FHFA Brand Name Justification

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

41 U.S.C. 3304 (a) (1)

Pursuant to the requirements of the Competition in Contracting Act (CICA), as implemented by FAR Subpart 6.3, and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is supported by the following facts and rationale required under FAR 6.303-2 as follows:

1. AGENCY AND CONTRACTING ACTIVITY

The Federal Housing Finance Agency (FHFA), Office of Budget and Financial Management (OBFM), proposes to enter into a contract on the basis other than full and open competition for a brand name purchase.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

FHFA’s Office of Technology and Information Management (OTIM) has a requirement to procure Symantec’s Enterprise Vault (e-Vault) software licenses, associated software maintenance support and help desk support services. e-Vault software licenses consist of perpetual software licenses for each of the following e-Vault software components:

Storage Management for Microsoft Exchange, Microsoft SharePoint Portal Server Archiving, Discovery Standard Edition for Microsoft Exchange, File System Archiving- Archiving & Search, and Data Classification Services. The total estimated cost is [REDACTED], inclusive of four (4) one-year options for renewal software maintenance and help desk support and a credit for 300 e-Vault perpetual software licenses currently owned by FHFA, which will be applied against the base period of performance.

3. DESCRIPTION OF SUPPLIES/SERVICES

3.1 FHFA will purchase perpetual software licenses, associated software maintenance, and help desk support services for the Base Year that includes the following e-Vault software components, maintenance and help desk support:

3.2 In addition, FHFA will purchase the option to renew e-Vault maintenance support (software maintenance and help desk support) for Option Years 1-4.

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION

The statutory authority permitting other than full and open competition is 41 U.S.C.

3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION

REQUIRES THE USE OF THE AUTHORITY CITED

FHFA intended to upgrade its currently-owned 300 perpetual software licenses (which consists of the e-Vault components identified in paragraph 2). These licenses were initially purchased via competitive quotes under eBuy as RFQ 427992 by a predecessor agency in 2007 and were last renewed in 2009, to the newest software version. FHFA also intended to acquire maintenance and help desk support services and purchase an additional 350 new perpetual software licenses (which also consists of the e-Vault components identified in paragraph 2). The additional 350 perpetual software licenses are needed to cover: (1) employees who were merged from the Federal Housing Finance Board (FHFB); (2) new employees recently hired by FHFA, and (3) special purpose (group and office) e-mail boxes. However, when FHFA’s contracting personnel contacted Symantec Corp to get more information regarding its currently-owned 300 perpetual software licenses, they were made aware of two (2) options to fulfill the Agency’s requirement for almost the same cost. The first option is renewing support of the currently-owned 300 perpetual software licenses, which means backdating the period of performance to 2009 and purchasing the additional 350 new perpetual software licenses. Renewing the support entitles FHFA to claim all software updates released since 2009 to the present, including EV 10.x. The second option is purchasing all 650 perpetual software licenses as new and allowing all e-Vault software licenses to be on the same maintenance services schedule while receiving a credit of approximately [REDACTED] for the 300 currently-owned software perpetual licenses. These two (2) options were presented to the program office and the decision was made to proceed with the second option.

The following key points are some of the considerations in justifying the acquisition of Symantec’s e-Vault perpetual software licenses, associated software, maintenance, and help desk support services:

• In 2008, in alignment with FHFA’s system architecture, e-Vault was configured, installed, and tested on the agency’s development/test network. The software worked smoothly with the development server and the development network. The software was never fully implemented because a great deal of work associated with the merger of the predecessor agencies took priority. FHFA now faces challenges related to effectively managing legacy e-mails (defined as “the set of e-mails that were created or received by the two predecessor agencies prior to the establishment of FHFA in 2008”). FHFA has determined that using a role-based categorization approach with the existent e-Vault software would be an effective solution for managing legacy e-mails and remove the “housekeeping” burden from employees.

• Acquiring different e-mail archiving software and services, rather than leveraging the investment already made in the existing 300 e-Vault product licenses that FHFA already owns, will result in the expenditure of additional FHFA program management man hours and time to implement an effective e-mail archiving software. Purchasing 650 licenses will enable FHFA to “immediately” and fully implement e-mail archiving capabilities now. e-Vault has already undergone development and testing in the FHFA network environment. Different e-mail archiving software will require additional development and testing in the FHFA network environment, which will delay full production implementation.

• FHFA system administrators and database administrators are already familiar with e-Vault. Three (3) system administrators and database administrators that now work for FHFA, each received 40 hours of formal training on FHFA-specific e-Vault configuration and setup. Since only modest changes have been made to the current e-Vault version, these FHFA system administrators and database administrators could leverage previous training to manage e-Vault in the current FHFA environment. Acquiring different e-mail archiving software will require additional investment in training for system and database administrators, thus increasing administrative costs and potentially delay full implementation.

The National Aeronautics and Space Administration (NASA) Solutions for Enterprise- Wide Procurement (SEWP) Government-Wide Acquisition Contract (GWAC) provides a broad base of Symantec re-sellers that can compete for award of the e-Vault requirement.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICAL

A solicitation will be sent to thirty-eight (38) vendors under the NASA SEWP Indefinite Delivery Indefinite Quantity (IDIQ) contract. This contract vehicle has already been synopsized in accordance with FAR 5.201.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer determines that the anticipated price will be fair and reasonable by obtaining competition among the NASA SEWP vendors.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED

FHFA believes that award to any other brand would result in substantial duplication of cost that is not expected to be recovered through competition and would result in unacceptable delays in fulfilling agency objectives as described in paragraph 5. As a result, while comparable products may exist, FHFA market research focused on available sources and resellers to fulfill our e-Vault requirements. Market research has concluded that the requirements could be fulfilled by soliciting from the NASA SEWP IDIQ contract.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL

AND OPEN COMPETITION

No other supporting facts other than those addressed in Section 5. To accomplish the initiatives and requirements for Records and Information Management, e-Vault software is required.

10. A LISTING OF SOURCES, IF ANY, THAT HAVE EXPRESSED AN

INTEREST IN THIS ACQUISITION

The following vendors under the NASA SEWP IDIQ contract will be given the opportunity to submit a quote. The vendors are as follows:

Affigent, LLC Blue Tech, Inc. Emtec Federal Alliance Technology CDW*G FCN Technology Alvarez & Associates CounterTrade Products FedStore Corporation Best Buy, Gov LLC Detaline LLC Force 3, Inc.

Dell Federal Systems Four Points Tech GC Micro IBM Merlin International GovConnection, Inc.

iGov.com Presidio Hewlett Packard (HP) ImmixGroup PC Mall Gov i3 Federal Iron Bow Technologies Red River Ricoh Americas Corp Silicon Graphics Fed. Softchoice Corp. Sword & Shield Technica Corporation Three Wire Systems ThunderCat Technology Unisys WWT

11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

EITHER REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION

If in the future, FHFA has a need to replace the proposed software due to a change in its current technical requirements, then the Agency will conduct an extensive market research effort in an attempt to identify additional manufacturers besides Symantec without negatively impacting performance.

12. CONTRACTING OFFICER'S CERTIFICATION
