Questions and Answers
1. The solicitation appears to have been changed from a small business set aside to unrestricted. However, the bottom of page 15 in the solicitation document states: "The proposed contract is a 100 percent set-aside for small business."
Answer: The bottom of page 15 will be amended as it was overlooked.
According to FAR 19-502.2 "Each acquisition of supplies and services that has an anticipated dollar value exceeding $3,000 but not exceeding $150,000 ... is automatically reserved for small business concerns". Is there a reason why the small business requirement was removed, since one or more previous responses were from small businesses?
Answer: Our office dissolved the small business set-aside solely on pricing not being fair and reasonable. No technical evaluations were performed.
2. The original requirement for 50/50 performance for a small business doesn't appear to apply when considering the services being solicited.
According to 52-219.6 (c), "A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns...."
However, According to 52-219.6, Alternate I (Oct 1995) "When the acquisition is for a product in a class where which the Small Business Administration has determined that there are no small business manufacturers or processors in the Federal Market according to 19-502.2(c), delete paragraph (c).
Answer: IAW FAR 13.106-3, "Before making award, the contracting officer must determine that the proposed price is fair and reasonable." Thus, we did not go forward with the solicitation and are now re-soliciting full and open.
It appears that this solicitation is required to be set aside for a small business, and per deletion pf paragraph (c), no requirement exists for the end-items to have been produced by the small business, but can be subcontracted. Will you consider awarding to a small business that subcontracts according to the above FARs?
Answer: We have opened this solicitation to both small and large businesses. If you wish to submit your proposal, please do so.
3. The start of the period of performance stated in the solicitation document (April 1) is already past the due date for submissions (April 15th). What are start and end dates for the revised period of performance for each CLIN (year)?
Answer: Based on internal processes and once an offeror has been chosen, the new period of performance is projected to be 24 April 2015- 23 April 2020.
4. Since part of the reason for re-submitting for the solicitation was to acquire based on "fair and reasonable based on the government's estimate", can you provide any details about your market research results, and pricing range that you are expecting?
We will not be providing the government estimate.
