SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
EVALUATION FACTORS
SECTION M - EVALUATION FACTORS FOR AWARD
M-1 BASIS FOR AWARD
1.0 The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is determined to be the lowest priced technically acceptable offeror with satisfactory performance. The evaluation process shall proceed In Accordance With (IAW) the evaluation instructions listed below.
M-2 EVALUATION FACTORS AND PROCESS
2.0 By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or sub factors. All technically acceptable offers shall be treated equally except for their prices and performance records. Failure to meet a technical requirement may result in an offer being determined technically unacceptable.
Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall be conducted as follows:
2.1. Factor 1 – Price/Contract Documentation Proposal. For the evaluation of Factor 1, the US Government will review each of the proposed prices and completeness of the proposal. Section L provides detailed information on each of the sections and what the offeror is responsible to provide. Initially, offers will be ranked according to price.
The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A complete proposal must be submitted in order for an offeror to be considered for award IAW Section L. Contract documentation will be rated as either “acceptable” or “unacceptable”.
3.0. Factor 2 – Technical Capability. The offeror’s technical capability will be reviewed and assigned one of the following ratings. The rating depicts whether the offeror’s technical proposal meets the requirements IAW the stated evaluation criteria and solicitation requirements set forth in Section L.
Definition of Technical ratings:
RATING DEFINITION
Acceptable Meets/exceeds specified minimum performance or capability requirements specified in Section L of this solicitation.
Unacceptable Fails to meet specified minimum performance or capability requirements as specified in Section L of this solicitation. Proposals with an unacceptable rating are ineligible for award.
Technical Acceptability. Initially, the government technical evaluation team shall evaluate the technical proposals on a pass/fail basis, assigning ratings of Acceptable or Unacceptable. Only the three (3) lowest priced proposals determined to be technically acceptable will be considered for further evaluation. The proposals shall be evaluated against the following sub factors:
1. Subfactor 1 - Quality Control: The offeror’s quality control plan and methodology will be evaluated on its completeness and IAW project specification Section 01 45 00.00 20, Construction Quality Control.
2. Subfactor 2 - Technical Capabilities: The offeror’s technical capabilities plan will be evaluated on its completeness and whether offeror can clearly demonstrate capability by providing information that represents technical expertise and project management capabilities IAW section L of the solicitation.
3. Subfactor 3 - Schedule: The offeror’s progress schedule will be evaluated on its completeness, adherence to the performance period listed in the solicitation, and feasibility.
4.0 Factor 3 – Past Performance Information. The offeror’s Past Performance will be reviewed and assigned one of the following ratings. The rating depicts whether the offeror’s proposal meets the requirements IAW the stated evaluation criteria and solicitation requirements set forth in Section L.
Table A-2. Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the
Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Past Performance Acceptability. Next, the government technical evaluation team shall evaluate past performnace proposals on a pass/fail basis, assigning ratings of Acceptable or Unacceptable. The proposals shall be evaluated against the following sub factors:
1. Subfactor 1 – Recency Asscessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing (50% complete) or must have been completed within the past three (3) years from the date of issuance of this solicitation. Past performance information that is not recent will not be evaluated.
2. Subfactor 2 – Relevancy Assessment: The US Government will conduct an in-depth evaluation of all recent performance information obtained to determine the degree of relevance of the past performance.
Factors that will help determine relevancy include, but are not limited to: Painting work relating to facilities/buildings; projects with similar scheduling requirements and constraints; projects involving paint work that is similar or greater in scope, magnitude and complexity than the effort described in this solicitation.
3. Subfactor 3 – Contractors Performance: An assessment of the contrators past performance will be made to determine wheather the offeror’s proposal meets the requirements IAW the stated evaluation criteria and solicitation requirements set forth in Section L.
Additional Information:
a. Offeror may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.
b. The US Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The US
Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
