III. Description of supplies/services required to meet agency needs

The work encompasses the functional test, disassembly, cleaning, inspection, maintenance, re‐assembly, testing, and finishing actions required to return the end item to a serviceable condition. If any component part does not meet inspection requirements as specified in the applicable technical documents, or if there is any doubt as to its serviceability or longevity, the Contractor shall replace the component if it cannot be restored to the original life expectancy, or nearly so. The Contractor is advised to include the cost of replacing a percentage of re‐usable and recoverable components, as identified above, in their overhaul cost proposal.

Dollar values listed below reflect the anticipated total contract cost. Under the contemplated contract, Honeywell will provide the overhaul of the E‐3/E‐8 electro mechanical actuator as described below.

PR Line Item 0003 Data Not Separately Priced (NSP) Delivery IAW DD Form(s) 1423 Contract Data Requirements List(s)

Due to the circumstances described below in Sections V, IX and XI, there are no immediate actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year. If other qualified or approved sources become known at any time during the life of this contract, any remaining options will not be exercised and this J&A will not be utilized to exercise remaining options.

IV. Statutory authority permitting Other than Full and Open Competition.

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302‐1 (a)(2)(ii).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Honeywell is the designer and actual manufacturer of the item described in section III, and is the only known source that has the necessary overhaul data, process data, parts, expertise, special tooling, and special test equipment needed to overhaul this item.

Development of additional sources to overhaul this item is not feasible within allowable timeframes. This PR package is a follow‐ on effort for a highly specialized service. Honeywell is currently overhauling this item on the contract identified in Section II.

The 423 Supply Chain Management Squadron (SCMS) has determined through analysis that Honeywell is the only firm capable of providing the overhaul effort described in Section III above without the Government experiencing substantial duplication of cost that is not expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

On 31 Mar 17, a Sources Sought Synopsis for this requirement was posted on the Federal Business Opportunities (FedBizOpps) website for 15 calendar days. The SSS was posted under FD2030‐17‐01862. As of 17 Apr 17, one company expressed interest in overhaul of this electro mechanical actuator. However, the Government is not aware of the OEM approving any additional sources at this time. See section X for additional company information.

IAW FAR 5.201, this requirement shall be synopsized and the Request for Proposal (RFP) will be posted to the Federal Business Opportunities website. Consideration shall be given to potential sources prior to award. Government defined pre‐award qualifications of new sources cannot be identified due to the unavailability of the necessary technical data as described in Section V. The OEM is the only entity capable of approving additional sources at this time.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide other than certified cost and pricing data. A detailed cost analysis may be performed and price analysis will be accomplished. The Defense Contracting Management Agency and/or Defense Contract Audit Agency may be contacted to assist with the analysis and may assist with inputs throughout the life of the contract.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

IAW FAR Part 10.001(a)(2), market research that began on 31 Mar 17 and concluded on 14 Aug 17 has revealed that there are currently no other companies with the ability to overhaul these assets. Market research included the sources sought synopsis described in Section VI and inquiries into internet sites including Google, the Thomas Register, Haystack, and similar item manufacturer’s websites. Searches included part number, name, and like items. Other sources overhaul similar items but none have been identified as having access to the data necessary to meet the requirement described in Section III. Market research did not yield any additional sources for the overhaul of this item.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Reverse engineering is not feasible within allowable timeframes. Any effort to reverse engineer the overhaul process would take a minimum of 5 years from the initiation of a Consolidated Sustainment Activity Group Sustaining Engineering project. This timeframe includes the budget request period, Purchase Request processing, contract negotiation and award, period of performance, qualification testing of the reverse engineered process, and source qualification of overhaul sources. Additionally, the necessary use rights would need to be negotiated with Honeywell to utilize the available proprietary technical data in the government’s possession to support the reverse engineering project. A cost estimate to complete this project has not been generated due to the unknown nature of some of the project’s elements such as securing government use rights to the technical data and the scope of qualification testing required to ensure OSS&E (Operational Safety, Suitability, and Effectiveness).

X. List of sources, if any, that expressed interest in the acquisition.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

In an effort to identify and remove barriers to competition, the 423 SCMS will continue to monitor the marketplace for overhaul source development, and will continue discussions with the OEM regarding additional approved overhaul sources.

The Government will continue to synopsize the requirement, rescreen the item, and attempt to acquire the data necessary to qualify additional sources.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
