Item 8.a.: Specific SCI locations and requirements to be determined on an order by order basis and approved by AFRL/RI Government Program Manager and SSO.

Item 10.e.(1): All Intelligence Information required for this contract will be handled in accordance with special security requirements provided in Attachment: ‘ACCESS TO SENSITIVE COMPARTMENTED INFORMATION,’ and regulations listed in Items 13 and 14.

Item 10.e.(1): Access to SCI is limited to that at U.S. Government locations identified under Item 8.a. or within a Government or Contractor approved SCI facility (SCIF) identified through an approved Memorandum of Agreement (MOA) or Co-Utilization Agreement (CUA). SCI level work maybe approved at a contractor SCIF accredited by an agency other than DIA after CUA approval.

Item 10.e.(2): Access to intelligence information will be handled in accordance with Attachment entitled ‘Release of Non-SCI Intelligence Information to U.S. Contractors.

Items 10.e.(1) and 10.e.(2): Access to intelligence information requires special briefings and a final U.S. Government clearance at the appropriate level. Prior Program Manager and SSO approval of the contracting activity is required for any subcontracting.

Item 10.g.: The contractor is permitted access to North Atlantic Treaty Organization (NATO) information in performance of this contract.

Access to NATO information requires a final U.S. Government clearance at the appropriate level. The government program/project manager is the designated representative that will ensure the contractor security manager and concerned employees are NATO briefed prior to access being granted. Prior approval from the contracting activity is required for subcontracting.

Item 10h.: The contractor is permitted access to Foreign Government information, except North Atlantic Treaty Organization (NATO) information, in the performance of this contract. Access to Foreign Government information requires a final U.S. Government clearance at the appropriate level. Prior approval of the contracting activity is required for subcontracting.

Item 10.j.: Controlled Unclassified Information provided under this contract shall be safeguarded as specified in the Attachment, ‘Protecting Controlled Unclassified Information.

Item 11.c.: The contractor requires access to classified source data, up to and including: the level of classified information stated for performance at contractor locations listed in Item 8.a. in support of the work effort. Any extracts or use of such data requires the contractor to apply derivative classifications and markings consistent with the source documents. Use of “Multiple Sources” on the “Classified By” line necessitates compliance with the NISPOM, paragraph 4-208, and use of a bibliography. Classification, declassification, and markings will be in accordance with EO 13526 and other applicable Executive Orders.

Item 11.g.: The contractor is authorized to use the services of Defense Technical Information Center (DTIC) and is required to prepare and process a DD Form 1540, Registration for Scientific and Technical Information Services, in accordance with the NISPOM. The contracting activity must be involved in certifying need-to-know to DTIC.

Item 11.k.: This contract requires the use of the Defense Courier Service. The contracting activity will request DCS services from the Commander, Defense Courier Service, ATTN: Operations Division, Fort George G. Meade, MD 20755-5370.

Item 11.m.: Any transfer or processing of classified or sensitive information via electronic methods (e.g., facsimile, telemetry, voice, computer) must be protected by implementing an appropriate combination of countermeasures such as encryption devices and sound practices and procedures. The specific countermeasures used must be coordinated by the Project Manager for approval through AFRL/ RIOS, 525 Brooks Road, Rome NY 13441-4505. The use of cellular phones, laptop computers, hand-held radios, personal hand-held organizers, beepers/pagers, cordless telephones and cordless microphones in a computer facility where classified processing is accomplished, requires the special approval of the Government supporting activity.

The Defense Security Service (DSS) is relieved of all industrial security review responsibilities for the contractor's performance at Rome Research Site, NY. The servicing security activity (SSA), AFRL/RIOF, will maintain oversight, control and supervision of the contractor's work performance at Rome Research Site, NY.

The AFRL/RI, Senior Intelligence Officer (SIO) has exclusive security responsibility for all SCI classified material released or developed under this contract. AFRL/RI Special Security Office (SSO) is designated by the SIO as security management and oversight for all SCI non- SCI classified material released to, or developed under this contract and held within the contractor's SCIF. DIA is granted SCI inspection authority for all physical, information and personnel security related matters under this contract.

PROTECTING CONTROLLED UNCLASSIFIED INFORMATION

In accordance with DoDM 5200.01-V4

1. General: In addition to classified information, certain types of unclassified information also require application of access and distribution controls and protective measures for a variety of reasons; such information is referred to collectively as Controlled Unclassified Information (CUI).

This attachment will identify the controls and protective measures developed for DoD CUI; such as For Official Use Only, DoD Unclassified Nuclear Information, and Limited Distribution.

2. Information may not be designated CUI to:

-Conceal violations of law, inefficiency, or administrative error -Prevent embarrassment to a person, organization or agency -Restrain competition -Prevent or delay the release of information that does not require protection under statute or regulation

3. Originator responsibility: Is responsible for determining at origination whether the information may qualify for CUI status, and if so, for applying the appropriate CUI markings. Freedom of Information Act (FOIA) can be consulted for advice on the proper application of FOIA exemptions.

4. Provided or generated by DoD Contractors: The controls and protective measures to be applied shall be described in the pertinent contract documents (e.g., contract clause; statement of work; or DD form 254). Solicitations and contracts shall use a non-disclosure of information clause that prohibits release of unclassified information to the public without approval of the contracting activity. The clause shall also be made applicable to subcontractors.

5. Release or disclosure of CUI to foreign governments or international organizations shall be in accordance with DoDD 5230.20 and other policy and procedures that many be established by the

USD(P).

6. For unauthorized disclosure of CUI, no formal security inquiry or investigation is required.

However, appropriate management action shall be taken to fix responsibility for unauthorized disclosure of CUI whenever feasible or required by other guidance, and appropriate disciplinary action shall be taken against those responsible.

7. For Official Use Only: Is a dissemination control applied by the Department of Defense to unclassified information when disclosure to the public of that particular record, or portion thereof, would reasonably be expected to cause a foreseeable harm to an interest protected by one or more FOIA Exemptions 2 through 9.

-Application: It is the responsibility of the document’s originator to determine at origination whether the information may qualify for FOUO status and to ensure markings are applied as required.

-Marking: Information that has been determined to qualify for FOUO status shall be indicated by markings. Document shall be marked “UNCLASSIFIED//FOR OFFICIAL USE ONLY” at the top and bottom of the outside of the front cover, portion marked in pertinent paragraphs and top and bottom of internal pages.

-Access: No person may have access to information designated as FOUO unless that person has been determined to have a valid need for such access in connection with the accomplishment of a lawful and authorized Government purpose.

-Protection: During working hours, reasonable steps shall be taken to minimize the risk of access by unauthorized personnel. After working hours, FOUO information may be stored in unlocked containers, desks, or cabinets if Government or Government-contract building security is provided.

8. DoD Unclassified Controlled Nuclear Information (DoD UCNI): Is unclassified information on security measures for the physical protection of DoD Special Nuclear Material (SNM), SNM equipment, SNM facilities or nuclear weapons in DoD custody.

-Marking: Information that has been determined to qualify for DoD UCNI status shall be indicated by markings. Document shall be marked “UNCLASSIFIED//DOD UNCLASSIFIED CONTROLLED NUCLEAR INFORMATION” at the top and bottom of the outside of the front cover, portion marked in pertinent paragraphs (e.g.; U//DCNI) and top and bottom of internal pages.

-Access: To DoD UCNI shall be granted only to persons who have a valid need to know the information and are specifically eligible for access in accordance with the provisions of DoDD

5210.83 “Department of Defense Unclassified Controlled Nuclear Information, November 15, 1991.

9. Limited Distribution Information: Is a caveat used by the National Geospatial-Intelligence Agency (NGA) to identify a select group of sensitive, unclassified imagery or geospatial information and data created or distributed by NGA or information, data and products derived from such information.

-Access: Information bearing the Limited Distribution caveat shall be disseminated by the NGA to Military Departments or other DoD components, to DoD contractors and to authorized grantees for the conduct of official DoD business.

10. Distribution Statements on Technical Documents: In accordance with DoDD 5230.24, “Distribution Statements on Technical Documents,” March 18, 1987, requires distribution statements to be placed on classified and unclassified scientific and technical documents. These statements are intended to facilitate control, secondary distribution and release of these documents without the need to repeatedly obtain approval or authorization from the controlling DoD office.

INTELLIGENCE INFORMATION TO U.S. CONTRACTORS

1. Requirements for access to non-SCI intelligence:

a. All intelligence material released to the contractor remains the property of the U.S.

Government and may be withdrawn at any time. Contractors must maintain accountability for all classified intelligence released into their custody.

b. The contractor must not reproduce intelligence material without the written permission of the originating agency through the Intelligence Support Office. If permission is granted, each copy shall be controlled in the same manner as the original.

c. The contractor must not destroy any intelligence material without advance approval or as specified by the Program Manager identified under Item 13 of the DD Form 254.

(EXCEPTION: Classified waste shall be destroyed as soon as practical in accordance with the provisions of the Industrial Security Program).

d. The contractor must restrict access to only those individuals who possess the necessary security clearance and who are actually providing services under the contract with a valid need to know. Further dissemination to other contractors, subcontractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the originating agency through the Program Manager identified under Item 13 of the DD Form 254.

e. The contractor must ensure each employee having access to intelligence material is fully aware of the special security requirements for this material and shall maintain records in a manner that will permit the contractor to furnish, on demand, the names of individuals who have had access to this material in their custody.

f. Intelligence material must not be released to foreign nationals or immigrant aliens whether they are consultants, U.S. contractors, or employees of the contractor and regardless of the level of their security clearance, except with advance written permission from the originator.

Requests for release to foreign nationals shall be initially forwarded to the contract monitor and shall include:

(1) A copy of the proposed disclosure.

(2) Full justification reflecting the benefits to U.S. interests.

(3) Name, nationality, particulars of clearance, and current access authorization of each proposed foreign national recipient.

g. Upon completion or termination of the classified contract, or sooner when the purpose of the release has been served, the contractor will return all classified intelligence (furnished or generated) to the source from which received unless retention or other disposition instructions (see AFMAN 37-139) are authorized in writing by the Program Manager identified under Item 13 of the DD Form 254.

h. The contractor must designate an individual who is working on the contract as custodian. The designated custodian shall be responsible for receipting and accounting for all classified material. The inner wrapper of all classified material dispatched should be marked for the attention of a designated custodian and must not be opened by anyone not working directly on the contract.

i. Within 30 days after the final product is received and accepted by the procuring agency, classified intelligence materials released to or generated by the contractor, must be returned to the originating agency, through the Program Manager identified under Item 13 of the DD Form 254, unless written instructions authorizing destruction or retention are issued.

Requests to retain material shall be directed to the Program Manager identified under Item 13 of the DD Form 254 for this contract in writing and clearly indicate the justification for retention and identity of the specific document to be retained.

j. Classification, regrading, or declassification markings of documentation produced by the contractor shall be consistent with that applied to the information or documentation from which the new document was prepared. If a compilation of information or a complete analysis of subject appears to require a security classification other than that of the source documentation, the contractor shall assign the tentative security classification and request instructions from the contract monitor. Pending final determination, the material shall be safeguarded as required for its assigned or proposed classification, whichever is higher, until the classification is changed or otherwise verified.

2. Intelligence material carries special markings. The following is a list of the authorized control markings of intelligence material:

a. “Dissemination and Extraction of Information Controlled by Originator (ORCON).”

This marking is used, with a security classification, to enable a continuing knowledge and supervision by the originator of the use made of the information involved. This marking may be used on intelligence which clearly identifies, or would reasonably permit ready identification of an intelligence source or method which is particularly susceptible to countermeasures that would nullify or measurably reduce its effectiveness. This marking may not be used when an item or information will reasonably be protected by the use of other markings specified herein, or by the application of the “need-to-know” principle and the safeguarding procedures of the security classification system.

b. Authorized for Release to (Name of the Country(ies)/International Organization).”

The above is abbreviated “REL _________________________.” This marking must be used when it is necessary to identify classified intelligence material the U.S. Government originator has predetermined to be releasable or has been released through established foreign disclosure channels to the indicated country(ies) or organization.

3. The following procedures govern the use of control markings.

a. Any recipient desiring to use intelligence in a manner contrary to restrictions established by the control markings set forth above shall obtain the advance permission of the originating agency through the Program Manager identified under Item 13 of the DD Form 254.

Such permission applies only to the specific purposes agreed to by the originator and does not automatically apply to all recipients. Originators shall ensure that prompt consideration is given to recipients’ requests in these regards, with particular attention to reviewing and editing, if necessary, sanitized or paraphrased versions to derive a text suitable for release subject to lesser or no control markings.

b. The control marking authorized above shall be shown on the title page, front cover, and other applicable pages of documents, incorporated in the text of electrical communications, shown on graphics, and associated (in full or abbreviated form‚ with data stored or processed in automatic data processing systems. The control marking also shall be indicated by parenthetical use of the marking abbreviations at the beginning or end of the appropriate portions. If the control marking applies to several or all portions, the document must be marked with a statement to this effect rather than marking each portion individually.

c. The control markings shall be individually assigned at the time of preparation of intelligence products and used in conjunction with security classifications and other marking specified by E.O. 13526 and its implementing security directives, in addition to previous Executive Orders. The marking shall be carried forward to any new format in which the same information is incorporated including oral and visual presentations.

4. Request for release of intelligence material to a contractor outside Rome Research Site must be prepared by the Program Manager identified under Item 13 of the DD Form 254 and submitted through the AFRL/RI SSO designated in Item 15 of the DD Form 254 to the Director of Intelligence (DI). This should be accomplished as soon as possible after the contract has been awarded. The request must include a copy of the DD Form 254 and the Statement of Work.

(Note: Program Manager identified under Item 13 of the DD Form 254 can obtain a copy of format from the AFRL/RI SSO designated in Item 15 of the DD Form 254).

ACCESS TO SENSITIVE COMPARTMENTED INFORMATION (SCI)

1. Inquiries pertaining to classification guidance on SCI will be directed to the responsible AFRL/RI Contracting Officer’s Representative (COR), Contracting Officer’s Technical Representative (COTR), or Program Manager (PM) and the AFRL/RI Special Security Officer (SSO) as identified under Item 13 of the DD Form 254. (The term PM refers to PM, COR, & COTR in this document). SCI access is limited to the executable term of the contract which is identified in block 9 of the front page of the DD254. Upon expiration of the SCI contract, all contractors with SCI accesses must be withdrawn and all SCI materials must be recovered.

2. All SCI access required in the performance of this contract will be justified through the PM and maintained/approved by SSO. The PM will provide the contractor Facility Security Officer (FSO) or contractor Special Security Officer (CSSO) with written approval of personnel and the necessary data to submit request(s) for single scope background investigations (SSBIs) IAW DOD 5220.22-M (NISPOM) and Supplement Overprint. Term certifications from any other government agencies for contractors working SCI portions of the AFRL/RI contracts are acceptable for the time between submission and approval of the contractor SCI access request.

FSO/CSSO will be required to pass Personal Identifying Information (PII) to the SSO; contractor must make provisions for approved electronic encryption methods to communicate required information. The AFRL/RI Senior Intelligence Officer (SIO) is the final authority for approval of contractor personnel SCI access. The SSO will provide the SCI access nomination request form to FSO/CSSOs.

3. The FSO/CSSO is responsible to establish and maintain an SCI personnel access list of those employees working on the contract to include sub-contractors FSO/CSSO will provide a copy of this list at least quarterly to the PM and SSO.

4. The FSO/CSSO will advise the PM and SSO immediately upon reassignment, dismissal, termination, or revocation of need-to-know for SCI cleared personnel on this contract. A formal notice to the SSO is required for processing debrief action. FSO/CSSOs will notify the PM and SSO immediately when there is a change in status of SCI indoctrinated contractor personnel IAW the security clearance adjudication guidelines identified in ICD 704.

5. All contractor personnel performing SCI work under this contract are subject to additional security training IAW DoDM 5105.21, Volumes 1, 2, and 3. SSO will provide this additional security training to contractor personnel quarterly, which will be recorded and tracked throughout the term of the contract or when SCI indoctrinated personnel are removed from the contract. Additional reporting instructions and information will be provided to the FSO/CSSO.

6. FSO/CSSO must coordinate approval prior to subcontracting any portion of SCI efforts involved in the contract. The subcontractor DD Form 254 must have coordination signatures from the PM and SSO prior to administering.

7. Release of Information: SCI will not be released to contractor employees without specific release approval of the AFRL/RI Senior Intelligence Officer or the originator of the material when applicable. SCI with restrictive caveats (ORCON, PROPIN, etc.) will be released to contractors only when originator approval has been obtained. This approval will be obtained through the SSO based on approved justification of "need-to-know" by the PM.

8. SCI documentation, or other material concerning this contract will not be discussed with or released to any individual, subcontractor, agency (including Federal Government agencies and employees), and contractor employees not working on the contract without prior written approval from the PM.

9. Any SCI-derived material generated under this contract will be reviewed by the PM and SSO for proper classification prior to final publication and distribution. All non-SCI documents and publications developed by the contractor under this contract require mandatory review by the SSO and PM prior to public release authorization. Final Technical Reports must be sent to the SSO via approved shipping/handling methods at the address below.

10. Any SCI data released to or generated by the contractor in support of this contract remains the property of the DoD Department, agency, or command that released it. The contractor will maintain a record of all SCI released to contractor custody under this contract and upon completion/cancellation of the contract, and must return all such material to the SSO. This applies to all data and materials, including working papers and notes. SCI data furnished to or generated by the contractor will require special security handling and controls beyond those in the National Industrial Security Program Operating Manual (NISPOM).

11. Access to SCI is limited to that at U.S. Government locations identified under Item 8.a. or within a Government or Contractor approved SCI facility (SCIF) identified through an approved Memorandum of Agreement (MOA) or Co-Utilization Agreement (CUA). SCI level work may be approved at a contractor SCIF accredited by an agency other than DIA after CUA approval.

12. If this contract requires electronic processing of SCI, the PM must determine and request a SCIF requirement through the SSO in which Defense Intelligence Agency is the accrediting authority for AF sponsored SCIFs. Operational accreditation of AIS at the SCI level must be obtained through the ICD 503 A&A process.

13. This contract requires additional security requirements established for Sensitive Compartmented Information in accordance with DoDM 5105.21, Volumes 1, 2, and 3, Intelligence Community Directives (ICD); ICD 503, ICD 704, ICD 705, AFMAN 14-304 and AFMC Instructions or Supplements.
