About this file

This is an Invitation to Bid (ITB) issued by the Florida Department of Law Enforcement (FDLE) for the procurement of oral swab collection kits to support the Investigations and Forensic Sciences Program and DNA Investigative Support Database in Tallahassee, Florida. The FDLE seeks an estimated 120,000 to 180,000 oral swab collection kits annually, with each kit consisting of outer packaging (either sealed clear plastic sleeves or pre-sealed white envelopes), a pre-printed return address envelope, a printed kit/form on white Bristol stock, a sample card/swab envelope, a sterile sponge-tipped swab, and a sample collection card (either FTA Indicator Card or Nucleic Card Color matrix). The contractor must deliver a minimum of 10,000 kits monthly with deliveries due no later than the first Tuesday of each month, excluding state holidays, and accommodate supplemental orders of up to 5,000 additional kits monthly with fifteen-calendar-day delivery. Written questions are due by 12:00 p.m. Eastern Time on March 30, 2026, with bid submissions due by 2:00 p.m. on April 15, 2026. Public bid opening is scheduled for 10:00 a.m. on April 17, 2026, via conference call. The resulting contract will have an initial term of twelve months with three one-year renewal options at the FDLE's discretion, contingent upon satisfactory performance and fund availability.

Bidders must provide separate unit pricing for two sample collection card options (with and without cards provided by FDLE) and for each of the two packaging configurations, with no additional tooling, change, or administrative fees permitted regardless of FDLE's selection or subsequent configuration changes. All freight, inside delivery, and associated delivery costs must be included in the awarded unit price, and supplemental quantities are invoiced at the same unit price with no rush fees or surcharges applicable. Manufacturers must comply with FDA Good Manufacturing Practices and provide current FDA registration numbers with bid submissions, and bidders are required to submit physical samples of their proposed kits with complete bid responses. All bidders must register on MyFloridaMarketPlace, comply with drug-free workplace certifications, and submit vendor certification forms as required. The solicitation incorporates Florida's General Instructions to Bidders (PUR 1001, 2006 version) and General Contract Conditions (PUR 1000) by reference, establishing standard requirements for all Florida state procurements. No specific set-aside designations for disadvantaged enterprises are identified in the solicitation materials, though minority business enterprise certification compliance is required. Communications regarding the solicitation must be directed to Angela Githens, Procurement Officer, at FDLEOGSContracts@fdle.state.fl.us with the ITB number in the subject line.

SOLICITATION INTRODUCTION

Critical Things to Keep in Mind When Responding to a Solicitation for the Florida Department of Law Enforcement

1. Read the entire document. Note critical items such as mandatory requirements; sample(s) required; supplies/services required; submittal dates; number of copies required for submittal; funding amount and source; contract requirements (i.e., contract performance security, insurance requirements, performance and/or reporting requirements, etc.).

2. Note the Procurement Officer's name, address, phone numbers and e-mail address. This is the only person you are allowed to communicate with regarding the solicitation and is an excellent source of information for any questions you may have.

3. Take advantage of the “question and answer” period. Submit your questions to the Procurement Officer by the due date listed in the Calendar of Events and view the answers given in the formal “addenda” issued for the Solicitation. All addenda issued for a solicitation are posted on the Vendor Information Portal website (MyFloridaMarketPlace Vendor Information Portal) and will include all questions asked and answered concerning the solicitation.

4. Follow the format required in the solicitation when preparing your response. Provide point-by-point responses to the required sections in a clear and concise manner.

5. Provide complete answers/descriptions. Read and answer all questions and requirements. Don’t assume the Department will know what your company capabilities are or what items/services you can provide, even if you have previously contracted with the Department. The bids are evaluated based solely on the information and materials provided in your response.

6. Use the forms provided, i.e., Solicitation cover sheet, Price forms, etc.

7. Check the Vendor Information Portal website for solicitation addenda. Before submitting your response, check the Vendor Information Portal website to see whether any addenda were issued for the solicitation. Some addenda require that you sign and return them with the bid.

8. Review and read the Solicitation document again to make sure that you have addressed all requirements. Your original response and the requested copies must be identical and complete.

9. Submit your response on time. Note all dates and times listed in the Calendar of Events and within the document and be sure to submit all required items on time. Faxed, emailed or late bid responses are never accepted.

The FDLE has established certain requirements with respect to bids to be submitted by Bidders. The use of “shall”, “must” or “will” (except to indicate simple futurity) in this ITB indicates a requirement or conditions from which a material deviation may not be waived by the Department. SECTION 3 – PERFORMANCE METRICS AND FINANCIAL CONSEQUENCES FOR ORAL SWAB

COLLECTION KIT ORDER FULFILLMENT

3.1 MONTHLY DELIVERY REQUIREMENTS

The minimum monthly delivery requirement established in Section 2.5 shall be ten thousand (10,000) Kits per month, for a total of one hundred twenty thousand (120,000) Kits over a twelve (12) month period.

Delivery shall occur in accordance with Section 2.5. This delivery schedule is automatic and continuous. No purchase order, release, or additional authorization from FDLE is required to initiate or trigger monthly delivery obligations.

3.2 DELIVERY COMPLIANCE STANDARD

For purposes of performance measurement, a Kit is considered “on time” only if physically received and accepted by FDLE on or before the required monthly delivery date.

The Contractor is responsible for maintaining sufficient inventory, supplier relationships, and operational capacity to meet the monthly delivery requirements set forth in this Solicitation and any resulting Contract.

3.3 FINANCIAL CONSEQUENCES FOR LATE DELIVERY

For each Kit not received and accepted by the required monthly delivery date, FDLE may apply a price reduction of $0.50 per late Kit.

If the Contractor provides written notice prior to the required delivery date explaining the anticipated delay and FDLE determines the delay is outside the Contractor’s reasonable control, FDLE may, at its sole discretion, waive or adjust the applicable price reduction.

For purposes of this section, routine supply chain constraints, inventory shortages, subcontractor delays, or increased material costs shall not, standing alone, be considered circumstances outside the Contractor’s reasonable control.

Extraordinary events beyond the reasonable control of the Contractor, such as declared natural disasters, government embargoes, or other force majeure events as defined in the resulting Contract, may be considered in FDLE’s determination.

Any price reduction applied shall be reflected as a deduction on the Contractor’s invoice for the applicable monthly billing period. FDLE reserves the right to offset such reductions against amounts due to the Contractor.

3.4 FAILURE TO DELIVER MONTHLY QUANTITY

If the Contractor anticipates that it will be unable to deliver the full required monthly quantity of 10,000 Kits, the Contractor shall promptly notify FDLE and provide a written explanation and proposed corrective action plan.

If the required quantity is not delivered and FDLE determines that operational needs require immediate fulfillment, FDLE may procure the necessary Kits from an alternate source.

3.5 REPLACEMENT PROCUREMENT AND COST RECOVERY

If the Contractor delivers Kits after the required monthly delivery date, FDLE may apply the per-Kit price reduction described above to the late quantity delivered by the Contractor.

If FDLE procures Kits from an alternate source due to the Contractor’s failure to deliver the required quantity, FDLE may recover from the Contractor the difference between the Contractor’s awarded unit price and the price paid to the alternate source for the affected quantity.

For any quantity procured from an alternate source, the cost differential recovery shall apply in lieu of the per-Kit price reduction for that same quantity. The per-Kit price reduction shall apply only to quantities delivered by the Contractor after the required delivery date.

3.6 MONITORING

FDLE will monitor the Contractor’s monthly delivery performance to ensure compliance with the requirements of this Solicitation and any resulting Contract.

Delivery compliance shall be determined based on documented receipt and acceptance records maintained by FDLE.

Financial consequences, if applicable, shall be calculated based on documented delivery performance for each monthly billing period.

3.7 MISCELLANEOUS FEES AND CHARGES

The Contractor shall not charge FDLE any additional fees beyond the awarded unit price. Prohibited charges include, but are not limited to, property tax, sales tax, delivery charges, pick-up charges, fuel surcharges, administrative fees, or any other supplemental costs.

All costs necessary to meet the delivery requirements set forth in this solicitation shall be included in the Contractor’s bid price.

SECTION 4 – INVITATION TO BID PROCESS

This ITB is hereby advertised on the State of Florida VIP. To find the ITB or other related information, enter Agency “Department of Law Enforcement” and click on “Initiate Search” at the bottom of the web page. If unable to download the document(s), contact the FDLE Procurement Officer.

Section 120.57(3)(b) F.S., requires that notice of protest of the solicitation documents shall be made within 72 hours after the posting of the solicitation. Failure to file a protest within the time prescribed in section 120.57(3) F.S., shall constitute a waiver of proceedings under Chapter 120 F.S.

4.1 SPECIAL CONDITIONS AND INSTRUCTIONS

The FDLE Bid requirements and special conditions modify and shall take precedence over the State of Florida form PUR 1001, General Instructions to Bidders.

The FDLE currently does not utilize the State of Florida’s, MyFloridaMarketPlace e-Procurement system for competitive solicitations such as this ITB. Bidders are to manually submit a hard copy of their responses to this ITB as identified in this section. Specific references to MFMP usage for this ITB stated in paragraphs 3 and 5 of the PUR 1001, General Instructions to Bidders are not applicable.

4.2 SOLICITATION REQUESTS

All questions or requests for clarification pertaining to this ITB should be addressed in writing to the Procurement Officer. It will be the responsibility of each Bidder to submit any questions prior to the ITB receipt opening. Questions or requests for clarification concerning the specifications or solicitation procedures as written must be submitted to the FDLE in accordance with the Schedule of Events / Timeline.

The written interpretation of the appropriate representative of the FDLE shall prevail.

4.3 BIDDER INQUIRIES

The Bidder will examine the ITB to determine if the FDLE requirements are clearly stated. If there are requirements which may restrict competition, Bidders may request specification changes. Requests must identify and describe the difficulty meeting specifications, provide detailed justification, and provide the recommended changes. Change requests or protests of the specifications must be received by the State no later than 72 hours after the posting of the solicitation. The FDLE will determine what, if any, changes to the ITB will be accepted. If required, the FDLE will issue addenda reflecting the changes.

Written interpretations of the appropriate representative of the FDLE will prevail. While oral responses may be given in good faith and are intended to be accurate, the FDLE is not bound by any non-written interpretation or guidance offered to Bidders.

4.4 ADDENDA

The FDLE reserves the right to modify this ITB. All addenda to this ITB will be in writing with content and number of pages described to all Bidders. Any addenda or answers to written questions supplied by the FDLE to participating Bidders may include an Addenda Acknowledgement Form. This form shall be signed by an authorized representative of the Bidder’s organization and submitted to the FDLE.

All addenda will be provided via the VIP at the following website: MyFloridaMarketPlace Vendor Information Portal

Bidders are not authorized to make any changes to the ITB including forms or attachments submitted with their Bid, unless otherwise specified. Making such modifications may be grounds for deeming the Bidder non-responsive.

It is the sole responsibility of the Bidder to monitor the VIP for any addenda issued in reference to this ITB.

4.5 DISCUSSIONS

No negotiations, decisions or actions shall be initiated or executed by the Bidder as a result of any discussions with any State employee prior to the opening of the sealed Bid(s). Prior to the opening of the sealed Bid(s), Bidders are NOT to divulge bid prices to any state employee or representative of the State. Further, Bids submitted to FDLE will remain unopened until the time for opening Bids as indicated on the Schedule of Events / Timeline. During this period, any discussion by the Bidder with any state employee or representative of the State involving price information will result in rejection of said Bidder’s response. Only those communications which are in writing or electronically submitted by FDLE, General Services may be considered as a duly authorized expression on behalf of the FDLE. Also, only communications from Bidders, which are in writing and signed or electronically submitted, will be recognized by FDLE as duly authorized expressions on behalf of the Bidder.
