52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will select the best overall offer based on the Technical Capability, Cost Savings Approach, and other factors considered. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be the greatest cost savings to the Government in accordance with the evaluation criterias outlined at FAR 52.212-2 of the solicitation entitled “Evaluation- Commercial Items. Technical capability is further divided into the following subfactors, Performance Work Statement, Management Plan, Quality Control. Technical factor is equally as important as the Cost Savings Approach factor. The government seeks to award to the offeror who gives the greatest cost savings to the Government. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. A rating of unacceptable at the factor or subfactor level will render the entire proposal unacceptable. The Government will determine technical acceptability based on responses to the evaluation factors. In making this decision, the Source Selection Authority (SSA) will analyze the results from the Source Selection Evaluation Team (SSET) evaluations of the evaluation factors. While the SSET and the SSA will strive for maximum objectivity, the selection process, by its nature, is subjective and, therefore, professional judgment is implicit throughout the entire process. Technical Capability Subfactors

An award will be made to the Contractor from the pool of technically acceptable proposals, whose cost savings approach is the greatest cost savings to the government. The evaluation team will begin by selecting the proposal with the greatest cost savings and evaluating for technical capability. Once the greatest cost savings, technically acceptable proposal is found, evaluation of proposals will end. Any part of the offeror’s proposal that does not meet the technically acceptable rating, will be considered unacceptable The Government will exclude an offeror from further consideration if it determines that its proposal failed to meet a solicitation requirement and the proposal is determined technically unacceptable.
