About this file
This is a Simplified Acquisition Procedures (SAP) Determination Memorandum for a sole source acquisition under FAR 13.106-3(b)(3)(i) with purchase request number F6A1D05027AW01 and an estimated amount of $112,692.43. The document justifies awarding to Colonna's Ship Yard, Inc. DBA Steel America for providing towing, lifting, laydown, storage, and maintenance support services for three MKVI Patrol Boats.
The sole source justification explains that the Michigan Air National Guard acquired these patrol boats from DLA that were slated for scrapping. The boats are currently stored at the contractor's facility under an existing Navy contract (N0018922P0641), but their seaworthiness is unknown after 9 years of offshore storage and 2.5 years without water testing. Due to these risks, the government determined that only the current contractor should perform the work to avoid potential loss of government property during transfer. The period of performance will begin March 13, 2025, for an estimated 1-4 months, with monthly billing. The market research indicates that while similar services are commercially available, the specific requirement cannot be met by other sources due to the unique circumstances and risks involved.

| _7_ PROVIDE A STATEMENT OF ACT_dWWFyKo3zgQ-e71MSrA2mA: Market research for future storage initiatives will continue. However, due to the short duration of the requirement until the vessels can be shipped to Michigan, future initiatives will be competed among local vendors. | |
| _5_ PROVIDE A STATEMENT OF ACT_xMsHeIbKfGYdZx*NQZBzkg: Similar services are widely available, and the services are considered to be commercial in nature. The requirement cannot be met by the required sources of supply and services. | |
| _4_ UNIQUE CHARACTERISTICS THA_fxPS18NzthbsRqqrY5h47Q: This requirement was created following the Michigan Air National Guard’s acquisition of 3 Mark VI Patrol Boats from DLA that were slated to be scrapped if they were not procured by an outside agency. Using the open market would incure additional costs to the government since the current contractor would have to allow the new contractor access to their facility for work to be done. It is unknown if the watercraft are seaworthy, and they are currently being stored at a Contractor Facility under an existing Navy Contract, number N0018922P0641. The property is to be transferred and stored under a new MING contract. Discussions with the requiring activity indicated that there is a high risk that the vessels are not seaworthy since they have been stored offshore for 9 years and have not been water tested in 2.5 years. Since the seaworthiness of the vessels is unknown, water towing the vessels could result in the loss of government property. Competing the requirement and having them towed prior to inspection, repair, and fit-in could result in the loss of the government property. Under the current Navy contract, there is no authority to conduct inspection/maintenance/repair of the vessels, and the Navy is unwilling to modify the contract to allow for these services. The only reasonable path forward is to transfer the vessels to a MING contract with the contractor that allows for inspection/maintenance/repair services. The storage is temporary until the MING can determine seaworthiness and prepare the vessels for shipping from the contractor facility to Michigan. | |
| _3_ BRIEF DESCRIPTION OF SUPPL_UM33PhqLHArLIQSUjN*Zfw: The contractor shall provide all personnel, equipment, tools, materials, supervision, utilities, and quality control necessary, to provide towing, lifting, laydown, storage, and maintenance support required for three (3) MKVI Patrol Boats listed below and in Technical Exhibit 1. Services shall be performed at Contractor’s facilities. The period of performance for these services will begin 13 March 2025 for an estimated period of one (1) to four (4) months. Services will be billed monthly and end when services are no longer being rendered. | |
