FAR Clause 52.212-1, Instruction to Offerors-Commercial Items (Feb 2012), is hereby tailored in accordance with the following:
52.212-1 (c) is hereby tailored to read as follows: Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

QUOTATION PREPARATION INSTRUCTIONS
This procurement is being solicited under the Federal Acquisition Regulations FAR Part 12, Commercial Items and
FAR Part 13.5 Test Program for Certain Commerial Items .
A. To assure timely and equitable evaluation of the quotation, the offeror must follow the instructions contained herein. The quotation must be complete, self-sufficient, and respond directly to the requirements of this solicitation.
The response shall consist of three (3) separate parts:
Part I – Capability of the item offered to meet the Government requirement.
Part II – Past and Present Performance
Part III – Price
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.
C. Specific Instructions:
1. PART I – TECHNICAL CAPABILITY- Submit original and one (1) copy.
(a) Subfactor 1, Certifications and Licenses
All certifications and licenses must be current on the date of receipt of qoutation(s), and maintained throughout the life of the contract.
*Note: The licenses and certifications shall contain or accompany with English Translation.

PART II – PAST AND PRESENT PERFORMANCE QUESTIONNAIRE
(a) Offerors shall use Solicitation Attachment 4 ( Past and Present Performance Information) for submission of the quotation.
(b) Past and Present Performance information (Solicitation Attachment 4): Provide a list of no more than five (5), of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years from the issuance date of the solicitation. Relevant contracts include efforts involving the delivery of bulk fuel. The evaluation of past and present performance information will take into account past and present performance services. Furnished the following information for each contract referenced of Attachment 2.

ADDENDA TO FAR 52.212-2, EVALUATION--COMMERCIAL ITEMS:
BASIS FOR CONTRACT AWARD: This is a competitive Lowest Price Technically Acceptable (LPTA) source selection under procedures in FAR Part 12 and 13.5. Offerors will be evaluated using the factors identified in FAR
52.212.-2, Evaluation – Commercial Items, and this addendum. Noncompliance with the RFQ may be grounds to eliminate the quotation from consideration for contract award. Failure to meet a non-price factor may result in an offer being determined technically unacceptable. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors (and its addendum), the offeror accedes to the terms of this model contract. The evaluation process will proceed as follows:

B. Past and Present Performance: Using Past and Present Performance information (Solicitation Attachment 4), the Government will seek recent and relevant performance information on all offerors based on the references provided by the offeror (Solicitation Attachment 2) and data independently obtained from other government or commercial sources.
(i) Recent performance information includes relevant contracts performed for the Department of Defense, or
Government of Japan, or US Government agencies, or commercial customers within the last three (3) years from the issuance date of the solicitation.
(ii) Relevant performance includes performance of efforts involving delivery of bulk fuel. that are similar or greater in scope, magnitude, and complexity than the effort described in this solicitation. The Government will use the relevancy definitions and ratings in Table 2 below when assessing for relevancy:

Therefore, the offeror shall be determined to have an unknown past performance. In the context of acceptability/unacceptability, “Unknown” shall be considered as “Acceptable.”.
C. Price Evaluation. Next, the government shall rank all technical Acceptable offers by price. An offeror’ s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the unit price for each item to confirm the extended amount for each. The price evaluation will document the reasonableness and completeness of the proposed total evaluated price based upon individual unit price. Copies of the Pricing Schedule will be necessary in order to submit a quotation.
In order to meet the requirements of FAR Part 6 and FAR Part 17, the price equivalent to the 6 months extension of services authorized by FAR 52.217-8 will be evaluated separately for the performance period, and will be factored as part of the total evaluated price for award. The Government will use the offeror’s proposed Price by a quantity equivalent to 6 months under FAR 52.217-9, in order to evaluate the extension of services authorized by FAR
52.217-8. The Government reserves the right to perform price realism analysis.
D. Offerors are cautioned to submit sufficient information and in the format specified in paragraph ADDENDUM
TO FAR 52.212-1, Instructions to Offerors-Commercial Items, Part II Past and Present Performance Information.
Offeror’s may be asked to clarify certain aspects of their quotation (for example, the relevance of past and present performance information) or respond to adverse past/present performance information to which the offeror has not previously had an opportunity to respond. Communication conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserve the right to award a contract without the opportunity for quotation revision.
E. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAY 2014)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the
Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment
Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Service-disabled veteran-owned small business concern--
