am52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2:

This is a competitive best value source selection in which competing offerors past performance history will be evaluated on a basis of approximately equal to price. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors, the offeror accedes to the terms of this model contract.

All technically acceptable offers shall be treated equally except for their prices and performance records. Failure to meet a requirement may result in an offer being determined technically unacceptable. The evaluation process shall proceed as follows:

A. Technical Acceptability. Initially, the Government technical evaluation team shall evaluate the technical proposals by assigning an Acceptable or Unacceptable rating (see Table 1 below). The proposals shall be evaluated against the following subfactor:

Subfactor 1, Disposal Plan – the plan shall include the following:

a. Copies of certifications and permits as specified in Performance-Based Work Statement (Attachment 1) paragraph 1.2.1, Special Requirements: Disposal. Permits must be current on the date of award, and maintained throughout the life of the contract.

b. Number(s) of Incinerators offeror has access to.

c. Provide landfill(s) information on:

i. The future capacity to include maximum capacity;

ii. Landfill’s current fill level

iii. Estimated collection per year and end of useful life

B. Past Performance. Next, the Government shall seek recent and relevant performance information on all technically acceptable offerors based on (1) the references provided by the offeror, (2) past performance information obtained from questionnaires (Attachment 3), and (3) data independently obtained from other Government or commercial sources.

Recent performance information includes relevant contracts performed for the Department of Defense, Government of Japan, US Government agencies, and commercial customers within the last three (3) years from the issuance date of the solicitation.

Relevant performance includes performance of efforts involving Army Refuse Collection and Recycle Services that are similar or greater in scope, magnitude, and complexity than the effort described in this solicitation. The Government will use the relevancy definitions and ratings in Table 2 below when assessing for relevancy:

The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the offeror’s ability to provide Army Refuse Collection and Recycle Services that meet the solicitation requirements based on the offeror’s demonstrated record of performance. The assessment process will result in an overall performance confidence assessment rating of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Unknown confidence as defined in Table 3 below. Past performance regarding predecessor companies, or subcontractors that will perform major or critical aspects of the requirement will not be rated as highly as past performance information for the principal offeror. Offerors with no relevant past or present performance history or the offeror’s performance record is so limited that no confidence assessment rating can be reasonably assigned shall receive the rating “Unknown Confidence,” meaning the rating is treated neither favorably nor unfavorably (neutral).

C. Price Evaluation. Lastly, the Government shall rank all technically Acceptable offerors (and Unacceptable offers with correction potential) by price, including all option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Price Schedule by the proposed unit price for proposed unit for each Contract Line Item Number to confirm the extended amount for each. The price evaluation will document the reasonableness and completeness of the proposed total evaluated price. The Government reserves the right to perform price realism analysis.

NOTE: In order to meet the requirements of FAR Part 6 and FAR Part 17, the price equivalent to the six (6) months extension of services authorized by FAR 52.217-8 will be evaluated separately, and will be factored as part of the total evaluated price for award. The Government will calculate prices for a quantity equivalent to 6 months by prorating prices offered for CLIN 0001 thru CLIN 0007 and all corresponding CLINs under Options of FAR 52.217-9 and evaluate such prices for reasonableness.

(a) Definitions.

As used in this clause-

(1) Foreign person means any person other than a United States person as defined in Section 16(2) of the Export Administration Act of 1979 (50 U.S.C. App. Sec. 2415).

(2) United States means the 50 States, the District of Columbia, outlying areas, and the outer Continental Shelf as defined in 43 U.S.C. 1331.

(3) United States person is defined in Section 16(2) of the Export Administration Act of 1979 and means any United States resident or national (other than an individual resident outside the United States and employed by other than a United States person), any domestic concern (including any permanent domestic establishment of any foreign concern), and any foreign subsidiary or affiliate (including any permanent foreign establishment) of any domestic concern which is controlled in fact by such domestic concern, as determined under regulations of the President.

(b) Certification.

By submitting this offer, the Offeror, if a foreign person, company or entity, certifies that it -

(1) Does not comply with the Secondary Arab Boycott of Israel; and

(2) Is not taking or knowingly agreeing to take any action, with respect to the Secondary Boycott of Israel by Arab countries, which 50 U.S.C. App. Sec. 2407(a) prohibits a United States person from taking.

(c) Representation of Extent of Transportation by Sea. (This representation does not apply to solicitations for the direct purchase of ocean transportation services).

(1) The Offeror shall indicate by checking the appropriate blank in paragraph (c)(2) of this provision whether transportation of supplies by sea is anticipated under the resultant contract. The term "supplies" is defined in the Transportation of Supplies by Sea clause of this solicitation.
