About this file

This document is a Notice of Government Responses to Industry Questions related to a Sources Sought notice dated July 20, 2026. The Government clarifies restrictions on foreign participation in contractor teams and security clearance requirements for classified repair work.

Key restrictions include: foreign-owned or foreign-based subcontractors are prohibited from participating as members of contractor teams; restrictions apply to both classified and unclassified work; and all classified repair work must be performed by appropriately cleared U.S. personnel. The Government emphasizes that Prime Contractors must currently possess an active SECRET Facility Security Clearance (FCL) with appropriately cleared personnel in place prior to contract award, rather than obtaining clearances after award. For unclassified logistics and engineering activities involving foreign partners, the Government notes that engineering roles are problematic if the engineer cannot work on classified issues, potentially requiring two separate engineering resources—one cleared for unclassified work and one for classified work. All other terms, conditions, and response submission deadlines remain unchanged from the original Sources Sought notice.

Notice of Government Responses to Industry Questions:

The Government has received and compiled questions from interested vendors regarding the subject Sources Sought notice. In the interest of transparency, equal access to information, and to assist industry in developing comprehensive capability statements, the official Government responses are provided below:

Vendor Question 1: Does this restriction prohibit foreign-owned or foreign-based subcontractors from participating as members of a contractor team?

USG Response: Yes

Vendor Question 2: Does this restriction apply only to performance involving classified information or classified repair activities?

USG Response: Both

Vendor Question 3: Would a U.S. prime contractor be permitted to utilize foreign partners for unclassified logistics, engineering, or industrial participation activities, provided all classified work is performed by appropriately cleared U.S. personnel and entities?

USG Response: Personnel require classified clearance for the actual repair. Will have to run by our security officer. I suggest we ask the source for details of what they are considering as unclassified logistics (shipping, procurement, etc.), engineering? Engineering is an iffy because why would you hire an engineer who cannot work on classified issues. This means they will need 2 (1 un-class and 1 class).

Vendor Question 4: Must the Prime Contractor possess an active SECRET Facility Security Clearance (FCL) and appropriately cleared personnel at the time of proposal submission, or would the successful contractor be permitted to obtain the required facility and personnel clearances after contract award and prior to performing any classified work?

USG Response: Facility and personnel security clearance should be in place prior to contract award.

Vendor Question 5: For purposes of this Sources Sought Notice, is the Government interested in identifying companies that currently possess the required security clearances, or companies that have the capability and intent to obtain the required clearances prior to contract performance?

USG Response: Currently possess the required security clearances

All other terms, conditions, and the response submission deadline for this market research effort remain unchanged.
