JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This action will be awarded as a new Firm-Fixed-Price contract.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

Under the contemplated contract, the contractor shall be required to provide and install Laboratory Technical Furniture/Benches for the Information Directorate’s Alter Corporate Collateral Facility (CCF). Due to the nature of the facility and its diversity in occupants, various appropriations are being used (comprised of 3400 and 3600).

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 USC 2304(c), as implemented by FAR 6.302 (FAR 6.303-2(b)(4)).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE

ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

a. Only One Responsible Source (FAR 6.302-1) The Government intends to furnish a newly constructed research and development facility with laboratory furniture to support the scientists and engineers occupying the facility. The Government currently owns approximately $260,000 worth of Wright Line furniture which it will use to partially furnish the space. The remainder of the furniture will be procured under this requirement but must be compatible with the existing Wright Line furniture owned by the Government. Thus, Wright Line is the only brand name that the Government can use for this requirement without experiencing a substantial duplication of cost of $260,000, which is not expected to be recovered through competition.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

Market research was performed which resulted in the belief that numerous small businesses will respond to any subsequent solicitation. Additionally, in accordance with FAR Parts 5 and 12, a combined synopsis/solicitation will be posted to the Federal Business Opportunities website.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer determines that the anticipated cost will be considered fair and reasonable as a result of adequate price competition.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

The brand name manufacturer was contacted and asked to provide a list of companies in the general vicinity of the Information Directorate that would potentially be interested in providing and installing their products. Additionally, GSA Advantage was searched, and potential mandatory sources such as NETCENTS and the Air Force Installation Contracting Agency (AFICA) were ruled out as this requirement is not within their scopes. Further, recent acquisition of similar furniture has shown that numerous businesses are willing and able to provide this requirement.

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted and a synopsis of the proposed acquisition will be posted, advising industry of the pending acquisition and soliciting proposals from interested parties.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS

FOR THE SUPPLIES OR SERVICES REQUIRED

Requirements for new laboratory furniture in the future will be full and open acquisitions if they are not required to be used in conjunction with existing furniture and subsequent compatibility issues. To the maximum extent possible, AFRL/RIOCC will specify new furniture requirements that allow for the use of numerous laboratory furniture brands.

However, it is possible that similar future requirements may require similar restrictions if the alternative would be that the Government realizes an excessive duplication of costs due to the inability to use or reuse existing resources.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)).

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
