8. FAR clause 52.212-1, Instructions to Offerors – Commercial Items (Jan 2017) applies to this acquisition and the below addendum is also applicable.

Addendum 52.212-1 Instructions to Quoters – Commercial Items

52.212-1 is replaced in its entirety with the contents of this addendum.

(a) Small Business Status. The NAICS code and small business size standard for this acquisition appear on the Request for Quote Cover Sheet. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submitting the quote. A signed and dated quote must be submitted in writing to the address/email specified on the Request for Quotation (RFQ) Cover Sheet. Quoters may submit more than one quote. If multiple quotes are proposed, the Government will evaluate each quote separately.

Information to be submitted in the quote.

(1) The Request for Quotation number;

(2) Company name, address, CAGE, DUNS number and telephone number

(3) “Remit to” address, if different than mailing address;

(4) Acknowledgement of any amendments to this RFQ;

(5) A Statement of assent to all of the terms, conditions, and provisions of the RFQ.

Quoters that fail to furnish required representations or information, or reject the terms and conditions of the RFQ may be excluded from consideration.

(6) Specified validity period of at least 90 days.

(6) A technical description of the service being quoted in sufficient detail to evaluate: a) company’s technical experience with same/similar scope of work, b) availability of adequate technical staff to perform the work, and c) detailed outline of onboarding and commencement of services no later than 14 business days after purchase order award.

This response should not exceed 15 pages.

(7) Proposed price and any discount terms as outlined as specified in the Cover Sheet;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Past performance summaries for 3 to 5 current and/or former federal/state/commercial customers, who will attest to the quality, timeliness, and cost control of your services rendered within the past three years that are recent and relevant to the scope and complexity proposed in the Performance work statement. The summary must include:

customer name, address, telephone number, email address, person of contact, contract or purchase order number, and summary of work that was performed.

(c) Late submissions, modifications, revisions, and withdrawals of quotes. Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, to the Contracting POC by the specified date and time on the Cover Sheet. Quotes received after the quotation’s deadline will be considered “late” and will not be considered unless it is received before purchase order is made, and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and will be in the best interest of the Government.

(d) Issuance of purchase order. The initial quote should contain the Quoter’s best terms. The Government intends to evaluate quotes and award a purchase order without discussions.

However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if the action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.

(e) Availability of Government Documents. If the service description in the RFQ refers to any Government specification, standard, or commercial item description, you may obtain a copy of any such documents from the sources contained in the Performance Work Statement or the sources listed in Federal Acquisition Regulation 52.212-1, paragraph (i).

(f) System for Award Management. Unless exempted by the Contracting Officer, the Quoter must register in SAM at the time of the quote submission. If Quoter is not registered at time of evaluation and selection, the Contracting Officer may issue the order to a different quoter. Once registered, the Quoter must remain registered throughout performance until final payment. To obtain information on registration and annual confirmation requirements, review the following website. https://www.acquisition.gov.

(g) DUNS Number (Data Universal Numbering System Number). [This applies to all quotes] Place the annotation “DUNS” or “DUNS+4” next to your name and address on the first page of your quote followed by the DUNS or DUNS+4 number that identifies the quoter’s name and address.

https://www.acquisition.gov/

If you do not have a DUNS number, contact Dun and Bradstreet to obtain one. If you are located within the United States, you may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform.

If you are located outside the United States, you must contact the local Dun and Bradstreet office for a DUNS number. Tell Dun and Bradstreet that you are a Quoter for a Government contract when contacting the local Dun and Bradstreet office.

The DUNS+4 is the DUNS number plus a 4-character suffix that you may use at your discretion to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for your company.

(h) Debriefing. If a post-award debriefing is requested by the Quoter, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Quoter’s submission.

(2) The overall evaluated price and technical rating of the successful and debriefed quoter and past performance information on the debriefed quoter.

(3) The overall ranking of all quoters, if ranking was developed by the agency during evaluation.

(4) A summary of rationale for award;

(5) Reasonable responses to relevant questions posed by the debriefed quoter as to whether evaluation procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(a) The Government will award a Firm Fixed Price purchase order with Time & Material travel CLIN resulting from this solicitation to the responsible Quoter whose quotation, which conforms to the solicitation and Performance Work Statement, inclusive of attachments, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotations:

Technical and Managerial capability to provide and perform the services required to meet the Government’s need

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. (c) Before the Quoter’s specified expiration time, the Government may accept a quote, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
