If an actual or potential OCI exists, the Offeror shall submit a mitigation plan with the proposal. The
Contracting Officer will review the submitted mitigation plan and make a determination as to whether the plan adequately resolves the issues and provides adequate protection to both the
Offeror and the Government. Submission of mitigation plan is only required if the Offeror is aware of potential or actual OCI issues related to this procurement. Page. Tables of Content do not count against the page limitations.
L.7.3. Executive Summary. Provide a brief description of the background, experience, qualifications, and capabilities (including notable education, training, professional qualifications, licenses, and experience) for each legal entity participating in the offer. Attachment 4. Offeror Company Information and Team Structure for each legal entity participating in the offer. Ensure that the agreement (or documented affiliation) clearly demonstrates the company/entity’s commitment to perform those significant and critical aspects (EC2 categories) of this contract. An agreement (or documented affiliation) which is unclear, or equivocal in commitment, or vague (e.g., whether agreement applies to this particular contract, ambiguity regarding the EC2 categories to be performed) may adversely impact the evaluation of the offeror’s proposal. If an offeror does not provide sufficient information, then the government may not consider the company/entity’s work samples/contract references in past experience and past performance.
L.7.5.2. The government will review the signed agreement (or documented affiliation) simply to validate the company/entity’s commitment to perform significant and critical aspects of this contract. The form, format, detail, volume are entirely within the discretion of the offeror.

The Subcontractor/Teaming Partner Consent Letter shall be signed by an individual who has the authority to sign for and legally bind the company. Completed Attachment 5.

Offeror deems it necessary, additional Work Sample Reference data can be added at the end of the description. If a column/cell does not include reference data, please insert “N/A” into that cell. The Offeror shall include the Work Sample Reference Number (i.e., WS1-WS62), on each
Work Sample Document page.
L.8.6.1. Offerors shall submit Work Samples and correctly reference that Work Sample to illustrate and demonstrate Past Experience in each EC2 SA. Offerors are cautioned to ensure the
Cross-Reference Matrix is complete and accurate. Offeror omissions/errors may result in the
Government non-validating Work Samples. Each EC2 SA shall receive a separate Work Sample
Reference Number. Each EC2 SA shall not reference the same Work Sample Reference Number.
L.8.7. Work Sample Cover Sheet with Work Sample Documentation
L.8.7.1. Attachment 6. Work Sample Cover Sheet. The Work Sample Cover Sheet shall be completed for each Work Sample submitted. Offerors shall follow the instructions provided within Attachment 6. Each Work Sample shall provide at least two (2) Points of Contact (POCs).
The Government may contact the POCs provided, and the Government reserves the right to contact additional POCs if necessary to validate the Work Sample. For Work Samples performed as a subcontractor, the Offeror shall provide at least two (2) POCs for the prime company.
L.8.7.2. Work Samples. The work sample includes: (1) the Work Sample Cover Sheet, (2) the signed contract/TO cover page, and (3) the work sample official contract documentation.
The Offeror shall provide official contract documentation that demonstrates the Offeror’s Past
Experience of performing the same or similar work. Offerors must submit the original page (not create one page of pasted excerpts from different pages). The signed contract/TO cover page and the work sample official contract documentation shall be unedited original documents. See paragraph L.8.7.2.3. for directions on how to mark documents. Each work sample shall not exceed 10 pages. Page limits apply to individual work samples and cannot be combined between work samples. If the signed contract/TO cover page, and the work sample official contract documentation are classified, the offeror may submit an unclassified government originated/signed document, to meet the work sample requirement. The Offeror shall incorporate all documentation into Volume III.
L.8.7.2.1. "Official contract documentation" includes key documents integral to contract performance, including contracts (other than IDIQ contracts IAW L.8.7.4.), orders, modifications, PWS/SOW/SOO, CDRLs, subcontracting plans, invoices, meeting minutes, progress reports, monthly status reports, or other reports. The contractor may submit other documentation it regards to be integral to the contract (i.e., CPARS, FPDS, signed, original memos from COs/government officials/prime contractor), but Offerors are cautioned that the documentation is validated for past experience (not past performance) and that authenticity
(contract-contemporaneous documents), and level of detail are critical considerations of any
Work Sample. When contracts/TOs are used for Work Samples, the Offeror shall include the signed cover page associated with the contract.
L.8.7.2.2. The Government cautions Offerors to ensure detailed information (through the work sample and Attachment 6. Work Sample Cover Sheet). Do not presume that the government will necessarily extrapolate details that are not clearly presented. Submission of relevant excerpts
(vice submitting an entire document) is recommended. In Attachment 6. Work Sample Cover
Sheet and the Work Sample, spelling out critical acronyms, providing "lay person" explanations, and marking/highlighting (or otherwise distinguishing) key excerpts may also ensure that the
Government may consider the work sample and its nexus to the SAs under the IDIQ. The markings/highlighting should be evident that the marking/highlighting were newly added by the
Offeror and not part of the original document.”
L.8.7.2.3. Offerors shall highlight, notate, or make obvious the specific content within each
Work Sample they intend to satisfy the experience requirement for each SA. These highlights
(within the Work Sample(s)) are required to support the Government’s evaluators to associate the Offeror’s Past Experience with the demonstrated experience in performing the performance objectives identified in Attachment 1. Performance Work Statement (PWS) and Attachment 2.
PWS Supplement – Task Descriptions, respectively. All pages within each Work Sample shall be numbered with the Work Sample Reference Number (i.e., WS1-WS62) IAW Attachment 8.
Cross Reference Matrix, Columns C - K. Work Samples shall be in English.
L.8.7.3. There is a limit of two (2) Work Samples per SA. The Offeror shall submit Work
Sample(s) for each scored EC2 SA of the Self-Scoring Matrix to demonstrate their Past
Experience.
L.8.7.4. A contract/TO for the purpose of evaluating Work Samples is defined as a singular agreement used to document a mutually binding legal relationship obligating the seller to furnish supplies or services in exchange for the buyer paying for them. IDIQ contracts are not an acceptable proof of Past Experience (or Past Performance) and shall not be provided as a Work
Sample. However, individual TOs, performed under an IDIQ contract, can be used as a Work
Sample. Multiple contract/TOs cannot be combined and counted as one Work Sample.
L.8.7.5. Work Sample Qualifications. Work Samples shall meet these minimum qualifications:
(a) Be a past or current contract (including Federal, State, and local government and private) for efforts similar to the Government’s requirement IAW the criteria listed herein.
(b) Performed the work for a minimum of six months in duration and all work must have been completed within the last three years from the date of this Solicitation’s date of issuance or contracts that were started prior to this time, but still in effect with active performance as of 3 years from the date of this solicitation.
(c) Work was accomplished by a legal business entity included in the Team Structure.
L.8.8. Joint Ventures. If the offeror is a Joint Venture, then the Joint Venture must submit evidence of commitment including partners (see L.7.5 13 CFR 125.8 for additional guidance pertaining to Joint Ventures). As the offeror, the Joint Venture must submit information to meet all requirements of the solicitation. The offeror may rely on its own resources or those of its partners (specific capability, Past Performance, experience, business system and certification) to demonstrate the aggregate JV submission. From the thirty-one (31) defined SAs, the JV must demonstrate the contributions/experience of the protégé member in a minimum of six (6) of the
SAs. Therefore, the offeror must provide at least one protégé Work Sample in six different SAs.
In Attachment 4, the offeror will identify the six (6) SAs for the protégé member. Nothing herein requires that a protégé partner’s contribution or experience, solely or individually, meets the same requirements as non-protégé offerors.
L.8.9. Offerors may also include subsidiaries, or legal entities which fall under the Offeror, with the Offeror's affirmation that the subsidiary/legal entity will be supporting the Offeror in the performance of this contract. To use subsidiaries or legal entities as a prime Work Sample, (1) the acquisition of the subsidiary or legal entities shall have been finalized as of the date of this solicitation’s issuance, and (2) objective evidence shall be included in the Volume IV
Organization Structure Change History Section of the solicitation to demonstrate that they are now a legal entity of the Offeror. If the criteria above are met, subsidiary or legal entity Work
Samples will be considered prime Work Samples even if the work occurred prior to the company being acquired. This same approach and documentation requirement applies to any
Subcontractor/Teaming Partner Work Samples.
VOLUME IV - PAST PERFORMANCE
L.9. Volume IV Organization. This volume shall be organized according to L.5. Table 1 -
L.9.1. Volume IV Cover Page: Volume IV must include a cover page with the following
a. Volume number and name of volume
b. Solicitation number and title
c. Offeror’s name, address, and Points of Contact (Primary and an Alternate)
d. Telephone numbers and e-mail addresses for all POCs
e. Date of proposal and validity date (365 days from submission date)
L.9.2. Table of Contents. Volume IV’s Table of Contents shall be broken down at a minimum with Table 1 – Proposal Organization’s Volume IV to help delineate each component included in the Past Performance Proposal. Offerors file the Table of Contents after the Volume IV Cover
L.9.3. Past Performance Table of Contents. Volume IV’s Table of Contents shall also itemize the
Offeror’s list of “Past Performance submittals.” Tables of Content do not count against the page
L.9.4. Past Performance Submissions. This Past Performance evaluation factor assesses the recency, relevancy, and quality of the Offeror’s Past Performance references associated with the
Offeror’s Past Experience Work Samples. The Government will use the information included in the Offeror’s Past Performance Submission, and may gather information from other sources, to assess and assign adjectival ratings to the Offeror’s Past Performance following the criteria described in paragraph M.5.3.
L.9.4.1. A responsive Past Performance Submission consists of: (1) Attachment 9. Past
Performance Information Sheet and either a (2) Attachment 10. Past Performance Questionnaire
(PPQ) (submitted by the Offeror’s client), or a (3) Contractor Performance Assessment Report
(CPAR). PPQs shall only be submitted in instances when CPAR information is unavailable (e.g., commercial contracts, subcontracted work or the initial CPAR is not finalized). Past Performance
Submissions must reflect work accomplished by a legal entity included in the Offeror’s
Attachment 4. Offeror Company Information and Team Structure. Offerors shall only submit
Past Performance Submissions based on contracts submitted in Volume III. The Offeror shall submit a minimum of two (2) and a maximum of five (5) contract references for the Past
Performance Submission.
L.9.4.2. Attachment 9. Past Performance Information Sheet. Offerors shall submit a completed
Attachment 9. Past Performance Information Sheet for each Past Performance Submission.
Identify the applicable SAs represented within this contract reference.
L.9.4.3. Attachment 10. Past Performance Questionnaire (PPQ). Where CPAR is not available, Offerors shall send a PPQ to the Points of Contact (POCs) identified on each of the Offeror’s
Attachment 9. Past Performance Information Sheet(s). The POC on the Past Performance
Information Sheet and the PPQ shall be the same person. (POCs may be the same or different than the POCs identified in Attachment 6. Work Sample Cover Sheet.) Offerors shall use the
Government provided PPQ, Attachment 10. This attachment shall be used for any contract reference (including commercial contracts).
L.9.4.3.1. Offerors shall fill in Section I of the PPQ prior to sending the PPQ to the
Client/Customer POC. Client/Customer POCs will in-turn submit the completed PPQ is directly to the Government POCs listed in para. L.2.2. PPQs shall only be submitted in instances when
CPAR information is unavailable (e.g., commercial contracts, subcontracted work or initial
CPAR is not finalized). If both CPAR and a PPQ are submitted, the PPQ may not be considered.
L.9.4.4. Contractor Performance Assessment Reports (CPAR). For each past performance submission, the Offeror shall provide the most recent CPAR, completed within the last three years, as of the date of this Solicitation’s issuance.
L.9.5. Organizational Structure Change History. Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what Past Performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of your company, if necessary. A pamphlet or other commercial document describing such reorganizations may be used to describe the changes. As part of this explanation, describe how these changes impact the relevance of any efforts you identify for Past Performance evaluation/performance confidence assessment. Since the Government intends to consider Past Performance Information provided by other sources as well as that provided by the Offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
L.9.6. Specific Content. Additional information may be included to discuss the Offeror’s efforts to resolve recent contract performance problems encountered on prior contracts as well as past efforts to identify and manage program risk. Merely having problems does not automatically equate to a “Limited Confidence” or “No Confidence” rating, since the problems encountered may have been on a more complex program, or an Offeror may have subsequently demonstrated the ability to overcome the problems encountered. The Offeror is required to clearly demonstrate its position (i.e., company's response to a Corrective Action Request (CAR) and demonstrate management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified. This may facilitate consideration of a potentially higher confidence rating.
