Pursuant to s. 943.325 Florida Statutes, the FDLE Regional Operations Centers throughout the state operate crime laboratories with the specific mission of investigating high profile criminal case work. To accomplish this, FDLE must utilize specific equipment and implements in the analysis of crime-related specimens.

FDLE currently owns Agilent gas chromatographs, mass spectrometers, and related equipment used for the analysis of forensic evidence.

The FDLE OROC crime laboratory is in the process or relocating and must move Agilent equipment to accomplish the relocation.

Justification for single source acquisition (what is necessary and unique about the product, service or source; steps taken to confirm unavailability of competition, as appropriate):

FDLE must move the aforementioned instruments in a manner that protects the integrity of the equipment and ensures proper procedures are used during the de-installation and re-installation processes. Mishandling of the instruments during the moving process could result in less than optimal and inefficient development of procedures to analyze forensic evidence as well as a delay in routine casework.

The relocation services must be completed by Agilent to ensure Agilent certified individuals de-install and re-install the FDLE owned equipment. Agilent does not currently certify any third party vendors to de-install or re-install the equipment. Furthermore, FDLE's Agilent equipment is currently under a service agreement with Agilent and damages caused by a third party vendor would void FDLE's warranty and would not be covered under FDLE's current service agreement.

Damages incurred during de-installation, re-installation, and transport by a third party may make the instruments ineligible for future service through Agilent.

Prospective vendors are requested to provide information regarding their ability to supply the commodities or contractual services described. If it is determined in writing by the agency, after reviewing any information received from prospective vendors, that the commodities or contractual services are available only from a single source, the agency shall provide notice of its intended decision to enter a single-source purchase contract in the manner specified in Rule 60A- 1.045, Florida Administrative Code, and section 120.57(3), F.S.
