ADDENDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS
1.0 GENERAL INFORMATION
1.1 Basis of Contract Award. This is a best value source selection conducted in accordance with
(IAW) Federal Acquisition Regulation (FAR) 15.3 as supplemented. FAR 15.101 states that best value is obtained by using any one or a combination of source selection approaches. This source selection utilizes a multiple award Highest Technically Rated Offeror methodology.
The evaluation methodology is not a Tradeoff, the Government is not seeking the Lowest Priced Technically Acceptable proposal, and the Government will not evaluate Cost/Price. As authorized in FAR 15.304(c)(1)(ii)(A), the Government intends to make an award to each and all qualifying offerors. Per FAR 2.101, a qualifying offeror is defined as “an offeror that is determined to be a responsible source, submits a technically acceptable proposal that conforms to the requirements of the solicitation, and the contracting officer has no reason to believe would be likely to offer other than fair and reasonable pricing (10 U.S.C. 2305(a)(3)(D)).”
Thus, the Government intends to award to all qualifying offerors who satisfy the criteria of section 1.1.1 below, satisfy the Pass/Fail Questions and meet or exceed the minimum criteria outlined in section 1.1.1.1. Any responsible Offeror providing a proposal that meets this definition will represent the best value for the Government and will be awarded an IDIQ contract.
1.1.1 In order to determine that an Offer constitutes Best Value, the Government must determine:
(1) the Offeror is responsible IAW FAR 9.104-1; (2) the Offeror’s proposal conforms to the solicitation requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the Instructions to Offerors) and meets the definition of a qualifying offeror IAW FAR 2.101; and (3) the Offeror’s proposal satisfies the Pass/Fail Questions and meets or exceeds the Technical Experience Scoring Sheet thresholds established in section 1.1.1.1 below.
1.1.1.1 For the Government to determine an offer a Highest Technically Rated Offer, the Offeror must respond “Yes” to all Pass/Fail Questions, and meet or exceed the following minimum scores for each evaluation group of Technical Experience in the “Self Scoring Matrix” (Appendix C):
1. Group I: 12,000 points (ITO Section 2.4.2.3)
2. Group II: 6,500 points (ITO Sections 2.4.2.4 and 2.4.2.5)
3. Group III: 5,000 points (ITO Section 2.4.2.6)
First, the Government will validate all “Yes” responses to the Pass/Fail Questions. If all “Yes” responses are validated, the Government will then validate the Offeror’s Technical Experience self-score in each evaluation group. The maximum score for each evaluation group of the Technical Experience in the “Self Scoring Matrix” (Appendix C) is as follows:
Page 2 of 4 FA564121R0006 / Amendment 0005
1. Group I: 20,000 points (ITO Section 2.4.2.3)
2. Group II: 10,000 points (ITO Sections 2.4.2.4 and 2.4.2.5)
3. Group III: 7,000 points (ITO Section 2.4.2.6)
Any Offeror meeting the criteria in sections 1.1.1 and 1.1.1.1 will be eligible for contract award.
1.1.2 While the Government source selection evaluation team and the SSA will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
1.2 Number of Contracts to be Awarded. For the purpose of establishing the Indefinite Delivery
Indefinite Quantity (IDIQ) Contract Pool, the Government intends to make award to each and all qualifying offerors as defined by FAR 2.101 who satisfy the criteria of section 1.1.1 above, satisfy the Pass/Fail Questions, and meet or exceed the minimum criteria of section 1.1.1.1.
The Government reserves the right to exercise “on-ramping” as described under Special Contract Requirements, “H001 ON-RAMP (15 November 2021)” of this solicitation, to award additional contracts at any point within the ordering period, to include options. In the event that the Government elects to exercise “on-ramping” procedures, the Government may exceed the number of contracts initially awarded.
1.3 IDIQ Ceiling. The overall ceiling of the IDIQ is estimated at $91M for a maximum seven (7) year ordering period including authorization at the delivery order level for an additional year of performance beyond the end of the ordering period. The total value of all delivery orders awarded under the IDIQ will not exceed this amount.
1.4 Minimum Guaranteed Delivery Order. The Government will hold a Post-Award Conference with each IDIQ awardee. The delivery order for the Post-Award Conference is $2,500.00 and will satisfy the minimum order requirement. A Contractor that is awarded an IDIQ contract is not guaranteed any delivery order beyond the Post-Award Conference delivery order. The Cost/Price of the Post-Award Conference will not be evaluated.
1.5 Proposal Substantiation. Unsubstantiated and/or misleading claims in a proposal, for even a single Technical Experience evaluation criterion, could result in the Government determining that the Offeror’s proposed self-score is disingenuous and/or artificially inflated. If this were to occur, the Government would unilaterally downward adjust the score, potentially down to zero (0) points as described in Section 4.1.
1.6 Discussions. The Government intends to award these IDIQ contracts without discussions, but reserves the right to conduct discussions with one, some or all Offerors if necessary. Any discussions will be conducted in accordance with FAR 15.306. Additionally, the Government reserves the right to contact the Prime Offeror or any Team Members/Subcontractors to
Page 3 of 4 FA564121R0006 / Amendment 0005 substantiate, understand, or clarify any of the evidence provided, in accordance with FAR 15.306(a)(2). These clarifications may be provided in the form of Evaluation Notices (ENs).
2.0 REQUIRED INFORMATION AND RESPONSIBILITY
2.1 Information Required in Offeror Proposals. Offerors shall meet all solicitation requirements, such as terms and conditions, representations and certifications, and other instructions identified within the solicitation. Offerors shall comply with content required within each of the proposal volumes and sections. Failure to comply with any requirement of the solicitation may prevent complete evaluation of offers and result in the Offeror being ineligible for award.
2.2 Responsibility. No award shall be made to an Offeror unless the Contracting Officer determines them to be responsible. To be determined responsible, an Offeror shall meet the general standards described in FAR 9.104-1. The Contracting Officer may consider information provided within any volume of the proposal when making the determination of responsibility.
2.3 Organizational Conflict of Interest (OCI). Organizational Conflict of Interest issues are treated in a manner similar to responsibility determinations. An Offeror’s actual or potential OCI concerns must be avoided, mitigated, or neutralized before that Offeror may receive an award of this contract.
3.0 EVALUATION METHODOLOGY AND FACTORS
3.1 Evaluation Methodology. Per FAR 15.304(c)(1)(ii)(A), the Government contemplates awarding an IDIQ contract to each and all qualifying offerors meeting or exceeding the minimum criteria in sections 1.1.1 and 1.1.1.1 above. There will be no trade-offs between cost/price and other factors, and the Government is not seeking the lowest price technically acceptable proposal. The HTRO method requires each Offeror to score itself on Factor 1:
Technical Experience, based on the objective criteria described in the Instructions to Offerors.
First, the Government will validate all “Yes” responses to Pass/Fail Questions. In the case of a “No” response, the proposal will not be further evaluated. If all “Yes” responses are validated, the Government will then evaluate all proposed self-scores for Factor 1 that are equal to or above the minimum points required in section 1.1.1.1.
3.2 Evaluation Factors. The Government will use the following evaluation factor to evaluate each proposal:
Factor 1: Technical Experience
IAW 10 U.S.C. 2305(a)(3)(C)(i), Cost/Price will not be evaluated during this source selection;
Cost/Price will be evaluated for each individual DO.
Page 4 of 4 FA564121R0006 / Amendment 0005
4.0 Factor 1 – Technical Experience.
4.1 Technical Experience Evaluation. The Government will validate each Offeror’s “Yes” responses to the Pass/Fail Questions. In the case of a “No” response to a Pass/Fail Question, the proposal will not be further evaluated. For all proposals with validated “Yes” responses to the Pass/Fail Questions, the Government will validate all proposed self-score points equal to or above the minimum points required in section 1.1.1.1. In the case of a “Yes” response the Government can not validate, the offer will be determined technically unacceptable and will not be further evaluated. Only proposals with validated “Yes” responses to all Pass/Fail Questions will be evaluated for their self-scores on the Self Scoring Matrix, Groups I, II, and
III.
The Government will validate each Offeror’s self-score points using the work samples provided by the Offeror, and the documents required by the Instructions to Offerors. The Government will review the section of the work sample that is listed within the “Cross Reference Matrix” (Appendix D). If the substantiating information cannot be found within the referenced page, section, paragraph, table, etc., the Government will not search further for the substantiating information. If the Offeror’s score cannot be validated based on the work samples and “Cross Reference Matrix,” the Government will unilaterally downward adjust the score, potentially all the way down to zero (0) points. The Government will only adjust the Offeror’s self-score downward, not upward. Such adjustments are within the sole discretion of the Government.
The Government intends to award this IDIQ contract without discussions, but reserves the right to conduct discussions with one, some or all Offerors if necessary. Any responsible and qualifying Offeror providing a proposal that satisfies the requirements of section 1.1.1 and satisfies the Pass/Fail Questions and meets or exceeds the minimum Technical Experience scores in section 1.1.1.1, will represent the best value for the Government and will be awarded an IDIQ contract.
