RESPONSE TO INDUSTRY COMMENTS, DRAFT RFP FA8620-20-C-2001

1. Are you considering this effort for a small business set-aside, or any other designation?

a. Answer: This competition is Full and Open.

2. Will the Government please confirm that SETP membership with 10 years of experience is only required if a Test Pilot has not graduated from an SETP recognized TPS?

a. Answer: The Section L information was updated to better match the PWS requirements. The requirement is for a TPS Pilot who is either a graduate OR a SETP member with 10 years of experience.

3. A candidate may have LRE experience, but not be current/qualified. Will the Government accept candidates who have LRE experience but are not current/qualified?

a. Answer: Yes, the Government will accept candidates who were previously qualified, but has a goal of 60% being current and qualified starting the first flying day after the transition period

4. Will the Government allow the contractor to use contract-assigned assets to regain currencies or re-qualify aircrew?

a. Answer: Assuming the goal is met with LRE qualified minimums, the Government has accounted for the contractor use of Government assets to regain currencies or re-qualify aircrew.

Also noted in the PWS is contractor LRE qualifications will not be used to assess meeting PWS ground training hours per month requirements.

5. Request clarification on whether existing contractor-developed UAS Aircrew Training Materials, especially if there are any unique training programs, will be provided to the incoming contractor or if there will be a requirement to have our own training programs/materials on Contract Day 1.

a. Answer: Upon contract award and request, current training material will be provided to the contractor. The contractor would then be responsible for updates. There are no currently known unique training requirements planned for the start of the contract.

6. Request clarification on a minimum number of required résumés. Understand the established maximum number. Assumption is a minimum requirement for PM, Senior Pilot, Senior Operator, Test School Pilot, and FMM; but not certain.

a. Answer: Due to the non-binding aspect of résumés, the requirement has been removed from the Section L and M attachments.

7. Though not asked, it was recommended that we have a 60 day Transition as well as 60 day RFP to proposal submission.

a. Government response: The current RFP-to-Proposal timeline is estimated for 45 Days, which is greater than the original proposed 30 day. Due to the contract type, expected length and funding, a transition period longer than 30 days is not desired.

8. On December 17, 2018, President Trump signed into law the Small Business Runway Extension Act of

2018, which amends the Small Business Act to require that the size of a federal contractor be measured by an average of five years—rather than three years—of revenue for the purpose of determining small business program eligibility. As you may also know, the Act did not have a specific effective date. As such, it is our understanding that the Act is presumed to be effective immediately under longstanding principles of statutory interpretation. In this connection, we would greatly appreciate it if you would kindly confirm that we are to apply the five-year—rather than the three-year—lookback period for purposes of measuring size in connection with this specific procurement.

a. Answer: The changes have not been codified into our regulations, so we are still operating with the 3 year lookback period.
