MEMORANDUM FOR AFSC/PZIO OL-Robins 10 May 2018

SUBJECT: Sole Source Justification
1. This letter justifies why the company listed below is the only known source that can satisfy the requirements of this acquisition.
Relativity, Inc 700 Southwest Dr Jonesboro, AR 72401

3. Description of the item(s) to be purchased:
The contractor, Relativity, Inc, of Jonesboro, AR, shall provide requested phone and/or on-site technical support for Relativity Records Manager software currently installed at Robins AFB.
Support shall include:
a. Phone support five days a week, Monday thru Friday, 0800 to 1800 EST with response within 8 clock hours of contact.
b. On-site support if required, Monday thru Friday, 0800 to 1800 EST with response within 48 clock hours of contact.
c. Support also includes routine and minor software upgrades/fixes as required for continued operation.
4. Justification: In accordance with 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One or a Limited Number of Responsible Sources, and No Other Supplies or Services Will Satisfy Agency Requirements, I certify that the proposed source, Relativity, Inc, which is also the original supplier of the software, is the only known source that can satisfy the government’s requirement. This is proprietary, vendor owned software and the government only owns licenses to use the software and Robins AFB is the only DoD site using this software. Therefore the DOD Enterprise Software Initiative (ESI) is not applicable to this acquisition. Market research indicates no other vendors have legal data rights to the source code required to maintain/support the software.
This requirement will be publicized in the Federal
Business Opportunities (FedBizOpps) citing conditions, which preclude F&OC. All interested sources will be evaluated to determine if they are or can be qualified.
5. In an effort to remove or overcome such a barrier to competition in the future, the market will be scanned frequently for new companies that could satisfy the government’s requirements.
Where possible, the government will make future requirement descriptions suitable for full and open competition.
