

This is a Solicitation Modification (Addendum #3) issued by the Commonwealth of Kentucky, Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Traffic Operations for a master agreement contract to supply Square Sign Posts. The solicitation, RFB 605 2100000751, involves multiple line items for tubular steel square sign posts in various gauges (12 and 14 gauge) and specifications. The Phase 1 closing date for unpriced offers is July 9, 2021 at 1:30 p.m. Eastern Time, with vendor notification of approval to participate in the online reverse auction by July 12, 2021. Vendor training on the eBridge platform is scheduled for July 13-14, 2021, followed by the Phase 2 initial bid submission deadline of July 15, 2021 at 4:00 p.m., and the Phase 2 online reverse auction event on July 16, 2021 at 11:00 a.m. The tentative award date is July 20, 2021. The initial contract period runs from award through June 30, 2022, with four optional one-year renewal periods available. All bidding must be conducted electronically through the Kentucky e-Procurement system; only registered vendors submitting unpriced technical offers in Phase 1 will be eligible to participate in Phase 2 pricing.

Award will be made on a best-value basis using the following criteria: Price (95 points maximum) and Delivery time (5 points maximum). The bidder with the lowest price receives the maximum 95 points, with other bidders scored proportionally. Delivery time must be clearly specified, with the fastest delivery time receiving 5 points and others scored proportionally. Reciprocal preference will be applied to Kentucky resident bidders as defined in KRS 45A.494. Qualified bidders—including Kentucky Correctional Industries (20 percent preference), Kentucky Industries for the Blind, and nonprofit organizations serving individuals with severe disabilities (15 percent preference each)—are eligible for additional scoring preferences. All products must be new and first-class condition; deliveries are F.O.B. Destination with freight prepaid to any location within Kentucky. The vendor is responsible for all shipping and freight charges and for filing freight claims. One percent per day will be deducted from invoices for each day delivery is late, unless delays result from Commonwealth actions or events beyond vendor control. Payment will be made within 30 working days of invoice receipt and goods acceptance, with an additional 1 percent monthly penalty applied for payments exceeding 30 working days. Pricing is subject to firm pricing for the first six months, with one allowed price increase during the contract period if industry-wide justification is provided and approved. All responses must include the vendor's representative information and specific delivery time on the attached bid sheet submitted as an attachment in the e-procurement system.

3.08 - Vendor Terms and Conditions

Solicitation or quotation forms that include terms and conditions not in conformity with the terms and conditions of this solicitation or the Statutes of the Commonwealth of Kentucky may be deemed non-responsive.

The Commonwealth of Kentucky shall not be bound by any part(s) of the bidder’s response to this solicitation that contains information, options, conditions, terms, or prices neither requested nor required in the solicitation. In the event of any conflicts between the specifications, terms and conditions indicated by the Commonwealth and those indicated by the contractor, those of the Commonwealth take precedence. The contract supersedes all bids or other prior agreements, oral or written, and all other communications between the parties relating to this subject.

3.09 – Specifications

This solicitation specifies requested items. It is not the intention of this solicitation to eliminate vendors or manufacturers of similar or equal equipment of the types specified. It should be noted, however, that these requested items are written around specific needs of State agencies. The Commonwealth reserves the right to consider bids non-responsive if they do not comply with the specifications contained herein.

3.10 – Exceptions to Specifications

Vendors are cautioned that changes made to the solicitation other than in the designated fields for response shall render the response invalid and result in a non-responsive bid. Otherwise, it will be considered that items offered are in strict compliance with these specifications, and the successful bidder shall be held responsible for delivering materials that meet these specifications. Any exceptions shall be marked as such within the body of the bid and explained on a separate page. The Commonwealth is not bound to accept any exceptions.

3.11 – Alternate Brands/Specifications

Unless otherwise specified, brands and specifications referenced in this solicitation are meant to establish a minimum standard of quality only. Bidders may bid brands/specifications they consider to be equal by specifying the brand(s)/specifications and inserting the brand name(s), model number(s), etc. on which they are bidding. Bids offering “equal” products/specifications will be considered for award if such products are clearly identified in the bid and are determined by the State to meet or exceed fully the minimum essential specifications and salient characteristics referenced in the Solicitation. Bids that contain products/specifications that fail to meet the minimum essential requirements shall be deemed non-responsive.

Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. Failure to enclose sufficient literature may result in a non-responsive bid. If the brands are not changed, the contract will be written accordingly and the successful bidder shall be required to deliver the brands/specifications stated in the solicitation.

3.12 - Equipment

Unless otherwise indicated in the bid, it is understood and agreed that any item offered or shipped on this bid shall be new and the latest or current model year and be in first class condition. Any unit failing to meet the foregoing requirements shall be returned to the contractor, at their expense, and replaced with a new unit.
