However, the Government may conduct Clarifications with one, some, none or all offerors at its discretion.

VII. FAR 52.212-1, Instructions to Offerors--Commercial Products and Commercial Services applies to this acquisition.

a. Provide pricing utilizing CLIN breakout under section III of this combined synopsis/solicitation and provide offer details in Attachment 1 – FA524024QM067 Requirements List.

b. Provide vendor information specified in section IV of this combined synopsis/solicitation.

c. Include specifications in Attachment 1 – FA524024QM067 Requirements List in “Additional

Information Needed” section. Offers that do not include information per manufacturer specifications may be deemed ineligible for award. At minimum, specifications should include manufacturer and part number; otherwise, we cannot evaluate for technical acceptability and the quote may be deemed unacceptable. Include salient physical, functional, and/or performance characteristics to include any and all catalog cuts for the equipment requested.

VIII. FAR 52.212-2, Evaluation--Commercial Products and Commercial Services applies to this acquisition.

a. The Government will award a contract from this solicitation to the responsible offeror whose offer conforming to the solicitation is most advantageous to the Government based on the best overall offer that is determined to be the best value to the Government. The following factors shall be used to evaluate offers and are listed in descending order of importance:

i. Acceptability in accordance with (IAW) solicitation.

Rating Description

Acceptable

Offer clearly meets the minimum requirements of the specifications provided in Attachment 1 – FA524024QM067

Requirements List.

ii. Price.

The Contracting Officer shall conduct a price analysis in accordance with FAR 12.209. Offerors are cautioned that the award may not necessarily be made to the lowest price offered. The Government is more concerned with obtaining the best value than with making an award at the lowest overall price to the Government. However, the Government will not make an award at a significantly higher overall price to obtain an offer that exceeds the minimum requirements of the solicitation and/or specifications.

iii. Delivery Terms.

Acceptable delivery period. Offers that exceed a total delivery period of 120 calendar days ARO may be deemed unacceptable.

b. A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

c. BASIS FOR AWARD / EVALUATION PROCEDURES:

i. The Government will first evaluate offers for acceptability. Offers will then be evaluated based on price. Offer will additionally be evaluated with consideration of delivery time, if the offer exceeds the acceptable delivery period (see Section VIII(a)(iii)), the Government reserves the right to rate the offer as technically unacceptable. Award will then be made to the technically acceptable offer determined to represent the best value to the Government. If only one “Acceptable” offer is received, the Government will attempt to determine price to be fair and reasonable through means other than competition.

ii. Award will be made on the initial evaluation of quotes received in response to this RFQ.

Therefore, offerors are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. Offerors are further advised that any affirmative response regarding FAR 52.204-24(d) will be reviewed to determine if award is in the best interest of the government. If award is not in the best interest of the government, the government reserves the right to determine the quote ineligible for award.

IX. FAR 52.212-3, Offeror Representations and Certifications – Commercial Items is included in this solicitation. The contractor must have a valid Representations and Certifications filed in the System for

Award Management (SAM) and furnish the government a completed copy of the record with its offer.

X. FAR 52.212-4, Contract Terms and Conditions-Commercial Items applies to this acquisition. No addenda to this clause.

XI. FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders

Commercial Products and Commercial Service, and additional clauses and provisions applicable to this solicitation and resulting award are listed in Attachment 2 – Provisions and Clauses.

XII. All firms must be registered and active in the System for Award Management (SAM) database at https://www.sam.gov/SAM/ to be considered for award.
