Task Order Title: BRAND NAME OR EQUAL SPECIFICATIONS TO SIMILARWEB
SUBSCRIPTION AND TRAINING FOR CENTER FOR TOBACCO PRODUCTS (CTP)
1.0 Background and Purpose
The Family Smoking Prevention and Tobacco Control Act grants the U.S. Food and Drug Administration (FDA) the authority to regulate tobacco products. The FDA established the Center for Tobacco Products (CTP) to regulate the manufacture, marketing, and distribution of tobacco products to protect public health and to reduce tobacco use by youth. CTP oversees the implementation of the Family Smoking Prevention and Tobacco Control Act. To inform tobacco regulation, CTP implements and supports various internal and external research activities designed to expand the science base for tobacco regulation. One of these research activities is monitoring web traffic related to tobacco products.
Website analytics data allows researchers to access and analyze traffic to non-owned websites.
Analytics data of tobacco-related industry websites (e.g., manufacturers, distributers, retailers) can provide information on who is visiting these sites, how they arrive at these sites, and what they do once on the site. Website analytics data can provide information to help understand the popularity, overall active use, and related site traffic of different websites and which audiences may be exposed to these websites.
The purpose of this fixed price contract is to provide website analytics monitoring services for tracking tobacco-related industry websites.
Specifically, the Contractor shall provide CTP with access to its existing website analytics monitoring software and provide technical assistance in setting up and maintaining the software so that it can be used by CTP for research purposes. The software shall include traffic analytics for websites, including traffic source; total visits by day, week, month, and year; average visit duration; pages per visit; bounce rate (i.e., single page sessions); and visitor demographics.
CTP may publish results in peer-reviewed journals based on research conducted using the software.
2.0 Scope
The Contractor shall provide CTP online access to and support for its website analytics monitoring software – SimilarWeb – or equivalent product, which shall include traffic analytics for websites, including traffic source; total visits by day, week, month, and year; average visit duration; pages per visit; bounce rate; and visitor demographics.
The services for this requirement, listed below, will provide information to CTP to monitor tobacco-related industry websites and to inform tobacco regulatory actions.
2.1 The Contractor shall ensure that the proposed solution meets the following salient characteristics:
• The Contractor shall provide CTP with a subscription or license where CTP can log on via a website or software to view website analytics data collected by the existing platform.
• The Contractor shall ensure that a minimum of four users can access the system via user name and password authentication.
• The Contractor shall ensure that the software allows for tracking of websites.
• The Contractor shall ensure that the software tracks website analytics both from desktop and from mobile websites.
• The software shall provide website analytics data for websites, including traffic source; total visits by day, week, month, and year; average visit duration; pages per visit; bounce rate (i.e., single page sessions); and visitor demographics.
• The software shall include indicators for main traffic sources (i.e., channels) that lead to each website, including direct, referrals, organic search, paid search, social, email, and display ads.
• The software shall provide visitor demographic information for age and gender distribution.
• The software shall include indicators for conversion (i.e., if customers make a purchase).
• The software shall include primary keywords that companies are competing for.
• The software shall include components for displaying data.
• The software shall be able to display analytics for multiple websites at once to demonstrate comparable metrics.
• The Contractor shall ensure that the website analytics of multiple websites can be downloaded and exported to Microsoft Excel using either .xls or .csv file format.
• The software shall have the ability to provide access to historical data starting from 2017 or as soon thereafter as available.
• The Contractor shall provide software support, technical support, and training, as specified in 2.2 Requirements 2.2.3- 2.2.4.
2.2 Requirements
2.2.1 License / User Accounts: The Contractor shall provide access to SimilarWeb subscription or equivalent and support services for a minimum of four users.
2.2.2 Software: The interface and data shall be cloud- or web-hosted and shall be accessible 24 hours a day, 7 days a week with a user ID/password.
2.2.3 Software and Technical Support: The Contractor shall assign a Project
Manager to answer CTP’s questions and assist with system issues. The Project Manager shall answer all methodological questions and provide CTP accompanying documentation in the form of written email responses. The Project Manager (or an alternative staff person with knowledge of CTP’s account) shall answer CTP’s email and telephone inquiries within two business days. Administrative support shall be available eight hours per day, 40 hours per week. In addition, technical customer support or service shall be available from 8:00 AM to 5:00 PM Monday through Friday, US Eastern Time. Customer service shall provide general information on access questions.
2.2.4 Training: The Project Manager shall provide initial training to familiarize a minimum of four CTP staff with the software, and up to five additional trainings per year as needed. The initial training shall be up to one day and may be held in-person at CTP’s office (Beltsville, Maryland), or by webinar.
The Contractor shall provide a written user guide on how to use the software for distribution within CTP.
3.0 Deliverables
3.1 Kickoff Meeting: Within five (5) business days after award, the Contractor shall meet with the Government via teleconference for up to two hours to discuss contract administration and the process for providing user names to gain access to the website. The Contractor shall take notes at the kickoff meeting and provide them to the Government within three (3) business days after the kickoff meeting.
3.2 User Accounts: Within five (5) business days after kickoff meeting, the Contractor shall provide user accounts for web access to the COR.
3.3 Training: Within 90 days of contract award, the Contractor shall provide user guides/manuals and initial training (up to one day) to the CTP team.
4.0 Period of Performance
The period of performance is for a base period of 12 months and four (4) 12-month option years. Each option period has the same tasks as the base period.
5.0 Place of Performance
SimilarWeb or product equivalent is a cloud/web-based subscription. Trainings shall take place at FDA-CTP in Beltsville, Md or via webinar.

9.0 Conflict of Interest
The Contractor or Offeror warrants that, to the best of its knowledge and belief, and except as otherwise disclosed to the Contracting Officer, it does not have any actual, potential, or apparent conflict of interests pertaining to the subject contract, as defined in FAR Subpart 9.5 and HHS and FDA policies, for its organization, employees, or subcontractors working or proposed to be working under this contract.
The Contractor or Offeror agrees that, if after award, it discovers a conflict of interest with respect to this contract, it shall make an immediate and full disclosure in writing to the FDA Contracting Officer for this contract.
The Government reserves the right to exercise any remedy available at law or equity, including termination of the contract for cause or convenience, should the Government determine remedial action is necessary to address any actual, potential, or apparent conflict of interest.
10. 508 Compliance
All deliverables will be 508 compliant. This requirement does not involve the production of audiovisual materials, publications, or public affairs services.
The following standards are always required to be applied for contracts:

• E203 Access to Functionality (Appendix A, Application and Scoping Requirements)
• E204 Functional Performance Criteria (Appendix A, Application and Scoping Requirements)
• E205 Electronic Content (Appendix A, Application and Scoping Requirements)
• 302 Functional Performance Criteria (Appendix C, Functional Performance Criteria and Technical Requirements)
• Electronic content must be accessible to HHS acceptance criteria. Checklist for various formats are available at http://508.hhs.gov/, or from the Section 508 Coordinator listed at https://www.hhs.gov/web/section-508/additional-resources/section-508-contacts/index.html. Materials that are final items for delivery should be accompanied by the appropriate checklist, except upon approval of the Contracting Officer or Representative.

3) HHS and FDA policy also requires that specific language pertaining to Section 508 compliance be incorporated into every ICT contract. The contract clauses for Section 508 are as follows:

(a) The contracting officer shall insert the provision at 352.239-73, Electronic and Information Technology Accessibility Notice, in all solicitations.
(b) The contracting officer shall insert the clause at 353.239-74, Electronic and Information Technology Accessibility, in all contracts and orders.
11.0 Instruction to Offerors
Quotes shall be valid through July 1, 2020
Offerors shall submit quotations using two (2) volumes. Volume one (1) shall contain all technical information and Volume two (2) shall contain all pricing information.
Equal to quotes must meet all the salient characteristics in order to be considered technically acceptable. Equal to quotes must be submitted as a separate Technical quote with detailed point-by- point description of how the equal to product meets all the salient characteristics of this SOW. Technical quotes shall not contain pricing information.
Authorized reseller and/or servicing agent must identify and/or provide documentation to confirm their claim as an authorized reseller and/or servicing agent.
Volume One (1): Offerors shall clearly state the product description and salient characteristics. The quotation shall include and match (or equal to) the product description and salient characteristics. Offerors shall also include a narrative proposal describing their software support and approach to trainings. The bidders are advised that should their quotation conflict with or does not clearly reflect the specified requirement of this solicitation, their quotation may be deemed as technically unacceptable and may not be considered for award.
Volume Two (2): Offerors providing quotations must break down the proposed pricing by period of performance and clearly state the overall cost to the Government. If proposing an alternate solution, offeror shall include all costs associated with getting the FDA to its current state of functionality without causing any disruptions in service.
All additional terms and conditions must be submitted with its quotation.
Offerors shall submit all applicable terms and conditions in full text as attachments, appendix, or exhibits.
Offerors shall submit Product Accessibility Templates (PAT) in full text with their quotations.
Offerors shall submit all assumptions in their quotations.
Offerors shall notify the Contract Specialist / Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer
(OEM).
Offerors are advised that additional terms and conditions submitted with their quotation that is in conflict of the terms and conditions of this solicitation may be deemed as technically unacceptable and may not be considered for award.
Additional Administrative Instructions:
System for Award Management (SAM). In accordance with FAR 52.212-4, Offerors shall be registered in the CCR database to be considered for award. Registration is free and can be completed on-line at http://www.ccr.gov; provide DUNS number; Cage Code and TIN.

12.0 Award Determination
All quotations will be evaluated on a Lowest Priced Technically Acceptable (LPTA) basis. The award will be made to the lowest price bidder that demonstrates they can meet all the requirements of this solicitation. Failure to demonstrate meeting any of the requirements will result in a rating of technically unacceptable and will not be considered for award.
The Government intends to award a single Firm Fixed Price contract resulting from this solicitation to the responsible Offeror whose proposal represents the lowest price after evaluation in accordance with the factors identified in the solicitation.
While not currently anticipated, the Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government’s best interest to do so.
Exchanges with Offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.
As part of the technical acceptability determination the Government will review all information related to 508 submitted by the vendor. Section 508 conformance of the proposed solution is based upon all information provided by the vendor relevant to accessibility. The Government will evaluate:
• Submission of an HHS PAT for the solution.
• Quality of the accessibility documentation provided. This includes the submission of an HHS PAT to the instructions, inclusion of all applicable standards, and clarity of the information (including additional or supplementary information beyond the HHS PAT) provided.
• Qualitative evaluation of the accessibility of the proposed solution. This includes an evaluation of the proposed solution’s technical conformance to standards for accessibility, in relation to the needs of the agency.
13.0 Evaluation Criteria
The FDA will evaluate proposals and make an award decision based on the lowest evaluated price meeting or exceeding the technical requirements to complete all tasks and deliverables delineated in the SOW. The minimum technical requirements would include:

• SimilarWeb or product equivalent platform which meets all the salient characteristics listed in Section 2.1 of this SOW.
• Evidence of software and technical support for SimilarWeb or product equivalent, as listed in Section 2.2.3 of this SOW.
• Evidence of proposed trainings for SimilarWeb or product equivalent, as listed in Section 2.2.4 of this SOW.
• Evidence of past performance or past experience providing this type of data to governmental or non-governmental public health entity or entities.
• A listing of key personnel and their experience, which must include at least a Program Manager to answer CTP’s questions and assist with system issues.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
