52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of clause)
ADDENDUM TO 52.212-2 – EVALUATION—COMMERCIAL ITEMS
1. All proposals timely received will be evaluated in TWO (2) separate areas:
- Mission Capability/Technical
- Price
a. Initially, the Government shall evaluate the Mission Capability/Technical Proposals on a pass/fail basis. Each proposal will be assigned a rating of: Acceptable, Reasonably Susceptible of Being Made Acceptable, or Unacceptable. All technically acceptable proposals are considered equal and will not be assigned a technical ranking.
b. All technically acceptable proposals will then be ranked by evaluated price. Note: Unrealistically low proposals may be eliminated from competition and not considered for award.
c. The Government anticipates making award(s) without conducting discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined to be necessary by the Source Selection Authority.
d. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors (in the case of this acquisition, technical acceptability).
2. MISSION CAPABILITY/TECHNICAL:
a. A decision on the technical acceptability of each offeror’s Mission Capability Proposal shall be made. Each proposal will be assigned a rating of:
(1) Acceptable: The Mission Capability Proposal meets all the minimum mandatory Mission Capability Proposal requirements in the solicitation. Only those proposals determined acceptable, either initially or as a result of exchanges will be considered for award.
(2) Reasonably Susceptible of Being Made Acceptable: The Mission Capability Proposal does not meet some of the minimum mandatory Technical Proposal requirements in the solicitation; however, there is reason to believe that through exchanges an acceptable Mission Capability Proposal could result.
For award without discussions these proposals are considered “unacceptable”.
(3) Unacceptable: The Mission Capability Proposal substantially fails to meet the minimum mandatory Mission Capability Proposal requirements in the solicitation. Mission Capability Proposals with an unacceptable rating will not be considered for award.
b. Each offeror must show evidence of a capability to provide the mandatory requirements set forth in the Performance Work Statement (PWS) and elsewhere in this solicitation. A technical review team composed of key Government personnel will use their technical skills, knowledge and experience to thoroughly review the adequacy of the proposals.
In evaluating the Mission Capability Proposal, the Government will use the following evaluation criteria:
(1) Compliance with the requirements of the Performance Work Statement (PWS) and this entire solicitation.
(2) Understanding of the requirements of the Performance Work Statement (PWS) and this entire solicitation.
(3) Compliance and understanding of the requirements of the PWS as applied specifically to each factor/subfactor listed below.
c. The following specific factors and subfactors will be evaluated in the Mission Capability/Technical Proposal. Any factor or subfactor determined unacceptable will render the entire Mission Capability/Technical Proposal as unacceptable. Upon final determination that a proposal is unacceptable, the Contracting Officer (CO) shall promptly notify the firm submitting the proposal that it will not be considered for award and shall indicate in general terms the basis for the determination.
d. Mission Capability Evaluation Factors and Sub Factors are as follows:
FACTOR 1 – MISSION CAPABILITY:
Element 1-1: Offeror shall submit a plan or description of procedures followed to demonstrate knowledge of, and compliance with all applicable laws and regulations identified in the Performance Work Statement, and shall include copies of all applicable certifications, not limited to, transported EPA identification number(s) and employee confined space certifications.
An acceptable rating is met when the offeror plan or description of procedures demonstrates a working knowledge of and compliance with the laws and regulations identified in the PWS and includes all requested/applicable certifications.
Element 1-2: Offeror shall submit a plan for or description of the method of sample collecting, handling and analyzing.
An acceptable rating is met when a detailed, workable plan or description of the method of sample collecting, handling and analyzing is submitted.
FACTOR 2 – QUALITY CONTROL PLAN:
Element 2-1: Offeror shall submit a Quality Control Plan (QCP) that provides quality control procedures which demonstrates an adequate understanding of the Performance Work Statement (PWS) requirements. The QCP must be determined workable and acceptable with only minor clarifications.
An acceptable rating is met when the QCP demonstrates an effective performance/quality monitoring system that addresses all requirements of the PWS and will enable contractor to identify and correct their own errors/discrepancies.
Element 2-2: Offeror shall provide a description of the duties and responsibilities of the quality control inspectors.
An acceptable rating is met when the duties and responsibilites of quality control inspectors are adequate to enable contractor to maintain an efficient quality program.
Element 2-3: The proposal shall specify the roles/functions of other key personnel involved with quality control.
An acceptable rating is met when the roles/functions of other key personnel are adequate to enable contractor to maintain an efficient quality program.
FACTOR 3 – SCHEDULING METHODOLOGIES:
Element 3-1: The proposal shall include a work schedule to cover all requirments described in the Performance Work Statement (PWS), to include the Work Load Data.
An acceptable rating is met when a workable schedule is submitted that demonstrates an understanding of the work outlined in the PWS and Work Load Data.
