17.11.1 & 7.13.1Payment of OvertimeThe government states: PWS 7.11.1 “When the contractor aligns with the Government’s “5-4-9” schedule (i.e., 1st week: 4 days of 9-hour days and Friday 8-hour day; 2nd week: 4 days of 9-hour days), the contractor shall not charge overtime for the 4 hours in the 1st week exceeding 40 hours, as the next week will be a 36-hour work week thus totaling 80 hours for the two weeks.” However, PWS 7.13.1 “In the event of a guidance conflict, the contractor shall follow the most stringent requirement.” Given under the SCA and Department of Labor requires the payment of overtime within a 7 day period, please clarify under what authority will we NOT pay the employees overtime?Non-SenstivePWS Paragraph 7.11.1 was updated to clarify the Governments intent in regards to work schedule.

Additionally please note, that PWS Paragraph 7.13.1, "In the event of a guidance conflict, the contractor shall follow the most stringent requirement” is in reference to Environmental Compliance and Regulations.

2Table 3.0, Services SummaryLine 1- Contract Performance " . . . is acceptable if there are no more than three validated customer complaints per for timeliness, quality and safety within the task order period of performance." Unless the period of performance for individual task orders is a few months, the performance threshold of 3 complaints for the entire task order seems to exceed industry standard for performance for contractors.Question - will the Government please clarify that contractors and their employees are held to the same performance objectives and thresholds as Government employees? Please confirm that Government workforce and contractor augmentee workforce are subject to same standards of workmanship.Non-SenstiveThe Government intends to tailor performance criteria to the individual task order as stated in Paragraph 3.0 of the PWS. The Government is not required to hold contractors to the same performance thresholds to which Government employees are held.
3Cross Reference MatrixPWS Paragraph: 8.3In the Cross Reference Matrix, paragraph 8.3 of the PWS is referenced. However, paragraph 8.3 of the PWS does not exist. Will the Government please clarify?Non-SenstiveThe Cross Reference Matrix in Section L was corrected to remove the reference to Paragraph 8.3 of the PWS. The Government additionally removed reference to PWS Paragraph 8.2.

1SCA Rate Health and Welfare Hourly RateThe TEP workbook dated 20 Dec 17 indicates in the blue column identified as Minimum SCA Rate Health and Welfare Hourly Rate the amount of $4.13. However all WD have the current amount of $4.41. Per the instructions, we are not to change the blue field but insert our amounts in the green fields. Is it intent of the government for us to insert in the green column the correct amount or use the incorrect amount?Non-SenstiveDue to this contract being covered by Executive Order 13706, the H&W rate is correctly stated as $4.13. Per Department of Labor All Agency Memorandum #25 dated July 25, 2017 " EO 13706 applies to new contracts with the federal government that result from solicitations issued on or after January 1, 2017 (or that are awarded outside the solicitation process on or after January 1, 2017)." As such "Employer contributions that are made to satisfy the employer's obligations under EO 13706 may not be credited toward the contractor's obligations under the SCA. To comply with EO 13706, an alternate health and welfare rate has been established that excludes the sick leave portion of the calculated health and welfare rate... The SCA health and welfare fringe benefits level for employees performing on contracts covered by EO 13706 will be $4.13 for each hour performing work on such a contract..." 2FE Warren Location - SCA RatesPlease clarify – FE Warren price sheet dated 20 Dec - we noticed the base hourly rate for Metrology Tech I & II in the WD as 24.72 and 29.83 however the posted TEP workbook shows Metrology Tech I as 29.83 and Meteorology Tech II as 25.85. Are we cleared to change the incorrect wage amount to the correct wage amount?Non-SenstiveThe FE Warren Price Sheet has been updated to reflect the correct labor rates for Metrology Tech I & II.

The SCA Rates were provided for your convienence. It is the contractor's responsibility to ensure the contractor is bidding no lower than the actual DOL SCA Rate.

45.3.2.1 Provide Qualified PersonnelThe offeror shall provide an approach for obtaining and retaining qualified personnel, and a plan for how this process will accomplish the Minimum Team Complement (MTC) requirements. As a minimum, the process shall include a detailed description of recruitment, hiring, turnover and downsizing processes, in both relocation and surge conditions IAW PWS Paragraph 2.4.1. The process shall also describe personnel qualifications and certification processes, and retention policies IAW PWS Paragraph(s) 2.2.1, 7.2 to 7.2.2.1.However, PWS paragraph 2.2.1 identifies Firm Fixed Price Minimum Team Complement (FFP MTC), 7.2 to 7.2.2.1 identifies Contractor Identification Badges, DBIDS Cards, Approved DBIDS Cards, Common Access Cards (CAC) and CAC Issuance. There seems to be a disconnect between the proposal preparation requirement (Section L) and the evaluation criteria (Section M) for this subfactor.What is the government’s expectation as to the required contents of the proposal in addressing the requirement for Volume II – Technical, Subfactor 2 Resource Management Plan, Provide Qualified Personnel (Section L-5.3.2.1 & M-4.3.1)?Non-SensitivePWS Paragraph 2.0 has been updated to clarify the Government's intentions.

3DOCAT4 RFP Volume II – Technical, Subfactor 3 Quality Management Plan Section L-5.3.3 & corresponding Section M-4.4 Quality Management PlanL-5.3.3 requires “The offeror shall provide a plan for Quality Management describing the methodology by which the offeror shall ensure quality effectiveness and comprehensive management; a process to identify, track, report on, and analyze quality issues, and trends; and a strategy to identify and resolve deficiencies, identify potential improvements, maintain inspection documentation, and make quality control inspections and corrective actions available to the Government. The Quality Management Plan shall address all requirements IAW PWS Paragraphs 5.1 and 5.1.1.” M-4.4 evaluates the L-5.3.3 requirement with “This subfactor is technically acceptable when the offeror provides a level of detail of a clear methodology which clearly demonstrates and substantiates how the offeror will adequately and effectively manage and supervise its workforce and provide a quality standard reporting and deficiency resolution plan IAW PWS Paragraph(s) 5.1 and 5.1.1.” L-5.3.3 and PWS paragraphs 5.1 and 5.1.1 make no mention of managing and supervising the workforce.
