52.212-2 Evaluation—Commercial Items (Addendum Replacing 52.212-2 in full)
BASIS OF AWARD: The Gov’t will award a firm-fixed priced contract to the responsible offeror representing the best value to the Gov't, using a streamlined comparative trade-off evaluation of Technical proposals and Price in accordance with FAR 12.203 and the below, among those offerors receiving a "Pass" rating on the Past Performance factor. This process may result in award to other than the lowest priced quote.
Your quote should contain your best terms. The Gov’t reserves the right to reject without further review quotes which contain additional terms and conditions or exclusions requiring extensive legal or higher level reviews.
After the evaluation of quotes, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.
LATE SUBMISSIONS: The Gov’t will not consider any quote that we receive after the deadline unless we receive it before we award a contract and consideration of the quote is otherwise in the best interest of the Gov’t.
STANDING PRICE QUOTATIONS: Standing price quotations may be used if needed and deemed in the best interest of the Gov’t.
PRICE: Gov’t will record total evaluated prices (to include options). If more than 3 quotes are received, the Gov’t will identify a grouping of the most competitively priced quotes; remaining quotes will not be evaluated further unless later deemed necessary by the Contracting Officer.

TECHNICAL: The Government will evaluate the technical proposal to determine how well the proposed products or services meet the Government’s requirement. The Gov’t may deem a quote to be technically acceptable or superior if their technical solution differs from the specified requirements or does not meet the technical minimums, but ultimately results in a solution that will meet or exceed the intent of the Government’s needs and would involve an acceptable level of risk.
PAST PERFORMANCE: Past Performance will be evaluated on a Pass/Fail (Acceptable/Unacceptable) basis to determine the likelihood of successful contract performance. The evaluation may be based on the Contracting Officer’s prior knowledge or experience, past performance inquiry replies, CPARS, FAPIIS, or any other reasonable and verifiable basis.
To be rated Acceptable (Pass), the offeror’s submitted past performance must demonstrate compliance with the following thresholds:
Evaluation Element Required Standard
System Similarity
Experience successfully delivering similar powered paragliding or individual aerial mobility flight systems. (Does not require exact matches to the highly specific technical requirements evaluated under the Technical factor, such as wet silk training or 80lb payload flights).
Sustainment & Training Capability
Experience successfully delivering related tactical flight training and/or spare parts and sustainment support packages.
Recency Timeframe Performance must have occurred within the last three (3) years from the solicitation release date.
Minimum Quantity Successful delivery of at least three (3) flight systems under a previous contract (or contracts) to a military, federal, or commercial client.
Rating Description
Acceptable (Pass)
The offeror’s past performance record indicates a reasonable or high expectation of successful contract performance, OR the offeror lacks a record of relevant and recent past performance (Neutral). In accordance with FAR 15.202(c)(1), An offeror without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance; therefore, a Neutral rating will be treated as a "Pass".
Unacceptable (Fail)
The offeror’s past performance record indicates a low or no expectation of successful contract performance due to documented performance issues, default, cure notices, or poor quality on relevant contracts.
MULTIPLE AWARDS: Gov’t will not make multiple awards unless circumstances deem it appropriate and in the best interest of the Gov’t.
AWARDING WITHIN BUDGET: If deemed necessary to stay within budget, the Gov’t may reduce quantities and reach out to offerors with acceptable or better non-price proposals, requesting they revalidate or update their unit pricing. Alternatively, the Gov’t may cancel the requirement if needed.
