PERFORMANCE WORK STATEMENT (PWS)

for

86TH AIRLIFT WING SAFETY BASH MANAGER SERVICES

AT RAMSTEIN AIR BASE, GERMANY

1.0 DESCRIPTION OF SERVICES

1.1 OVERVIEW OF SERVICES. Non-personal services in support of the 86th Airlift Wing Safety (86th AW/SE) Bird/Wildlife Aircraft Strike Hazard (BASH) program falconry services. The contractor shall be responsible for furnishing all necessary management, tools, equipment including weapons, vehicles, material, licenses, and labor necessary to hunt birds and other wildlife to assist in the safety of air traffic, particularly in the airfield environment at Ramstein Air Base (RAB), Germany. These services are considered to be non-mission essential.

2.0. SPECIFIC REQUIREMENTS. The contractor shall perform services as stated and shall be in possession of the required German hunting/falconer license. Services shall be performed in accordance with all German Federal and State Hunting Law (Bundes- und Landesjagdgesetz), the German Federal and State Environmental Protection Law (Bundes- und Landesnaturschutzgesetz) and the German threatened and endangered (T&E) species regulation (Bundesartenschutzverordnung), and the Air Force Pamphlet (AFPAM) 91-212, Bird/Wildlife Aircraft Strike Hazard (BASH) Management Techniques. The contractor is exempt from all German hunting and environmental law restrictions if performing an emergency depredation because of flight safety reasons within the Controlled Movement Area (CMA) (as defined in the Memorandum of Understanding (MOU) between the 86th AW and the German Federal Forest Department, available upon request). Services will include operation of BASH cannons situated on the flightline as well as other BASH tools such as pyrotechnics, bioacoustics and effigies.

2.1. SUBTASK 1 – Basic Services

2.1.1. The contractor shall use multiple hunting birds in the RAB Flight Line area an estimated 25 times per month, for a total of approximately 300 visits annually, in order to control wildlife which are detrimental to safe flight operations at Ramstein Air Base. During critical months, as defined by 86th AW/SE and in accordance with the BASH Phase II program, the contractor shall conduct at least 25 visits per month. The critical months are estimated between May and October each year, but may change per wildlife migration and 86th AW/SE guidance. BASH tools such as BASH cannons, bioacoustics, pyrotechnics, and effigies may also be utilized to assist with these operations.

2.1.2. During visits, the contractor is authorized to depredate wildlife inside the Controlled Movement Area (CMA) or depredate wildlife which may enter the CMA. The contractor is authorized to depredate with a shotgun or rifle. The contractor is required to use only authorized shotguns/rifles/ammo in accordance with Appendix B. The contractor shall dispose of all wildlife at an off-base facility at no additional cost to the Government.

2.1.3. The contractor shall coordinate visits with identified Airfield Management Point of Contact prior to start of work. The contractor will be provided a Government-furnished radio and coordinate radio frequency with Airfield Management/Air Traffic Control. The contractor shall maintain radio contact with the Government at all times while performing services. The contractor shall report to Airfield Management prior to leaving RAB to return the Government-furnished radio. The contractor shall provide their own transportation while performing services.

2.1.4. The contractor shall coordinate the visit schedule in accordance with 2.1.1. with the Contracting Officer Representative (COR) no later than 5 business days prior to the start of each work week. The contractor shall schedule visits during low flying periods as identified by Airfield Management. The start of the work week is defined by the contractor. The work schedule shall alternate each week between morning and afternoon coverage. Each visit shall last, at a minimum, 4 hours.

2.1.5. The contractor shall compile and submit a control log (see Appendix A) to the COR no later than 3 business days from the beginning of each month. The control log, at a minimum, shall include: wildlife observed, wildlife depredated, and start/end times of each visit.

2.2. SUBTASK 2 – Emergency and Special Event Services

The contractor shall perform services as stated in 2.1 under emergency or special event criteria as identified in paragraphs 2.2.1 through 2.2.2.

2.2.1. Upon notification, the contractor shall report and perform emergency or special event services. Visits may be required after normal duty hours (after sunset) to keep birds from resting on the aircraft.

2.2.2. The contractor shall provide a contact number and will be considered on-call during days when not scheduled for visits. If called, the contractor shall respond within 2 hours of notification. On-call status (24 hours/7 days a week) will only be utilized by the Government during critical months as defined in 2.1.2. On-call status during normal duty hours (Monday – Friday, 0800-1630) will be utilized during non-critical months.

4.0. GENERAL INFORMATION

4.1. BASE ACCESS. The contractor shall be responsible for obtaining the appropriate access passes for all personnel employed under this contract prior to performance. If applicable, the contractor shall be responsible for obtaining the appropriate vehicle pass(es). The Government will not escort the contractor employees on base during the performance of this contract, unless the contractor has made an expedient and best effort to obtain the passes prior to performance and have not been issued the passes by the appropriate authorities.

4.1.1. SECURITY CHECKS. In accordance with (IAW) United States Army in Europe (USAREUR) Regulation 604-1, Foreign National Employee Screening Program, and the contractor will complete Army in Europe (AE) Form 604-1B for each employee assigned to perform under this contract in order to be issued a pass. The completed forms shall be submitted to the COR as soon as possible, but. The COR will submit the forms to appropriate authorities for a security check. The COR will also check the names of all employees against the USAREUR and United States Air Forces in Europe (USAFE) consolidated installation disbarment list prior to employees beginning work under this contract. Disbarred employees shall not perform under this contract. The contractor shall also submit all necessary paperwork to receive their restricted access badge no later than 10 business days after award.

4.2. MANAGEMENT. The contractor shall identify a Contract Manager (CM) and an alternate. The names of these individuals shall be designated in writing and provided to the Contracting Officer (CO), no later than 10 business days after contract award. The CM and alternate shall be able to use the English language fluently and accurately on all levels normally pertinent to professional needs. The CM and alternate must be able to read English fluently and accurately on all styles and forms of the language pertinent to professional needs. The contractor shall appoint a lead who shall be responsible for coordinating with the COR to obtain and clarify contract requirements and who will be responsible for the daily control and supervision of contractor's employees.

4.3. PLACE OF PERFORMANCE/HOURS OF WORK. Services shall be performed on RAB, Germany. Normal duty hours are 0800 – 1630, Monday through Friday. The contractor may be required to work other than normal duty hours, IAW 2.2., including German holidays and US Federal holidays.

4.4. CONTRACTOR MANPOWER REPORTING. The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) for performance of services provided under this contract for the Air Force via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance for each Government Fiscal Year (FY), which runs 1 October through 30 September. While inputs may be reported at any time during the FY, all data shall be reported not later than 31 October of each calendar year. Contractor may direct questions to the CMRA help desk.

4.5. CONFORMANCE WITH ENVIRONMENTAL MANAGEMENT SYSTEMS

4.5.1. The Contractor shall perform work under this contract consistent with the relevant environmental policy and objectives identified in the installation environmental management system (EMS) applicable for your contract. The Contractor shall perform work in a manner that conserves water, energy and other resources to the maximum extent feasible and ensure minimum production of waste as possible, giving preference to recycling and reutilization opportunities. Furthermore, the Contractor shall give preference to less toxic materials whenever available and still reliable for their work. In the event an environmental nonconformance or noncompliance of host nation and USAF environmental laws and regulations associated with the contracted services is identified, the contractor shall take corrective and/or preventative actions. In the case of a noncompliance, the Contractor shall respond and take corrective action immediately. In the case of a nonconformance, the Contractor shall respond and take corrective action based on the time schedule established by the EMS Coordinator. In addition, the Contractor shall ensure that their employees are aware of the environmental management system on base and how these requirements affect their work performed under this contract.

4.5.2. All on-site contractor personnel shall receive the installation EMS awareness level information.

4.5.3. Conformance with Environmental Requirements. The contractor shall perform all work in accordance with applicable German and US Air Force environmental laws, regulations and operating standards, including but not limited to the Final Governing Standards (FGS) for Germany. The contractor shall be immediately capable of understanding and addressing environmental laws and regulations as they pertain to work performed under this contract.

4.5.4. The FGS for Germany and other important environmental laws & requirements applicable for all contractors working on base will be provided upon request.

5.0. GOVERNMENT- FURNISHED PROPERTY. The Government will provide the contractor a radio to maintain contact with Airfield Management while performing duties. The contractor shall return the radio to the Government prior to leaving RAB. The Government will provide vehicle identification decals for the contractor’s use while performing duties on the flight line. The Government will provide the contractor with airfield driving training prior to start of operations on the airfield.
