52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
This acquisition is being conducted under FAR 12.2. The Government is not obligated to determine a competitive range, conduct discussions with offerors, or solicit final proposal revisions. The Government contemplates an award to the lowest Total Evaluated Price that meets the Special Standard of Responsibility. Based on previous history, the Government has provided estimated usages for the basic plus 9 (nine) option periods found in attachment 1 (Rate Schedules) of the Exhibit/Attachment section of the RFP. These estimates are strictly used to calculate the Total Evaluated Price (TEP). The Government is in no way obligated to order these amounts after contract award.
IAW FAR 9.104-2, there is one Special Standard of Responsibility (SSR) required by this RFP. Offerors must provide a current certificate or proof that they are an authorized marketer and can provide natural gas through Atlanta Gas Light (AGL) owned pipeline leading onto Robins AFB, GA or the City of Warner Robins which owns a separate pipeline leading onto Robins AFB, GA.
Each offeror shall propose pricing utilizing the tables found in attachment 1 (Rate schedules) of the Exhibit/Attachment section of the RFP. The Government shall use the sum of the dollars per year found on the rate schedules (base year plus 9 (nine) options) to calculate the TEP.
The Government intends to award without discussions, but reserves the right to conduct discussions if determined necessary. Any discussions will be conducted in accordance with FAR 15.306. The Government reserves the right to make a selection based upon initial submissions, so Offertory should submit their best terms in the initial proposal. The Government also reserves the right to make no award.
Any contractor (and/or subcontractor) having a conflict of interest as defined under FAR Part 9.5 must identify the conflict as soon as it is known and provide a recommended mitigation plan. Mitigation plans are required whenever a competing contractor has had unequal access to non-public information regarding the Task Order requirement, or has assisted the Government in defining the Task Order requirements or evaluation criteria.
Each offeror’s proposal shall consist of the completed and signed RFP with a cover letter delineating any exceptions taken to the RFP terms and conditions. However, offerors are cautioned that any noncompliance with the terms and conditions of the RFP may cause their proposal to be determined unacceptable. Offerors shall also ensure that all clauses and provisions that require “fill-in” information are appropriately completed, including the proposed Rate schedule tables attached to the RFP and if the offeror is an authorized AGL marketer the proposal shall include a current certificate or proof that they are an authorized marketer. Joint Ventures (JV) may submit a proposal to this solicitation if the conditions at FAR 19.1403 and 13 CFR 125.15 are met. Joint Ventures shall include the joint venture agreement with their proposal.
All offerors shall meet the Special Standard of Responsibility (SSR) identified in this section. Offerors shall thoroughly examine all RFP documents and instructions. Failure to do so will be at the Offeror’s own risk. The Government shall not pay any Offeror for any cost or expenses associated with the preparation of their proposal.
The offeror's cost/price proposal will be evaluated for reasonableness, balance and a total evaluated price will be calculated in accordance with the following:
(i) Reasonableness: The existence of adequate price competition is expected to support a determination of reasonableness. In addition, price analysis techniques may be used to further validate price reasonableness. If adequate competition is not obtained or if price reasonableness cannot be determined using price analysis, other techniques described in FAR 15.4 will be used.
(ii) Balanced Pricing: Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items (including Basic and Option Years) is significantly overstated or understated as indicated by the application of analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or sub-line items. Prices will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror’s response to the pricing structure in Section B. Offers that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.
(iii) Total Evaluated Price will be calculated as follows: The sum of all the CLINs evaluated prices (Basic Year and all Options) as calculated on the Exhibit “A” Rate Schedule will represent the total evaluated price. The evaluation of options shall not obligate the Government to exercise such options.
TOTAL EVALUATED PRICE (Base plus nine option years): $ .
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
