The Air Force is procuring Motorola NICE Inform Recorder support services, including annual preventative maintenance, on-site response, technical support, and infrastructure repair for the recorders used at the Primary and Alternate Emergency Control Centers. This is a brand name purchase under simplified acquisition procedures, as Motorola is the sole manufacturer of the NICE recorders currently in use. The estimated contract value is $31,854.60. The requirement will be competed among small businesses that are authorized Motorola resellers or distributors. Market research confirmed that at least three small businesses expressed interest and are capable of providing the required support services. NICE Inform Recorder is a call logging software which reliably logs and synchronizes 911 calls, including digital, analog, and VoIP calls, conventional and radio transmissions, text -to-911 interactions, video, images, console screens, locations from geographic information systems (GIS), and integrated feeds from other sources such as CCTV video. The services will be used for the NICE recorders present at the Primary Emergency Control Center and Alt ECC.
III. Description of supplies/services required to meet agency needs (including the estimated value).

IV. Statutory authority permitting other than full and open competition.
This acquisition is being pursued under simplified acquisition procedures, specifically under FAR 13.106-1(b), for a brand name purchase. This requirement will be competed among small businesses that are authorized resellers or distributors of Motorola Solutions.
V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).
Motorola Solutions is the manufacturer of the NICE Inform Recorders and associated software that Andersen AFB uses at the Primary and Alternate Dispatch Center. Since Andersen Air Force Base uses Motorola NICE Inform Recorders, any purchase from other than Motorola would degrade mission readiness and increases cost of operation via timeliness of repairs and maintenance as there is no other remote support besides Motorola Solutions. If this service contract does not get funded and the recording systems go down, Andersen Fire Department will lose recording capabilities and will not be in compliance with NFPA 1221.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
Sources sought was posted on SAM.gov from 7 June 2024 to 14 June 2024. Three small businesses expressed interest in this procurement.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
In accordance with FAR 13.106-3(a)(1), the government anticipates receiving two or more competitive offers in response to the solicitation to judge price fair and reasonableness.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
In addition to examining current market availability and other possible contracting vehicles, market research was also conducted by posting a sources sought notice through the GPE. Three small businesses expressed interest in the requirement. All three businesses are able to provide Motorola NICE Inform Recorder support. At this time, the NICE Recorder units are not needed as they were purchased previously on contract FA524021P0071. The respondents to the sources sought have satisfactory past performance with contracts that utilize Motorola services or products. One vendor, AEG Group Inc, has serviced Andersen AFB radio needs as recently as of this fiscal year and was awarded a contract for Motorola Radio programming and installation.
Locally, Motorola Solutions is the only certified vendor that is capable of doing this job on Guam. If another vendor receives the award, they will likely sub-contract to Motorola Solutions. All DOD agencies use Motorola for Land Mobile Radio and 911 communications. Ensuring services and parts are streamlined with Motorola is critical in maintaining uniformity across systems and partner agencies that also use the systems and technology.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Currently, the NICE recorders are on warranty for FY23; however, this workload has now expired. Andersen Fire Department has previous contracts of Motorola Vesta 911System (FA524023P0034) and Motorola Portable Radios (FA524022F0106), which the NICE recorders also record for all 911 calls and radio transmissions. With the recorders not being maintained, it will not only affect 911 and admin lines, but all radio transmission communication. Due to the nature of the requirement, and its direct impact on the safety of emergency responders, it is in the best interest of the Government to move forward with a standardized approach for this equipment by purchasing Motorola NICE Recorders support services.

2) Anbessa Mundus LLC
3) BHPE LLC
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Prevention of future barriers to competition by electing not to pursue a Motorola brand name purchase is not entirely possible without replacing existing equipment and degrading mission capability, which will drive costs and not meet program compliance IAW NFPA 1221. However, because Motorola partners with other vendors that are authorized resellers/distributors, competition can still be pursued IAW FAR 19.502-2 and FAR 13.106-1(b) as a total small business set aside after exclusion of sources. Current market research confirms there are at least two or more qualified Motorola distributors/resellers willing to meet the government's requirement.
