Description

This is an announcement that constitutes the only solicitation; quotes are being requested and a written synopsis will not be issued in accordance with FAR Part 5.202(13). This is not to be construed as a commitment by the Government. All information is to be submitted at no cost to the Government.

The solicitation will be issued as a Request for Quotation (RFQ) under the solicitation number FA5215-17-Q-7007 for Open Line Indicators supporting Headquarters PACAF at JBPH-H, HI in Japan, Korea, Guam and Alaska.

This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) FAC 2005-95, as of 19 January, 2017;

Defense Federal Acquisition Regulation Supplement Publication Notice (DPN) 20161222 and Air Force Acquisition Circular (AFAC) 2017-0127.

This acquisition is a Small Business Set-Aside in regards to size standards. The applicable NAICS is 561621, Security Systems Services (except Locksmiths) and the small business size standard is $20,500,000.00.

This RFQ contains fourteen (14) CLINS on a firm fixed price basis. The line items are as follows:

Acceptance will be performed by the Government. The FOB Point is destination.

The FAR provision 52.212-1, Instruction to Offerors-Commercial Items applies to this acquisition. Addenda to the following paragraphs of 52.212-1 are:

(a) All quotes are due on or before 8:00 AM, Hawaii Standard Time (HST), 08 September 2017. Submission MUST be made via email to the Contract Specialist, Mr. Daxton Lyon at daxton.lyon@us.af.mil AND to the Contracting Officer, Dayna Asuncion at dayna.asuncion@us.af.mil. Quotes must reference the solicitation number FA5215-17-Q- 7007. The Government intends to evaluate all quotes and award without Discussions.

(b) System for Award Management (SAM). Offerors must be registered in the SAM database to receive a contract award. If the offeror is not registered in the SAM database, the Contracting Officer will proceed to award to the next otherwise successful registered offeror. Instructions to register your entity to be eligible for contracts in SAM are located at www.SAM.gov.

In addition, 52.212-2(a) Evaluation- Commercial Items, the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor shall be used to evaluate offers: Lowest Price Technically Acceptable.

Award of the contract resulting from this solicitation will be made to the offeror whose proposal is the lowest price technically acceptable offer (LPTA). Offers must be technically acceptable based on the factors below to be eligible for award.

1. Factor 1 – Price

Price consideration will be an important factor in the award of this contract. Proposed prices will be evaluated to determine completeness and reasonableness of CLINS 0001 thru 0014.

2. Factor 2 – Technical

(a) Offerors shall provide a Technical Proposal that addresses the two technical evaluation criteria:

(1) Technical Approach

(i) At a minimum, the offeror’s Technical Proposal must demonstrate their understanding of Department of Defense (DoD), United States Air Force (USAF), and customer technical requirements/standards by selecting products that meet or exceed the Government’s requirement(s).

(2) Delivery and Installation Schedule

(i) The offeror must define a delivery and installation schedule that will guarantee successful compliance with all technical and contractual requirements set forth in the

SOO.

TECHNICAL EVALUATION - Quotes will be reviewed and evaluated in accordance with the evaluation criteria identified below:

(a) All offerors shall be ranked from lowest-priced, to highest-priced. The three (3) lowest priced offerors’ quotes shall be reviewed for Technical Acceptability. Those outside the initial evaluation pool will not be evaluated, unless necessary to obtain the desired effective competition of three (3) offers rated as "acceptable" in all technical sub factors or until all offerors have been evaluated.

(b) The Technical Factors (A. Technical Approach and B. Delivery and Installation Schedule) may be given a rating of either Acceptable or Unacceptable. The following table details what will deem an “acceptable” or “unacceptable” rating:

(c) Representation. The offeror represents that—

52.209-5 Certification Regarding Responsibility Matters (Vendor Fill-in)

(a)

(1) The Offeror certifies, to the best of its knowledge and belief, that --

(i) The Offeror and/or any of its Principals --

(A) Are [_] are not [_] presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have [_] have not [_], within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C.

§6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C.

§6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has [[_] has not [_], within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) “Principal,” for the purposes of this certification, means an officer; director;

owner; partner; or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law. (Feb 2016)

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web- Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. (d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
