SAFETY DATA SHEET AUTHORING SERVICES – 1333ND23QNB150138

SECTION 1

I. INTRODUCTION

THIS IS A COMBINED SYNOPSIS/ SOLICITATION FOR COMMERICAL ITEMS PREPARED IN

ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, STREAMLINED PROCEDURES

FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS, AS SUPPLEMENTED

WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT

CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A

SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE

SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES.

This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-01, December 30, 2022.

The associated North American Industrial Classification System (NAICS) code for this procurement is 541690 – Other Scientific and Technical Consulting Services. The small business size standard is $16.5M million. This is an open market purchase. Simplified acquisition procedures will be utilized. It is being issued using the simplified acquisition procedures under the authority of FAR Subpart 13.5— Simplified Procedures for Certain Commercial Items.

***This is an Open-Market Combined Synopsis/Solicitation for commercial SDS authoring services as defined in the statement of work (SoW). The Government intends to award a Purchase Order as a result of this Combined Synopsis/Solicitation that will include the terms and conditions that are set forth herein. In order to facilitate the award process, ALL quotations shall include a statement regarding the terms and conditions herein as follows:

The Offeror shall state “The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition.”

The Offeror shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:

Offeror shall list exception(s) and rationale for the exception(s).

Offerors that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

***Please note that this procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

The Government contemplates award of a Fixed Rate – Time and Material contract from this RFQ.

II. COMMERCE ACQUISITION REGULATION (CAR) 1352.215-72 INQUIRIES (APR

2010)

Offerors must submit all questions concerning this solicitation in writing, via email, to Robert Singman, contracting Officer at. robert.singman@nist.gov Questions should be received no later than Friday February 24, 2023, by 12:00pm est. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, the question responses included in the amendment to the solicitation will govern performance of the contract.

BACKGROUND

The United States Occupational Safety and Health Administration’s (OSHA) Hazard Communication Standard (HCS), 29 CFR 1910.1200, requires that chemical manufacturers classify the hazards of the chemical products they produce. Additionally, chemical manufacturers must provide information about the classified hazards of their chemical products to downstream users by developing and providing Safety Data Sheets (SDSs) and “shipped” container labels. The HCS provides specific requirements regarding the hazard classification process and the required content and format for SDSs and “shipped” container labels for “hazardous chemicals” (as defined in the HCS). The HCS chemical manufacturer requirements apply to “laboratories” (as defined in OSHA 29 CFR 1910.1450, Occupational Exposure to Hazardous Chemicals in Laboratories) only when the hazardous chemicals will be shipped from the laboratory workplace.

The National Institute of Standards and Technology (NIST) is an agency of the US Department of Commerce (DoC). NIST is a physical science laboratory located primarily in Gaithersburg, MD and Boulder, CO. NIST’s mission is to promote US innovation and industrial competitiveness by advancing measurement science, standards, and technology in ways that enhance economic security and improve our quality of life.

In conducting NIST’s mission, numerous hazardous chemicals are manufactured and used at NIST workplaces. The majority of the hazardous chemicals manufactured or used at NIST workplaces are “laboratory use” (as defined in OSHA 29 CFR 1910.1450, Occupational Exposure to Hazardous Chemicals in Laboratories). Occasionally, hazardous chemicals need to be shipped from a NIST workplace and therefore the HCS chemical manufacturer requirements regarding hazard classification, SDSs, and “shipped” container labels apply; for these chemicals, hazard classification must be performed, an SDS must be developed, and a “shipped” container label must be developed in accordance with the requirements of the HCS.

All interested vendors shall provide a firm-fixed-price quotation for SDS authoring services as defined in the statement of work attached.

III. FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Due Date for Quotations

Offerors shall submit their quotations so that NIST receives them not later than 3:00PM Eastern Standard Time on March 7, 2023. FAX quotations shall not be accepted. E-mail quotations shall be submitted directly to robret.singman@nist.gov.

Please reference the RFQ number in the subject line of email communications and packages mailed. Offerors’ quotations shall not be deemed received by the Government until the quotation is entered in the e-mail box set forth above.

The offeror shall hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers.

System for Award Management (SAM)

In accordance with FAR 52.204-7, the awardee must be registered in SAM (www.sam.gov) prior to award. Refusal to register shall forfeit award.

Required Information

The government will not consider any proposal without the information required by this solicitation.

Due Date for Proposals

Offerors shall submit their proposals so that NIST receives them not later than 3:00 p.m. Eastern Time on Tuesday, March 7, 2023. FAX and hard-copy proposals shall not be accepted. E-mail proposals shall be accepted at robert.singman@nist.gov. Offerors’ proposals shall not be deemed received by the Government until the proposal is entered the e-mail address inbox set forth above. Late quotes will not be accepted.

Addendum to FAR 52.212-1, Quotation Preparation Instructions:

Price – A not to exceed firm- fixed-price for each CLIN.

Offeror's Unique ID and TIN, and POC information: name, telephone no., e-mail address;

Quotations shall conform to the instructions identified herein, and the evaluation factor submittal requirements. Significant deviation may result in the possible exclusion of such quotation from further consideration or may be reflected in the overall evaluation of the quotation.

Failure to comply with the terms and conditions of this RFQ may result in the Quoter's quotation being removed from consideration for award. The quotation must include page numbers and be clearly and concisely written. Submission of quotations in response to this RFQ assumes the Quoter agrees to all terms and conditions unless specifically excepted in quoter's quotation.

To aid in evaluation, the quotation shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and be assembled according to the provisions in this section. All pages of each part shall be appropriately numbered and identified with the name of the Quoter, the date, and the solicitation number (1333ND23QNB1500XX).

The quotation shall be typed, with one-inch margins, using a fixed font (Times New Roman preferred), a minimum 12-point type (or equivalent), unreduced in size, on 8-1/2" by 11" paper, not exceeding 30 pages, single sided, for the technical proposal, resumes, representations and certifications, past performance references, and other administrative documentation such as a one-page cover page and table of contents or list of tables/figures. Actual tables/graphics/figures are included in the page limit. Any pages in excess of 30 will be disregarded, and will not be included in the quotation evaluation. There is no page limit for the past performance/references and business/price quotation volumes.

Overall Arrangement of Documents

VOLUME I: TECHNICAL

NIST will evaluate quotations, based on the information submitted in support of the following factors:

Factor 1 - Technical Capability

The offeror shall provide sufficient information to demonstrate its understanding of the tasks associated with hazard classification and SDS authoring as defined in the SoW, by providing a concise, detailed, and thorough discussion of its technical approach to: a) classifying chemical hazards and drafting SDS’s; and, b) maintaining a sufficient staff of SDS Authors with the required education and experience (as defined in Section 4.0 of the SoW) to prepare up to 15 SDS’s concurrently and comply with the standard or rush preparation times specified in the SoW.

Factor 2 - Organizational Experience

1. Demonstrate corporate experience ( ≥ 10 years) in authoring Safety Data Sheets (SDSs), including experience preparing SDSs for complex1 laboratory samples, in accordance with the United States Occupational Safety and Health Administration (OSHA) 29 CFR 1910.1200, Hazard Communication Standard (HCS).

a. SDS Authoring:

i. Provide the following information for at least three clients:

1. Client information,

2. Time period that work was conducted,

3. Numbers of SDSs prepared, 1 Complex is defined as having three or more components with or without assigned Chemical Abstracts Service Registry Numbers (CAS #s) or an SDS with a single component that does not have an assigned CAS #.

4. The types of chemicals for which SDSs were prepared, and

5. Example SDSs.

2. Demonstrate corporate ability in performing hazard classification and SDS authoring in accordance with the HCS.

a. Hazard Classification:

i. Provide the step-by-step process by which your company performs hazard classification. Include the data sources consulted for chemical identity, physical and chemical properties, and health effects information.

ii. Provide the step-by-step process by which your company performs an example hazard classification for the following chemical:

Ba3Tb(11BO3)3.

iii. Prepare and submit a Classification Back-Up Document [as specified in the solicitation (see Statement of Work-Attachment A)] for the following chemical: Ba3Tb(11BO3)3.

b. SDS Authoring:

i. Provide the step-by-step process by which your company authors an SDS.

ii. Provide an example SDS authored by your company for the following chemical: Ba3Tb(11BO3)3

3. Demonstrate experience and training for personnel who perform hazard classification and SDS authoring.

a. Provide resumes that demonstrate:

i. At least 5 individuals who have a minimum of 3 years of experience in authoring SDSs, including experience preparing SDSs for complex laboratory samples. Each individual shall have educational background (at least a Bachelor’s Degree) in chemistry, toxicology, industrial hygiene and/or biology.

ii. At least 2 individuals who meet the training requirements of United States Department of Transportation (DOT) 49 CFR 172, Subpart H; and,

iii. At least 2 individuals who have a minimum of 3 years of experience performing pre-transportation functions (e.g., assigning Proper Shipping Name, Hazard Class or Division, Identification Numbers, Packing Group, Label Codes, Special Provisions, Packaging) in accordance with the DOT Hazardous Materials Regulations (HMR) 49 CFR 171- 180.

VOLUME II: PAST PERFORMANCE/REFERENCES

The offeror shall provide three (3) examples of past performance conducted within the last three

(3) years of contracts for hazard classification and SDS authoring services with federal, state or local governments and/or commercial customers. If the offeror has no relevant past performance it should include a statement to that effect in its quotation. The government reserves the right to consider past performance data obtained from sources other than those provided by the offeror in its quotation.

The description of each reference described in this section shall not exceed a half page. For each of the contracts, the offeror shall provide the following information:

• Contract number

• Client’s name and address and point of contact, including telephone number and e-mail address

• Dollar value

• Period of performance

• Narrative describing the requirement and its relevance to the current requirement

• Name of contracting officer or point of contact, telephone number and e-mail address

VOLUME III: BUSINESS/PRICE QUOTATION

1. Price - firm, fixed-price for SDS authoring services as defined in the SoW;

PROPOSED PRICING

All costs for preparation of the draft SDS, and revision of the draft SDS to a final SDS that is accepted by NIST, shall be included in the Contractor’s fixed unit prices for SDS01-SDS06 shown in each pricing table for each year of the not-to-exceed (NTE) purchase order.

The Government will award a not-to-exceed (NTE) purchase order resulting from this solicitation that will include the terms and conditions that are set forth herein to the responsible offeror whose quotation is conforming to the solicitation, results in the best value to the Government, non-price and price factors considered. NIST reserves the right to make award to other than the lowest-priced offeror or to the offeror ranked highest technically, if it determines that to do so would result in the best value to the Government.

The Government intends to make a single award and reserves the right to make no award as a result of this solicitation.

The Government intends to evaluate quotations and award a not-to-exceed (NTE) purchase order without discussions with offerors. Therefore, the offeror's initial quotation should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may reject any and or all quotations if such action is in the public interest;

accept other than the lowest price quotation; and waive informalities and minor irregularities in quotations received.

Non-price factors are listed in descending order of importance. Technical approach is more important than organizational experience which is more important than past performance.

Technical approach, organizational experience and past performance, when combined, are approximately more importance than price.

An offers failure to quote all of the part numbers listed above may be considered indicative of the offerors lack of understanding of the Government’s requirements and may result in the offer being determined unacceptable.

Evaluation Criteria Factor 1 - Technical Approach

The Government will evaluate the offeror's technical approach based on the information contained in the technical quotation to determine the extent of its methodology for classifying hazards and drafting SDS’s; and, maintaining an adequate no. of staff with the required education and experience levels to accommodate completion of up to 15 SDS’s concurrently and comply with preparation times stated in the SoW.

The Government will evaluate the offeror’s sample Level 4 SDS to determine the extent to which the sample complies with the required content expressed in the Safety Data Sheet Authoring Request.

Factor 2 - Organizational Experience

The Government will evaluate the offeror’s organizational experience examples submitted to determine the extent to which the offeror’s general background and experience demonstrate its ability to classify hazards and draft SDS’s for organizations similar to NIST.

Factor 3 - Past Performance:

The Government will evaluate the Offeror’s past performance information to determine its relevance to the current requirement and the extent to which it demonstrates that the Offeror has successfully completed relevant contracts in the past three (3) years. In assessing the Offeror’s past performance, NIST may evaluate the quality, timeliness, and ability to control cost and schedule of past work. Offerors with no relevant past performance will not be rated favorably or unfavorably. Past performance will be evaluated by contacting appropriate references, including NIST references, if applicable.

PRICE:

The Government will evaluate the Offeror’s proposed pricing to determine whether the calculated standard turn-around and rush turn-around fees to prepare: a) Levels 1-4 SDS’s; b) addendum and/or updates to existing SDS’; and, c) “shipped” container label files, are realistic, complete, and reasonable in relation to the solicitation requirements.

Pricing will not be evaluated for quotations that are determined technically unacceptable under the Technical Capability and Organizational Experience evaluation factors.

The Government does not intend to enter discussion and may award a purchase order on the basis of initial offers received, without discussions. Therefore, each initial quotation shall contain the offeror’s best terms. Nonetheless, the Government reserves the right to conduct discussions if it is in the best interest of the Government.

SECTION II

If the vendor objects to any of the terms and conditions contained in this solicitation, the vendor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Vendor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the vendor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Vendor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
