Contractor Questions with Government Responses
Subject: FA8121-21-R-0002, 229 Combustion Chamber Date: 19 April 2021
Question: Warranty – are there terms and conditions which specify this?
Answer: Please refer to paragraph 1.1.1.2 of the Statement of Work (SOW) for this information.
Question: Delay penalties – what are the conditions if we delivery later than turn-around-time we stated? Are there mechanisms whereby we can envisage a small bonus based on respecting the delivery time?
Answer: The penalty for delay would be a negative rating on CPARs for this effort. The government will not offer an incentive for early delivery times.
Question: The supply chain for the current 229 Combustion Chamber contract, FA8121-16-D-0002, allows the use of FEDMALL. For the upcoming contract, currently in acquisition, FEDMALL is no longer an option and competitors are required to rely on the open market for the supply chain, including OEM supplied parts. There is a potential of high mark-up costs from the OEM. Will the government amend the solicitation to allow either FEDMALL use or provide GFM to the competitors?
Answer: No, Use of FEDMALL will not be allowed and parts will not be provided as GFM.
Question: Price of parts – missing pricelist of OEM: the OEM has not released an official pricelist yet. How/what can we add to our bid that will allow us to be sure that the new prices from the OEM will be taken into account and we will not be forced to honor a quote made on old/obsolete prices? Something that will allows us to change the price of the repair because of cost of detail parts change.
Answer: Offerors are encouraged to submit all pricing for all years in order to be considered for contract award.
Question: The list of FMS countries is pretty long: how/what can we put in our bid/response that we are obliged to comply with export rule set our national/regional government? Also said, any USAF chamber it’s not a problem. But if any of the FMS countries for a political reason or another ends up on a no-export list… what can we do about it?
Answer: If the contractor vs. FMS country issue is to arise where the contractor or FMS country are unable to meet the clauses outlined in the contract, the USAF production will continue. If this issue is identified by the FMS country, the country will not be obligated to use this contract vehicle. If this issue is identified by the contractor, the statement and supporting justification will need to be submitted at the time of proposal.
Question: As a foreign company, are we exempt from submittal of a Small Business Subcontracting Plan with the proposal?
Answer: Per FAR Part 19.702(a)(ii)(b) Subcontracting plans (see paragraphs (a)(1) and (2) of this section) are not required–
(1) From small business concerns;
(2) For personal services contracts;
(3) For contracts or contract modifications that will be performed entirely outside of the United States and its outlying areas; or
(4) For modifications that are within the scope of the contract and the contract does not contain the clause at 52.219-8, Utilization of Small Business Concerns.
