Addendum to 52.212-1 -- Instructions to Offerors -- Commercial Items (Jun 2008)
(m) Additional Information. The offeror’s proposal shall be clear, concise, and include sufficient detail and description for effective evaluation and for substantiating the validity of stated claims. The offeror shall not merely reiterate the objectives or reformulate the requirements specified in the solicitation. Offerors shall assume that the Government has no prior knowledge of their facilities, capabilities, or experience, and will base its evaluation on the information presented in the offeror’s proposal. By proposal submission, the offeror is representing that its firm will perform all the requirements specified.
(n) Proposal Volumes. The proposal volumes should not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet those requirements.
(1) Volume I – Executive Summary. The Offeror shall submit a cover letter, executive summary, table of contents, and any applicable attachments (for example, completed 52.212-3) in this volume. This volume shall not be evaluated and is included for informational purposes only.
(2) Volume II – Technical Proposal. Each offeror is required to submit a proposal volume that addresses how all of the requirements of the Performance Work Statement (PWS) are to be accomplished. The proposal must be specific and complete.
(3) Volume III – Price Proposal. Offerors must propose Firm-Fixed-Price (FFP) burdened rates in the attached Pricing Table spreadsheet. No other spreadsheet will be accepted. The rates shall include wages, materials, indirect costs, general administrative expense(s), and profit (fully burdened to cover all expenses) for all of the line items for the base period and each of the four option years.
(o) Organization/Number of Copies/Page Limits. The offeror shall prepare the proposal as set forth in Proposal Organization Table (Table 1 below). The titles and contents shall be defined as spelled out in Table 1 and all of which shall be within the required page limits as set forth in the table. The page limits include any incorporated indices, appendices, and attachments unless otherwise stated. Text of the proposals shall be submitted in English. Any proposal received in other language other than English will be grounds for rejection. Page limitations shall be treated as maximums. If exceeded, the excess pages will not be read or considered in the evaluation of the offeror’s proposal. A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Page size shall be 8.5 x 11 inches and page line spacing shall be 1.5 lines. The text size shall be no less than Arial 12 points.

52.212-2 -- Evaluation -- Commercial Items (Jan 1999)
(a) Basis for Contract Award. This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with Federal Acquisition Regulation (FAR) 15.101-2, as supplemented. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the technically acceptable offeror with the lowest evaluated cost or price and whose proposal conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by 52.212-1 of this solicitation. The Government reserves the right to award without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.
(b) Number of Contracts to be Awarded. The Government intends to select one contractor for the Missile Tech Order Support (MTOS) services program. However, the Government reserves the right to award no contract at all, depending on the quality of the proposals and prices submitted and the availability of funds.
(c) Rejection of Unrealistic Offers. The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low in cost/price when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.
(d) Correction Potential of Proposals. The Government will consider, throughout the evaluation, the "correction potential" of any proposal uncertainty. The judgment of such "correction potential" is within the sole discretion of the Government. If an aspect of an offeror's proposal not meeting the Government's requirements is not considered correctable or if the amount of corrections needed to meet Government requirements is impractical, the offeror may be eliminated from the competitive range.
(e) List of Evaluation Factors. The following factors shall be used to evaluate offers:
(1) Technical
(2) Price
(f) Evaluation Methodology. Technical acceptability will be evaluated on all offers. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. Next, price will be evaluated for all proposals. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards for the non-cost factor, Technical. The methodology for proposal evaluation for this acquisition is as follows:
(1) Technical Evaluation. Each proposal will be evaluated for technical acceptability. The offeror will be evaluated for compliance with the PWS. To be rated technically acceptable, the offeror’s approach must ensure all requirements of the PWS are met.
The technical proposal evaluation will determine one of the ratings below:
(i) Acceptable – The proposal meets specified minimum requirements necessary for acceptable contract performance.
(ii) Unacceptable – The proposal fails to meet specified minimum requirements necessary for contract performance. Proposals with an unacceptable rating are not awardable.
(2) Price Evaluation. The offeror’s price proposal will be evaluated for award purposes by adding the total price for basic requirements (basic award) and all options. The government may determine that an offer is unacceptable if option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(i) Total Evaluated Price. Price analysis will be performed to determine the reasonableness of the offeror’s price proposal. Reasonableness will be based on the total evaluated price. The total evaluated price will be calculated as the sum of the Contract Line Item Numbers (CLINs) as defined in Atch 3, Pricing Tables and Instructions .
(ii) Unrealistically Low Costs or Prices. Unrealistically low proposed costs or prices, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or the offeror has made an unrealistic proposal.
(iii) Unbalanced Pricing. Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items. Offers that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
(3) It is the Government’s intent to award without discussions, therefore, it is imperative that offerors submit their best terms initially. However, if during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs), and the Final Proposal Revisions (FPRs) will be considered in making the source selection decision. If a Request for FPR is issued, offeror responses to ENs must be included in the FPR in order to be considered for award.
(4) Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or sub-factors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
