Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

Department of the United States Air Force

II. Nature and/or description of the action being processed.

This individual Justification and Approval (J&A) authorizes the use of a new contract using other than full and open competition procedures to procure: Sixteen (16) each MetaVR VRSG v6.3 Software Maintenance.

The resulting new contract will be a Commercial, Firm-Fixed Price, sole source, requirements type, negotiated action for a commodity.

III. Description of supplies/services required to meet agency needs.

76 SMXG/555 SMXS is requesting the purchase of Sixteen (16) Virtual Reality Scene Generator (VRSG) software licenses for use on the T-1A Combat Systems Officer Training debrief computers. This is required to ensure that the visual simulation software can be updated to match the rest of the training programs visual software used in the aircraft.

IV. Statutory authority permitting Other than Full and Open Competition.

The authority for this action is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 when the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, and full and open competition is therefore precluded. The application pursuant to FAR 6.302-1(b)(1) & (2). In accordance with FAR 6.304(a)(1), the approval level for this J&A is the Contracting Officer and their certification will serve as approval unless a higher approving level is established in agency procedures.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

MetaVR is the sole owner of the rights to source code and licensing for VRSG. The VRSG program is currently in use in two other phases of CSO training and the new requirement for the sensor simulation capability requires the T-1A Mod to match the rest of the training phases. The debrief computers must have their version upgraded to match the version that is being added to the modified aircraft to meet this new requirement.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

In accordance with (IAW) FAR 10.001, Market Research was performed to see if any vendor was capable of providing this requirement. The result of the market research showed only one vendor capable of providing this requirement. That company is MetaVR. Additionally, IAW 5.201, this requirement shall be synopsized and the request for proposal posted on FBO.gov.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to both the Government and the Contractor. This will be a commercial contract so Certified Cost and Pricing Data cannot be requested, however, Other than Certified Cost and Pricing Data and historical pricing will be used for comparison purposes. Price reasonableness will be determined using price analysis IAW FAR 13.106-3 and supported by a technical evaluation and analysis by the Subject Matter Expert.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was performed reviewing Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code 511210 looking for companies that could MetaVR software Licenses. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide MetaVR software Licenses. In review only one source has the capabilities, technology, and expertise to fulfill this requirement.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

MetaVR is the sole owner and provider, there is no other program that sufficiently replaces what MetaVR's VRSG can do or integrate with the existing systems.

The Government will continue to search the market in the future to see if other vendors can provide these products.
