QUESTIONS AND ANSWERS

FA5682-18-R-0005 Packing and Crating Services, Aviano AB

Q1. Addendum to FAR 52.212-1 Instructions to Offerors-Commercial Items. Offer Preparation Instructions.

Paragraph A, second sentence requires “acknowledgement of compliance with all solicitation terms and conditions.” It is not clear as to how this acknowledgment is to be provided.

Does submittal of a signed offer (pursuant to subparagraph B) satisfy this requisite or do you expect a separately signed statement indicating compliance with all solicitation terms and conditions?

Would the content and types of documents required for the evaluation factors not satisfy this requisite and hence render this statement redundant?

A1. Acknowledgment of the solicitation means, as stated in paragraph B. of the provision FAR 52.212-1 addendum, completing blocks 12, 17a, and 30a, b, and c of the SF 1449. In doing so, the offeror accedes to the contract terms and conditions as written in the SOLICITATION, with attachments.

Acknowledgment of the solicitation amendments means completing blocks 8 and 15a, b and c of the

SF 30.

Q2. There is confusion as to the anticipated type of contract as various terminologies are utilized throughout the solicitation document versus a single term.

Can you please specify exactly the type of contract that is anticipated to be awarded as this impacts pricing decisions?

A2. The term "Fixed-price" is used to describe a contract's pricing arrangement. The term "requirements" is used to describe a contract's delivery arrangement. A contract's delivery arrangement and its pricing arrangement are two different, unrelated, aspects of the contract, and therefore the type of contract awarded will be Firm-fixed price requirements type of contract. In accordance with FAR Part 16, the Requirements Type contract is utilized (as indicated by DFARS 252.216-7010) because the Government anticipates recurring requirements but cannot predetermine the precise quantities of services that will be needed during the period of performance. The CLINs will be priced as Firm Fixed Priced (as indicated by FAR 52.216-1) because this is a commercial acquisition with adequate price competition and a stable market.

Q3. Clauses FAR 52.232-19 - Availability Of Funds For The Next Fiscal Year (Apr 1984) and FAR 52.232-4 Payments Under Transportation Contracts And Transportation-Related Services Contracts (Apr 1984) do not aid in ridding the confusion but rather increase it since they are in conflict. The former indicates funds are not available for next fiscal year for which it would but the latter suggests that payment for services will be from funds are come from Permanent Change of Station PCS orders or by AF 150 and hence not subject to the former.

A3. Permanent Change of Station (PCS) expenses are chargeable to the Line of Accounting (LOA) subject to Fiscal Year (FY) fund appropriations apportioned by Office of Management and Budget (OMB) to Department of Defense (DoD) who then allocates funds to the PCS Obligating Unit on annual basis, and prior to the beginning of the Fiscal Year and therefore both clauses apply to this acquisition.

Q4. Part II – Technical Capability Factor In view of the statement in II. Technical Capability Evaluation. “The government will evaluate technical offers and the below listed sub-factors”, can you please indicate if the intention is to receive a volume that addresses the individual paragraphs of the PWS (DTR Appendix G) or a volume that addresses the evaluation factors in accordance with the respective tasks of the PWS.

The Technical Volume shall, at a minimum, be prepared in a form consistent with the PWS and the evaluation criteria for award set forth in the “Evaluation Factors for Award” section of this solicitation.

QUESTIONS AND ANSWERS

FA5682-18-R-0005 Packing and Crating Services, Aviano AB

The section shall be prepared in an orderly format and in sufficient detail to enable the government to make a thorough evaluation of the contractor’s technical competence and ability to comply with the contract task requirements specified in the PWS. The offeror shall address as specifically as possible the actual methodology proposed for accomplishing the PWS tasks. The Technical Capability Offer shall be organized according to the following general outline…

A4. As indicated in the prescription FAR 52.212-2 the Technical Part of the offer shall include:

Technical Capability

1. Contractor’s Qualifications

2. Contractor’s Quality Control Plan

3. Prime Contractor’s Prior Technical Experience

Q5. II. Technical Capability Evaluation.

Prime Contractor’s Technical Experience: In evaluation of this subfactor, the Government will confirm that the offeror did submit an Individual Reference for 3 contracts within the last 5 years through the issue date of subject solicitation, demonstrating that the offeror provided services relevant to those required in the PWS. In view of the International Tender of Service (TOS) which covers GBL household goods shipments in the same fashion as this DPM but on a greater scale the requirement for 3 contracts should be reduced to a minimum of 2 just like other DPM solicitations issued by the Army and Navy in Italy.

A5. Technical sub-factor Prime Contractor’s Prior Technical Experience will be used as an indicator that the offeror will successfully perform a contract to be awarded. To be found acceptable the offeror must demonstrate that he has already provided services relevant to those required in the PWS. Relevant performance includes effort involving similar scope or greater in scope, magnitude and complexity than the effort described in this solicitation. The Direct Procurement Method does not define how many previous contracts the Contracting Officer can require as part of the evaluation.

Q6. Is the unit of issue NTCW (Net Hundred Weight) in pounds or kilograms?

A6. The unit of issue (UOI) is NTCW pounds.

Q7. Does the Combined Synopsis/Solicitation under solicitation number FA568218R0005 contain requirements similar to a current contract?

If possible, please provide the current contract number.

Or, is this a new requirement for the government?

A7. The current contract is FA5682-13-D-0002 contains similar requirements and is not new to the government.
