About this file
This is a Request for Bid (RFB) issued by the Commonwealth of Kentucky, Kentucky Transportation Cabinet (KYTC), Division of Purchases on behalf of the Division of Maintenance for a master agreement contract for vertical/overhead concrete patching material. The solicitation requests four line items: 50 kits of regular concrete patching material (1 kit = one 50 lb. bag of dry mixture and one gallon of liquid activator), 9 pallets of regular concrete patching material (1 pallet = 40 kits), 50 kits of fine concrete patching material (1 kit = one 40 lb. bag of dry mixture and one gallon of liquid activator), and 9 pallets of fine concrete patching material. The material must meet specific performance requirements including rapid cure capability (45 minutes or less), minimum compressive strength standards (2,500 psi at 45 minutes, 5,000 psi at 24 hours, and 11,000 psi at 28 days), a set time of no more than 15 minutes, and be either MG-Krete or an approved equal on the Kentucky Transportation Cabinet/Division of Materials approved list or at minimum phase V of the Kentucky Product Evaluation List. The solicitation was issued on August 1, 2019, with a deadline for written questions by August 5, 2019 at 12:00 p.m., and bids due by August 8, 2019 at 10:00 a.m. The tentative award date was August 14, 2019. The master agreement will begin upon award and extend through July 31, 2020, with an option for four additional one-year renewal periods subject to written approval of both the vendor and KYTC Division of Purchases and potential renegotiation of terms.
The procurement uses a best value ranking approach with price weighted at 95 points and delivery time at 5 points. Pricing shall be submitted on an F.O.B. Destination Freight Prepaid and Allowed basis, with all quantities estimated and not guaranteed. The contract is for use by the Kentucky Transportation Cabinet's Division of Maintenance and Highway Districts 1-12, with shipments and services authorized only upon receipt of official Delivery Orders. The Commonwealth reserves the right to reduce prices to reflect industry-wide price decreases and allows only one price increase during the initial contract period if industry-wide justification is provided, with no increases permitted during the first twelve months. Vendors are required to provide delivery within a specified number of calendar days after receipt of a Delivery Order, with a 1 percent per day deduction from invoices for late deliveries unless delays result from factors outside the vendor's control. The solicitation requires vendors bidding materials other than the suggested MG-Krete product to submit detailed specification information for product comparison; failure to include such information may result in a non-responsive bid determination. Resident bidder preferences and qualified bidder preferences apply in accordance with Kentucky Revised Statutes.

Bids that contain products/specifications that fail to meet the minimum essential requirements shall be deemed non-responsive.
Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. Failure to enclose sufficient literature may result in a non-responsive bid. If the brands are not changed, the contract will be written accordingly and the successful bidder shall be required to deliver the brands/specifications stated in the solicitation.
