52.212-1 (c) is hereby tailored to read as follows: Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

QUOTATION PREPARATION INSTRUCTIONS

This procurement is being solicited under the Federal Acquisition Regulations FAR Part 12, Commercial Items and

FAR Part 13.5 Test Program for Certain Commerial Items .

A. To assure timely and equitable evaluation of the quotation, the offeror must follow the instructions contained herein. The quotation must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

The response shall consist of three (3) separate parts:

Part I – Capability of the item offered to meet the Government requirement.

Part II – Past and Present Performance

Part III – Price

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition.

Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.

C. Specific Instructions:

1. PART I – TECHNICAL CAPABILITY- Submit original and one (1) copy.

(a) Subfactor 1, Certifications and Licenses

All certifications and licenses must be current on the date of receipt of qoutation(s), and maintained throughout the life of the contract.

*Note: The licenses and certifications shall contain or accompany with English Translation.

PART II – PAST AND PRESENT PERFORMANCE QUESTIONNAIRE

(a) Offerors shall use Solicitation Attachment 4 ( Past and Present Performance Information) for submission of the quotation.

(b) Past and Present Performance information (Solicitation Attachment 4): Provide a list of no more than five (5), of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years from the issuance date of the solicitation. Relevant contracts include efforts involving the delivery of bulk fuel. The evaluation of past and present performance information will take into account past and present performance services. Furnished the following information for each contract referenced of Attachment 2.

(i) Company/ Name of Offeror

(iii) Contracting Agency/Customer and Address

(iv) Period of Performance

(v) Contract # or equivalent Identifier – if none, type” No contract number or identifier”

(vi) Contract Amount (Yen or $)

(vii) Verified, up-to-date name, address, FAX, email address, and telephone number of point of contact (POC) - the contracting Officer or equivalent personnel of contracting agency/customer

(viii) Remarks - Comments regarding compliance with contract terms and conditions.

(c) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the quotation a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.

(d) Documents submitted in response to this solicitation must be fully responsive to and consistent with the following:

1. Requirements of the solicitation: FA5270-14-T-0147 and Performance-Based Work Statement (PWS), and government standards and regulations pertaining to the PWS.

2. Evaluation Factors for Award.

2. PART III – PRICE QUOTATION - Submit original and one (1) copy.

(a) Complete blocks 12, 17a, and 30a, b, and c of the SF 1449. In doing so, the offeror accedes to the contract terms and conditions as written in the SOLICITATION, with attachments. The SOLICITATION constitutes the model contract.

(b) Insert proposed unit prices for each Contract Line Item Number (CLINs) including all option periods in the Price

Exhibit A of the SF1449. The extended amount must equal the whole dollar unit price multiplied by the number of units. Incomplete pricing may result in a quotation being no longer considered for award.

(c) Complete the necessary fill-ins and certifications in the provisions. The provisions FAR 52.212-3 shall be returned along with the quotation.

Offerors shall complete appropriate fill-ins of the following provision, clause addendum, and provisions under the addendum.

(2) PRE-QUOTATION CONFERENCE/ SITE VISIT

Offerors are highly encouraged to attend scheduled site visit. Offerors shall use Pre-Quotation Conference/Site

Visit Form (Solicitation Attachment 2) in order to make a reservation for attendance. Site visit date is specified on the Pre-Quotation Conference/Site Visit Form. Offerors are highly encouraged to download the all solicitation documents from Federal Business Opportunities (FedBizOpps.Gov: https://www.fbo.gov/) before attendance, and hand-carry the documents for the event.

GENERAL INFORMATION

INFORMATION REGARDING SUBMISSION OF QUOTATION: Hand carried quotations must be deposited in the bid depository located at 18 th

Contracting Squadron, Bldg 95, Kadena AB, Okinawa, Japan. The sealed envelope or package used to submit your quotation must show the time and the date specified for the receipt, the Solicitation

Number, and the name and address of the offeror. There is a time and date stamp at the drop location. Offerors are cautioned that Kadena AB, Okinawa, Japan has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. SOME DELAY SHOULD BE ANTICIPATED WHEN

HANDCARRYING QUOTATIONS. Offerors should allow sufficient time to obtain a visitor pass and arrive at the bid depository PRIOR to the time specified for receipt. Late quotations will be processed in accordance with FAR

52.212-1(f) “Late submission, modifications, revisions, and withdrawals of offers.”

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

A. Technical Capability of the item offered to meet the Government requirement.

B. Past and Present Performance

C. Price

(b) Extension of Services. The Government will evaluate offers for award purposes by adding the total price for 6 months extension of services to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of 6 months extension of services shall not obligate the Government to exercise the 6 months extension of services.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDA TO FAR 52.212-2, EVALUATION--COMMERCIAL ITEMS:

BASIS FOR CONTRACT AWARD: This is a competitive Lowest Price Technically Acceptable (LPTA) source selection under procedures in FAR Part 12 and 13.5. Offerors will be evaluated using the factors identified in FAR

52.212.-2, Evaluation – Commercial Items, and this addendum. Noncompliance with the RFQ may be grounds to eliminate the quotation from consideration for contract award. Failure to meet a non-price factor may result in an offer being determined technically unacceptable. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors (and its addendum), the offeror accedes to the terms of this model contract. The evaluation process will proceed as follows:

A. Technical Acceptability. The Government will evaluate the technically quotations by assigning an

Acceptable or Unacceptable rating (see Table 1 below). The quotations will be evaluated against the following subfactor1.

All copies of certifications and licenses to perform services in Japan are listed below. All certifications and licenses must be current on the date of receipt of quotation(s), and maintained throughout the life of the contract

B. Past and Present Performance: Using Past and Present Performance information (Solicitation Attachment 4), the Government will seek recent and relevant performance information on all offerors based on the references provided by the offeror (Solicitation Attachment 2) and data independently obtained from other government or commercial sources.

(i) Recent performance information includes relevant contracts performed for the Department of Defense, or

Government of Japan, or US Government agencies, or commercial customers within the last three (3) years from the issuance date of the solicitation.

(ii) Relevant performance includes performance of efforts involving delivery of bulk fuel. that are similar or greater in scope, magnitude, and complexity than the effort described in this solicitation. The Government will use the relevancy definitions and ratings in Table 2 below when assessing for relevancy:

(iii) The past and present performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. Offerors must receive a past and present performance rating of “Acceptable” to be eligible for award. The past and present performance factor will receive one of the ratings in Table 3 below:

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without record of relevant past performance or for whom information on past performance is not available or so sparse that meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).

Therefore, the offeror shall be determined to have an unknown past performance. In the context of acceptability/unacceptability, “Unknown” shall be considered as “Acceptable.”.

C. Price Evaluation. Next, the government shall rank all technical Acceptable offers by price. An offeror’ s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the unit price for each item to confirm the extended amount for each. The price evaluation will document the reasonableness and completeness of the proposed total evaluated price based upon individual unit price. Copies of the Pricing Schedule will be necessary in order to submit a quotation.

In order to meet the requirements of FAR Part 6 and FAR Part 17, the price equivalent to the 6 months extension of services authorized by FAR 52.217-8 will be evaluated separately for the performance period, and will be factored as part of the total evaluated price for award. The Government will use the offeror’s proposed Price by a quantity equivalent to 6 months under FAR 52.217-9, in order to evaluate the extension of services authorized by FAR

52.217-8. The Government reserves the right to perform price realism analysis.

D. Offerors are cautioned to submit sufficient information and in the format specified in paragraph ADDENDUM

TO FAR 52.212-1, Instructions to Offerors-Commercial Items, Part II Past and Present Performance Information.

Offeror’s may be asked to clarify certain aspects of their quotation (for example, the relevance of past and present performance information) or respond to adverse past/present performance information to which the offeror has not previously had an opportunity to respond. Communication conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserve the right to award a contract without the opportunity for quotation revision.

E. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.
