Subject to the terms and conditions stated herein, the Contractor agrees to hold its offered prices firm for 120 days.

Qualification Requirements apply: To be eligible for contract award, the offeror must be an approved source, in accordance with clause, Qualification Requirements. The Government is NOT required to delay contract award to review pending source Approval Request (SAR).

Therefore, offerors are encouraged to submit SARs AS SOON AS POSSIBLE. If the Government has not completed review of a SAR when the contract is awarded, the SAR will be retained and the source will be reviewed for possible source approval for future awards.

This RFQ replaces RFP FA8122-15-R-0008 in its entirety.

Request for Quotation FA8122-15-Q-0009

SUPPLIES OR SERVICES AND PRICES/COSTS

This is a Firm Fixed Price, Indefinite Delivery Requirements contract to provide overhaul services for the F108 Compressor Inlet Temperature (CIT) Sensor. The contract period is for 5 years consisting of a one year basic contract period and 4 one-year options. The contractor shall furnish all plant, labor, material and equipment necessary to accomplish the services, packing, packaging, preparation for storage, marking and shipments. All effort shall be in accordance with the attachments and other directives for the F108 CIT sensor as specified in the performance work statement.

The F108 CIT Sensor is listed as an Item Unique Identifier(IUID) candidate by the Government Program Manager. The Government shall make the final decision as to the applicability of the IUID requirement as outlined in DFARS 252.211-7003 as it pertains to this contract. When required marking is implemented, the program manager will engage in engineering discussions with the contractor on HUMAN and MACHINE READABLE 2D MATRIX MARKING; will identify funding; and will request the contractor include IUID pricing in a proposal. Contractor shall only be required to IUID mark this part if the government and contractor have agreed upon the IUID pricing.

The Government reserves the right to adjust the Latest Cost Amount as reflected in this document either upward or downward at any time prior to and after contract award. Should the requirement for adjustment occur after award of the contract, the ACO/PCO will issue a unilateral modification to reflect the current Cost Amount. The adjustment is not subject to negotiation.

Fast Transportation is ONLY authorized IF the Contracting Officer, by written authorization through the ACO, authorizes Fast Transportation.

Condemnation will not count towards production.

(d) Comptroller General Examination of Record. (2) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System);

(d) Even though a product or service subject to a qualification requirement is not itself an end item under this contract, the product, manufacturer, or source must nevertheless be qualified at the time of award of this contract. This is necessary whether the Contractor or a subcontractor will ultimately provide the product or service in question. If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate this contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the Government's best interests.

(e) If an offeror, manufacturer, source, product, or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government's interest, award of this contract shall not be delayed to permit an offeror to submit evidence of qualification.

(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification. The reevaluation must be accomplished before the date of award.

(a) The Government may extend the term of this contract by written notice to the Contractor within 1 day ; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months if all options are exercised .

252.217-7028 OVER AND ABOVE WORK (DEC 1991)

(IAW DFARS 217.7702)

(a) Definitions.

As used in this clause--

(1) "Over and above work" means work discovered during the course of performing overhaul, maintenance, and repair efforts that is--

(i) Within the general scope of the contract;

(ii) Not covered by the line item(s) for the basic work under the contract; and

(iii) Necessary in order to satisfactorily complete the contract.

(2) "Work request" means a document prepared by the Contractor which describes over and above work being proposed.

(b) The Contractor and Administrative Contracting Officer shall mutually agree to procedures for Government administration and Contractor performance of over and above work requests. If the parties cannot agree upon the procedures, the Administrative Contracting Officer has the unilateral right to direct the over and above work procedures to be followed. These procedures shall, as a minimum, cover--

(1) The format, content, and submission of work requests by the Contractor. Work requests shall contain data on the type of discrepancy disclosed, the specific location of the discrepancy, and the estimated labor hours and material required to correct the discrepancy. Data shall be sufficient to satisfy contract requirements and obtain the authorization of the Contracting Officer to perform the proposed work;

(2) Government review, verification, and authorization of the work; and

(3) Proposal pricing, submission, negotiation, and definitization.

(c) Upon discovery of the need for over and above work, the Contractor shall prepare and furnish to the Government a work request in accordance with the agreed-to procedures.

(d) The Government shall--

(1) Promptly review the work request;

(2) Verify that the proposed work is required and not covered under the basic contract line item(s);

(3) Verify that the proposed corrective action is appropriate; and

(4) Authorize over and above work as necessary.

(e) The Contractor shall promptly submit to the Contracting Officer, a proposal for the over and above work. The Government and Contractor will then negotiate a settlement for the over and above work. Contract modifications will be executed to definitize all over and above work.

(f) Failure to agree on the price of over and above work shall be a dispute within the meaning of the Disputes clause of this contract.

This clause supplements the Federal Acquisition Regulation 52.219-9, Small Business Subcontracting Plan, clause of this contract.

(a) Definitions.

"Historically black colleges and universities," as used in this clause, means institutions determined by the Secretary of Education to meet the requirements of 34 CFR Section 608.2. The term also means any nonprofit research institution that was an integral part of such a college or university before November 14, 1986.

"Minority institutions," as used in this clause, means institutions meeting the requirements of Section 1046(3) of the Higher Education Act of 1965 (20 U.S.C. 1135d-5(3)). The term also include Hispanic-serving institutions as defined in Section 316(b)(1) of such Act (20 U.S.C. 1059c(b)(1)).

“Summary Subcontract Report (SSR) Coordinator,” means the individual who is registered in eSRS at the Department of Defense (9700).
