About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Naval Surface Warfare Center, Carderock Division (NSWCCD). The requirement is for the design and installation of a new fiber optic infrastructure system at the West Bethesda site, with an estimated total value of $5.4 million. The project involves creating a three-hub structure connecting critical Buildings 1, 4, and 17, and includes system design, installation, and removal of the existing infrastructure through underground ductwork.

NSWCCD intends to award a Firm-Fixed Price (FFP) contract to MIG GOV, LLC on an urgent basis due to critical infrastructure vulnerabilities. The current fiber loop, installed in the early 1990s, has experienced consistent outages affecting mission-critical systems including Navy-Marine Corps Intranet (NMCI), Research, Development, Test & Evaluation (RDT&E) Network, life safety, and Lenel security systems. The procurement is also tied to a regional management plan to transfer operational monitoring of the Lenel system to the Naval District Washington (NDW) Police Force, which requires a stable and redundant fiber optic network.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Carderock Division (NSWCCD), Contracting & Acquisitions Department (Code 02).

2. Description of the Action Being Approved

NSWCCD intends to purchase the design and installation of a new fiber optic infrastructure system for base-wide connectivity. The Government has an unusual and compelling urgency to procure these construction services to maintain compliance and further ensure security, safety, and mission critical communications at the NSWCCD West Bethesda site. NSWCCD intends to award a Firm-Fixed Price (FFP) contract to MIG GOV, LLC.

3. Description of Supplies/Services

This requirement is inclusive of, but not limited to, the design of a new fiber optic infrastructure at the West Bethesda site, the installation of the new system, and the removal of the old infrastructure through existing ductwork underground. The system will be tested to ensure operational functionality and will be designed based on the Government’s need. Specifically, the requirement will include a three-hub structure based around critical buildings at West Bethesda, including Buildings 1, 4, and

17. The estimated total dollar value is $5.4 million.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. §2304(a)(2), as implemented by FAR 6.302-2, “the agency's need for the property or services is of such an unusual and compelling urgency that the United States would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.”

5. Rationale Justifying Use of Cited Statutory Authority

NSWCCD has an urgent requirement to transition from the old fiber infrastructure to a new operational system that can support the demand of the Warfare Center’s West Bethesda worksite. The current fiber loop utilized by NSWCCD at the West Bethesda worksite is at the end of its life, and was installed in the early 1990’s, and was constructed with limited redundancies. The system has experienced consistent outages over the last few months, which includes mission critical systems, including Navy-Marine Corps Intranet (NMCI), Research, Development, Test & Evaluation (RDT&E) Network, life safety, Lenel security systems, and other communication systems. Such unscheduled outages have a catastrophic impact to the Unclassified and Classified RDT&E, NMCI, and other networks that the scientific and engineering departments rely upon to carry out the Warfare Center’s mission. The current system is becoming less stable and unreliable with the Warfare Center’s continued use of the fiber infrastructure.

Additionally, NSWCCD intends to transfer the operational monitoring and system maintenance of the Lenel system to the Naval District Washington (NDW) Police Force, as part of the regional management and oversight plan. This plan is conditioned on multiple factors, including the development and deployment of a stable fiber optic network that can support multiple redundancies and can isolate outages, all of which the current infrastructure cannot support. NDW initially had not intended to take over the operation of the Lenel system until the Lenel system was brought up to the OnGuard 8.3 firmware. This was also slated for FY26 but the firmware is now slated to be updated on or before 30 September 2025. This has accelerated the requirement to award the fiber infrastructure project as soon as possible.

Any further delays to resolicit this requirement for 30 days, vet multiple proposals, clear legal reviews, and make an award would substantially delay the transition to the region as well as cost NSWCCD over $300K a year to continue to manage and maintain the existing system. Additionally, with further delays, the migration of the Lenel system and the fire alarm system would pose risk to the personnel working at NSWCCD because the alarm systems would not be centrally monitored by the NDW Police and Fire agencies.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

NSWCCD performed extensive market research during acquisition planning for this requirement. Pricing was also identified using RS Means, as well as other cost estimating software. A solicitation was issued to a vendor who performed the initial installation approximately 15-20 years prior, but the vendor informed NSWCCD that it was unable to respond to the solicitation. NSWCCD made additional efforts to identify capable vendors in the marketplace that had the historical knowledge of NSWCCD’s West Bethesda work site, and possessed the capability to perform requisite work efforts were unsuccessful. NSWCCD also informally contacted existing NSWCCD Multiple Award Contract-holders for construction services, resulting in only one possessing the experience and capability of completing this project.

NSWCCD contacted a vendor that previously provided the Warfare Center comparable fiber optic infrastructure support; however, the vendor indicated that it was unable to respond to the solicitation. Open market solicitations may not yield vendors that have experience or knowledge to strictly comply with NSWCCD’s project schedule to meet the requirements of NDW’s transition of the Lenel system, and to ensure consistent stability to the system, resolving unscheduled outages that have a catastrophic impact to the Unclassified and Classified RDT&E, NMCI, and others. Due to the transition timeline, the contract must be awarded as soon as possible to allow for execution this FY and transition early next FY.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will request the data other than certified cost and pricing data necessary to conduct a cost analysis in accordance with FAR 15.404-1(c) and receive a
