17 November 2015 Questions and Answers (3)
1. Question 6.d from Amendment 2 Q&A asked the following.
RFP Attachment 4, Labor Category Rates.
(d) Since the task orders are CPFF and not FP or T&M, and the Government is allowing adjustment in the rates each year based on approved billing rates in the applicable year, would the Government consider deletion of Attachment 4? The requirement in RFP 4.2, Section 2, to provide supporting data for proposed indirect rates should fulfill the Attachment 4 requirement, as well as the completion of the Cost Summary schedules. Fully loaded labor rates are typical in an IDIQ when FP and T&M task orders are used.
The Government’s answer was:
Response: Verbiage regarding adjustment of approved billing rates deleted. Please see revised RFP.
Amendment 2 shows the track changes to RFP Part I Section H Special Contract Requirements. However, under H-2. Task Orders (c) the verbiage regarding adjustment of approved billing rates is still there.
… “Proposals shall be priced on a Cost-Plus-Fixed-Fee (CPFF) basis, as specified by the Government using rates listed in Section J, Attachment 4, Labor Category Rates for Task Orders. These rates may be revised once each fiscal year to adjust, if necessary, the rates for the following fiscal year, in accordance with FAR 52.216-7 (e), and the contract modified accordingly. Proposed rate changes will be based on DCAA approved billing rates or, if applicable, the most recent Forward Pricing Rate Agreement (FPRA)”
With Amendment 2 the Government added item (e) to H-2. Task Orders.
(e) Negotiated rate will be incorporated in Attachment 4 to the contract at the time of award. Proposals for task orders will be at the rates incorporated into the contract.
Question/Clarification- the addition of (e) seems to contradict the original verbiage in (c).
Please clarify what verbiage regarding adjustment of approved billing rates the Government deleted.
Will the contractor be allowed to adjust its rates in Attachment 4 yearly? Or will the proposed rates be fixed for the entire IDIQ period?
RESPONSE: Paragraph (c) of Section H adjusted. The contractor will not be allowed to adjust its rates; the proposed rates will be fixed for the entire IDIQ period. Please see revised solicitation document.
2. Question 9 from Amendment 2 Q&A asked the following.
Task order 0001 PWS indicates 1 FTE equals 1880 hours. The PoP for task order 0001 is 10 months, including 1 month of phase in. Shouldn’t the FTE be lower than 1880?
RESPONSE: No.
Please confirm the Govt’s answer of “No” to this question. 1880 hours is representative of one man-year, or 12 months of effort. Task Order 0001 is for 10 months.
RESPONSE: 1880 hours is representative of one man-year or 12-months of effort. Task Order 0001’s Period of Performance is 10 months.
3. Would the Government consider a proposal due date of December 8, 2015 based on the length of time it took to issue the Amendment 2 Q&A, coupled with two Federal Holidays that will occur by December 1 and these additional questions?
RESPONSE: Proposals are due 1 December 2015.
4. In the Q&A released on 12 November 2015, the response to question 1a states “Please use historical hours and suggested labor categories provided in the Performance Work Statements and Attachments 3 & 4.” We have the following follow-up questions.
a) Is this response intended to be a firm requirement that all bidders must bid exactly the same total level of effort regardless of technical approach?
RESPONSE: No.
b) If the response to the above question is yes, does this requirement apply to Task Order 0001, or only to future task orders?
RESPONSE: See response to 4 (a) above.
5. Request clarification for showing subcontractor costs on the Cost Summary form and its relation to Attachment 4, Labor Category Rates for Task Orders.
a) Please confirm that subcontractor costs (including their labor costs) are to be shown on the line titled “Subcontractor Costs” and not included in the Direct Labor section.
RESPONSE: Confirmed.
b) Note 1 of Attachment 4 states “In regards to subcontractor rates, it shall be up to the prime and subcontractor to negotiate one single rate for each labor category of the proposal.” However, in the Q&A released on 12 November 2015, the response to question 6b states “Please provide the base labor (unburdened) rates in Attachment 4. Given that base labor rates may be competition proprietary information not be disclosed to the prime bidder, should the labor rates in Attachment 4 be just the prime bidder’s base labor rates or should a composite rate of the team be provided for each labor category, in which case such labor rates would need to be at the fully burdened without fee level?
RESPONSE: Attachment 4 should specify the unburdened rates for each labor category.
