ATTACHMENT 5 – CLAUSE 52.228-4 AND QUESTIONS AND ANSWERS

The following clause has been added to the Solicitation:

FAR 52.228-4, Workers’ Compensation and War-Hazard Insurance Overseas.

WORKERS’ COMPENSATION AND WAR-HAZARD INSURANCE OVERSEAS (APR 1984)

(a) This paragraph applies if the Contractor employs any person who, but for a waiver granted by the Secretary of Labor, would be subject to workers’ compensation insurance under the Defense Base Act ( 42 U.S.C.1651, etseq.). On behalf of employees for whom the applicability of the Defense Base Act has been waived, the Contractor shall (1) provide , before commencing performance under this contract , at least that workers’ compensation insurance or the equivalent as the laws of the country of which these employees are nationals may require, and (2) continue to maintain it until performance is completed.

The Contractor shall insert, in all subcontracts under this contract to which the Defense Base Act would apply but for the waiver, a clause similar to this paragraph (a) (including this sentence) imposing upon those subcontractors this requirement to provide such workers’ compensation insurance coverage.

(b) This paragraph applies if the Contractor or any subcontractor under this contract employs any person who, but for a waiver granted by the Secretary of Labor, would be subject to the War Hazards Compensation Act ( 42 U.S.C.1701, etseq.). On behalf of employees for whom the applicability of the Defense Base Act (and hence that of the War Hazards Compensation Act) has been waived, the Contractor shall , subject to reimbursement as provided elsewhere in this contract , afford the same protection as that provided in the War Hazards Compensation Act, except that the level of benefits shall conform to any law or international agreement controlling the benefits to which the employees may be entitled. In all other respects, the standards of the War Hazards Compensation Act shall apply; e.g., the definition of war-hazard risks (injury, death, capture, or detention as the result of a war hazard as defined in the Act), proof of loss, and exclusion of benefits otherwise covered by workers’ compensation insurance or the equivalent. Unless the Contractor elects to assume directly the liability to subcontractor employees created by this clause, the Contractor shall insert, in all subcontracts under this contract to which the War Hazards Compensation Act would apply but for the waiver, a clause similar to this paragraph (b) (including this sentence) imposing upon those subcontractors this requirement to provide war-hazard benefits.

(End of clause)

NO QUESTION ANSWER

PWS Paragraph 4.11 PLACE AND HOURS OF OPERATION states, “Services are to be performed at the 86th Medical Group, Ramstein Air Base, Germany during the following hours: 0700-1630 hours (to include a 1-hour lunch break daily): Monday through Friday, including German holidays, but excluding U.S.

Federal holidays. Workdays will generally consist of eight-hour days. Hours are subject to change as mutually agreed between the FRED and the Contractor, however, the total number of hours will not exceed 80 hours every two weeks.

If work hours are from 0700 – 1630 with a 1-hour lunch break, this equates to 8 ½ working hours per day. This would exceed the 80 hours every two weeks restriction. Please clarify if individuals are expected to work 8 ½ hours per day and if at the end of the two weeks, the individual is given appropriate compensatory time (approximately 5 hours in a two-week period).

The times indicated in the PWS were incorrect;

this has been corrected and the work hours are

0730-1630.

Attachment 1 Pricing Schedule states for each CLIN, “In accordance with (IAW) the attached Performance Work Statement (PWS), including relocation cost, if any.”

Relocation and associated costs are not referenced in the PWS or other attachments. Please confirm that the contractor must include relocation costs into their proposal.

We hereby confirm that all relocation costs must be included in the CLIN pricing.

The PWS does not reference a “Phase In/Out” period.

In order to ensure a smooth transition from the incumbent contractor, will the government authorize a phase-in/out period and if so, how long is this authorized for?

Once new staff gain CAC and systems access, we will allocate 4 weeks for training and turnover.

Are contractors required to use the SCA wage determination for this opportunity? If so, please clarify which job title contractors should use for services required?

Per FAR 22.1003-2, The Service Contract Labor Standards statute applies to service contracts performed in the United States (see 22.1001).

The Service Contract Labor Standards statute does not apply to contracts performed outside the United States.

Will the government provide SOFA or Logistical support for this role? Yes, see PWS, paragraph 4.8

Who are authorized to bid on this opportunity? Is this applicable for vendors whose companies are registered in Germany only? Or this is also applicable to vendors outside Germany?

This acquisition is open to all interested parties regardless of where their physical business address is located.

Is this is a follow-on requirement or a new contract? If it is a follow on contract, could you please provide the incumbent contract number and the awarded price?

This is a follow-on contract. The current contract number is FA561320F0134, and the award amount is $417,351.20.

How many people are currently working under this contract?

There are 4 positions under the current contract, but currently all 4 of the positions are vacant.

Please confirm, so there would be 4 FTE’s required to perform under this contract? 1 LPN and 3 Medical Services Coordinator – Administrative Support?

Yes, we confirm that 1 Licensed Practical Nurse (LPN) and 3 Medical Services Coordinators for

Administrative Support are required.

Under paragraph (b)(6) Technical Capability, page 46 of 52 of Attachment 3, it states:

(A) Past Experience (limited to two pages per evidence): The offeror shall submit evidence of at least one (1) year of contract performance (or the past experience of a joint venture partner or key subcontractor that will perform major or critical aspects of the requirement) during the previous five (5) years from the issuance date of the solicitation, where the offeror is/was responsible for Referral Management Center Support Services including the same or similar tasks described in Attachment 2, Performance Work Statement (PWS). No resumes of individual potential candidates will be accepted as past experience for evaluation. Resumes received with proposals will be removed and not considered for evaluation purposes.

Does it mean that the offeror need to submit a written statement stating that the offeror were able to provide Referral Management Center Support Services/similar tasks in the previous/past contract/s performance?

The offeror is required to provide contract references and descriptions of the services your company has provided that meet the criteria as set forth in the solicitation. Note, no resumes of potential candidates will be evaluated for contract award and will be removed and not considered during the evaluation process.

Please confirm NO RESUMES will be submitted along with the proposal?

Resumes received with proposals will be removed and not considered for evaluation purposes.

Does it require to submit potential candidate’s documents along with the proposal like copy of license, certificates, diploma/transcript, etc.?

No. Resumes received with proposals will be removed and not considered for evaluation purposes. Upon award of the contract the contractor is required to provide potential candidate information to MDG personnel for approval prior to hiring as per PWS 4.1.2.

Please confirm what are the provided Government Furnished Equipment (GFE) to support for these roles?

There is no Government Furnished Property (GFP) provided under this effort. However, the government will have existing workstations with computers, office supplies, etc. for personnel to use in performance of their duties.

14 Please confirm the submission due date and time. Proposals are due on 29 March, 1600hrs CET
