INSTRUCTION TO OFFERORS
This note/section provides a tailored streamlined set of “Instructions to Offerors” in accordance with (IAW) FAR 12.301(b)(1) and clause 52.212-1 – Instructions to Offerors – Commercial Products and Commercial Services.
1. Combined Synopsis/Solicitation This solicitation is being issued as a combined synopsis/solicitation IAW FAR 12.603 procedures.
Clause 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services, applies to this acquisition.
Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Products and Commercial Services, applies to this acquisition.
Offerors shall include a completed copy of the provision at 52.213-3, Offeror Representations and Certifications-Commercial Products and Services, with its offer.
2. Bid & Proposal Costs This solicitation does not commit the Government to contract for any supply or service whatsoever.
Respondents are advised that the Government will not pay for any information or administrative costs incurred in response to this solicitation. All costs, such as bid and proposal, associated with preparing, submitting and supporting bids and proposals on this solicitation will be solely at the responding party’s expense. The Government reserves the right to cancel this solicitation, either before or after the proposal closing date. In the event the Government cancels this solicitation or determines not to award a contract, the Government has no obligation to reimburse an offeror for any bid and proposal (B&P) costs and/or any other costs incurred.
3. NAICS Code IAW SF 1449, front page
4. Submission of Offers IAW solicitation (SF 1449) and this note/section
5. Period of Acceptance of Offers IAW solicitation (SF 1449)
6. Multiple Offers Multiple offers will not be accepted
7. Multiple Awards The Government intends to award one (1) contract based on "All or None". The Government will not consider any offers for less than the quantity offered.
8. Contract Award The Government intends to evaluate offers and award a contract without discussions with offerors.
Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and delivery standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. In the event discussions are held, offeror responses to those notices will be considered in the evaluation.
9. Evaluation Criteria for Award For purposes of award, offers will be evaluated based on the lowest Total Evaluated Price (TEP). The "Unit Price" for the "Production" CLIN will be evaluated as the TEP. Note, this DOES NOT include the extended price (i.e. unit price x quantity) - only the "Unit Price" for the "Production" CLIN. This is necessary to ensure integrity, balance and fairness in the competition considering some offerors may be required to complete a "First Article" and other offerors may have a "First Article" waiver approved. this process will neither penalize or favor a proposal based on whether a "First Article" is required or waived because ALL offers are required to complete the "Production" CLIN requirement.
Therefore, the lowest "Unit Price" for the "Production" CLIN is determined to represent the best value to the Government. An example of the TEP evaluation is provided below for reference.
CLIN DESCRIPTION PROPOSED "UNIT PRICE"
0001 NSN 1650016428153LE $ N/A
0001AA First Article $ N/A 0001AB Production Article(s) $ (unit price only) 0002 CDRL - FA Test Report $ N/A
TOTAL EVALUATED PRICE (TEP) $
10. Consideration for Award
a. Engineering Source Approval / Approved Sources This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Therefore, to be considered for award an offeror will be required to be listed as an approved source. A list of Small Business approved source(s) are provided below.
Note: this requirement is a Total Small Business Set-Aside.
Approved Source Cage Code Transaero, Inc. 27541 Bemsco, Inc. 29560 Thomas Instrument, Inc. 5H860 or 50LP4 Machine Specialties LLC 1DDX0 Nassau Tool Works, Inc 2M490
Alternate sources shall refer to the attached "Manufacturing Qualification Requirements (MQR)" for procedures that must be satisfied to become an approved source for this requirement.
Award of the subject solicitation MAY NOT BE DELAYED due to alternate source notifying the appropriate Government contracting office of intent to qualify as an approved source for this requirement.
b. Quality Assurance Compliance Offers shall submit documentation (i.e. certification) that demonstrates they have the capability to comply with the quality assurance standard(s) IAW the solicitation (individual line-item schedule), which are provided below. The Government reserves the right to determine whether offers’ proposed “equivalent” quality certification is acceptable. Failure to submit this documentation or an unacceptable “equivalent” certification may result in the offer’s quote considered non-responsive (i.e. not eligible for award).
CLIN Quality Assurance (Title / Number) 0001AA AS9100 is required, but equivalent is acceptable 0001AB AS9100 is required, but equivalent is acceptable
11. Priority of Basic Award (MICAP) In the event the priority of the basic award and/or option(s) is upgraded to a MICAP post-award, the Government may require the delivery schedule to be expedited. The expedited delivery schedule and any resulting price increase will be negotiated and established via a bi-lateral contract modification.
DCMA RESPONSIBILITY & ROLES
