“16.202 Firm-fixed-price contracts.
16.202-1 Description.
A firm-fixed-price contract provides for a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. This contract type places upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. It provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties”.
The Firm-Fixed-Price contract agreement is bi-lateral. Both the Govt and the Contractor is bound by the terms of the FAR’s definition of FFP. Per the FFP definition the Contractor does not have the right to request for relief for “cost experience in performing the contract” regardless if profit is lost or not - nor does the Govt have the legal right to provide such relief per the FAR and the Dispute clause (52.233-1) in the RFP/contract; thus, if such request is received it should be rejected per the Dispute clause. If the Contractor fails to perform and meet the terms of the FFP contract default procedures should start immediately per the Dispute clause.
